PROCEDURES FOR ADDRESSING THE ZONING ADMINISTRATOR ORAL COMMUNICATIONS FOR MATTERS NOT ON THE AGENDA: Thirty (30) minutes are set aside at each meeting for citizens who wish to address an issue not on the agenda. The purpose of oral communications is to bring to the attention of the Zoning Administrator a matter or matters which do not appear on the agenda. Remarks shall be addressed to the Zoning Administrator /Secretary and not to any staff or the public. State law prohibits Zoning Administrator action on non - agenda items because the public would be unaware prior to the meeting of any potential action. If needed, Oral Communication items will be referred to the Development Services Department either for resolution by administrative action. Each speaker comment is allowed three (3) minutes. Time donations are not permitted during Oral Communications. REGULAR AGENDA ITEMS: Each speaker comment is allowed three (3) minutes to address the Secretary and staff. PROJECT NAME: Mackinnon Avenue sidewalk improvements; CASE NUMBER: CDP- 003557 -2020; FILING DATE: January 14, 2020; APPLICANT: City of Encinitas; LOCATION: Mackinnon Avenue between Birmingham Drive and Warwick Avenue; PROJECT DESCRIPTION: A public hearing to consider a Coastal Development Permit to demolish the existing sidewalk improvements and install new sidewalk improvements on the east side of Mackinnon Avenue north of Birmingham Drive and south of Warwick Avenue to accommodate Americans with Disabilities Act (ADA), curb, gutter and driveway apron improvements along this segment; ZONING /OVERLAY: The subject property is located in the Residential 8 (R -8) zone and the Public /Semi - Public (P /SP) zone and the Coastal Commission Appeal Jurisdiction of the Coastal Zone; ENVIRONMENTAL STATUS: The project has been determined to be exempt from environmental review pursuant to Section 15301(c) of the California Environmental Quality Act (CEQA) Guidelines. Section 15301(c) exempts the demolition of and installation of streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities.
