A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN
DIEGUITO WATER DISTRICT ADOPTING A DISCONTINUATION OF
WATER SERVICE POLICY
WHEREAS, Senate Bill No. 998 ("SB 998"), added Chapter 6, Discontinuation of
Residential Water Service, to Part 12 of Division 104 of the Health and Safety Code, requiring
water agencies to adopt written policies related to the discontinuation of residential water
service for nonpayment; and
WHEREAS, the San Dieguito Water District ("District") is required to comply with the
provisions of SB 998, which are mandatory, by February 1, 2020
WHEREAS, the District Board of Directors has been presented with the Discontinuation
of Water Service Policy ("Policy") related to discontinuation of water service for nonpayment;
and
WHEREAS, the Policy has been reviewed and considered, and found by the Board to be
in the interest of the District; and
WHEREAS, a copy of the Policy is attached as Exhibit 1 to this Resolution; and
WHEREAS, the District is in the process of updating its Administrative Code,
provisions of which may be in conflict with the Policy.
NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED that the
Board of Directors of the San Dieguito Water District does hereby adopt the proposed
Discontinuation of Water Service Policy, attached hereto as Exhibit 1 and incorporated by this
reference, effective on February 1, 2020.
BE IT FURTHER RESOLVED that, to the extent the Discontinuation of Water Service
Policy is in conflict with the District's current Administrative Code, the Discontinuation of
Water Service Policy shall control.
PASSED, APPROVED AND ADOPTED this 18th day of December 2019 by the San
Dieguito Water District, Encinitas, California.
