ACCEPTING EASEMENT OVER PORTION SECTION 15, TOwNSHIP 138
RANGE 4w, SEBM
WHEREAS, it is necessary for the completion of the water system for
a shopping center and church that an easement be accepted by the Board of
Directors of the San Dieguito Irrigation District. The O~TLers of the property,
Paul and Magdale~e Ecke, have executed an easement over the property on the
East side of the Paddock Restaurant and the South side of Encinitas Boulevard,
and presented same for acceptance;
NOW, THEREFORE, BE IT RESOLVED that the officers of the District be, and
they hereby are, authorized to acce~t for recording that particular easement,
a copy of which is attached hereto marked Exhibit "A' , and by this reference
made a part hereof.

as Grantee, receipt whereof is hereby acknowledged, does hereby grant unto said San DieguitC1 Irrigation District, its
successors and assigns, an exclualve and permanent ea.sement of right of way in, upon, over and across the lands
hereinafter described, for the purpose of loca.ting, relocating, constructing, reconstructing, maintaining, operating, in-
specting and repairing a pipe line or pipes lines, and all fixtures and appurtenances Incidental thereto for use in con.
nection therewith, for the transmission and distribution of water and all uses and purposes incidental thereto. together
with the right of ingress thereto and egress therefrom, to and along said right of way, together with the right to clear
and keep clear said rigbt of way from buildings, structures, explosive, trees, and other material or growths detriment.

The lands in which such easement of right of way is hereby granted are situated in the County of San DiegO', State
of California, and pa.dicularly described as follows. to wit:

A 10.00 foot strip of land being in a portion of the North Half of the Southeast Quarter
of the Northwest Quarter of Section 15, Township 13 South, Range 4 West, San Bernardino
Meridlan, In the County of San Diego, State of California, according .to Official Plat
thereof, said 10.00 foot strip lying 5.00 feet on each side measured at right angles to
the following described Centerline:
Th& route of said eaaement of right of way acroM the aforesaid lands shall be as follows:
Beginning at the intersection of the South line of the North Half of the Southeast Quarter of the
Northwest Quarter of said Section 15 with the Easterly right-of-way of Callfornla State Highway
XI-SD-5; thence along said South line South 89005'53" East 133~ .17 feet to the Southeast comer
of said North Half of the Southeast Quarter of the Northwest Quarter of Section 15; thence along
the North-South centerline of said Section 15 North 1057'1111 East 287.92 feet: thence .leaving
said North-South line North 88002'49" West 69.40 feet to a point in the centerline of that cer-
tain easement to San Dieguito Irrigation. District Recorded 8-22-25 as Document No. 41152,
Book 1114/125 of Deeds flied in the Office of the County Recorder of said County. Said point
being the true point of beginning of Parcel "An; thence North 540:--02'16" West 18.74 feet: thence
North 86'49'10" West 54.09 feet; thence North 67'49'45" West 88.00 feet; thence North
68031'50" West 143.50 feet; thence North 84019'51" West 159.40 feet; thence North 88033156"
Wast 121.69 feet; thence North 89015129" West 106.07 feet to a point of terminus.
The sidelines of said easement to be lengthened or shortened to end in a line which bears
North 8'03'00" West through said TRUE POINT OF TERMINUS .
It is expreesly agreed that the Grantor shall have the right, at his own riek, to use the surface of the right of way
hereby granted. for agricultural uses except for the planting and growing of trees; and the right to crOll!! or make use
of the surface in a manner not detrimental to the installation, construction, operation. inspection. repair, maintenance
and replacement of a. pipe line or pipe lines. OT to any other purposes and usell as are or may be necessary or incidental
to the construction, maintenance and operation of the Grantee's proposed pipe line or pipe lines.
And the GrantOT hereby agrees for himself. his successors or assigns, that he will not plant treell or cOMtruct or
cause to be constructed and maintained any buildlngll or structures of any nature or kind within ten feet of said pipe
line; or store (fJ' permit to be stored or use upon said right of way any blasting suppliea or explo.sivell commonly uaed for
blasting purpo8ell.
And the Grantee hereby agreell that it will avoid unreasonable interference with the use by Grantor and hill succes-
sors of said right of way. and agrees not to fence the same, and agreell that the Grantor may enjoy the surface use of
the land herein described, subject to' the conditions above stated; and agreell to permit the 1nstallation by the Grantor of
water pipes reasonably required for Grantor's use on his said property over and acrollS the right of way in a manner
which will not interfere with the Grantee's pipe linell and operations, provided, if the location 13 to be under Grantee's
pipe lIne,1.t must be installed subject to Grantee's supervision and approval, and the Grantee agreell, after the installa-
tion of its pipe Unell, to restore the surface grade above the pipe to as near the original elevation as practicable. All
present installed u".illties wlll be interfered with as little as possible and if interrupted will be promptly relltored to Ulle
at the expeD.lle of the Grantee.
