A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA, APPROVING AMENDMENTS TO THE GENERAL PLAN AND LOCAL
COASTAL PROGRAM
CASE NUMBER: 18-047 GPA/ZA/LCPA/BA (APN: 259-221-92 and 259-221-93)
SECTION ONE. The City Council of the City of Encinitas hereby finds and declares as follows:
WHEREAS, with adoption of Resolution No. 2017-70 on September 20, 2017, the City
Council.authorized the applicant to submit an application to initiate amendments'to the General
Plan, Zoning Map, and Local Coastal Program for the property located at 2423 Fifth Street
(APN: 259-221-92);
WHEREAS, the City of Encinitas received an application for General Plan, Local Coastal
Plan, and Zoning Code Amendments for properties located at 2423 and 2425 Fifth Street (APN:
259-221-92 and 259-221-93);
WHEREAS, the City of Encinitas determined that the amendment request is exempt
from the California Environmental Quality Act (CEQA) per Section 15061(b)(3);
WHEREAS, on October 4, 2018, and on August 15, 2019, the City of Encinitas Planning
Commission held duly noticed public hearings, to consider the staff report, staff
recommendation, and public testimony, and recommended approval to the City Council;
WHEREAS, a Public Notice of Availability of proposed Local Coastal Plan Amendments
(LCPA) was issued which opened a six-week public review period that ran from September 21,
2018, through November 2, 2018; and
WHEREAS, on September 25, 2019, the City of Encinitas City Council held a duly
noticed public hearing, to consider the staff report, staff recommendation, and public testimony,
and concurred with the City of Encinitas Planning Commission and staff recommendation to
approve the application.
NOW, THEREFORE, the City Council of the City of Encinitas, California, hereby
ordains as follows:
SECTION TWO. Text, tables, and figures of the City of Encinitas General Plan are amended as
follows:
