A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS
ACCEPTING THE COASTAL RAIL TRAIL - CHESTERFIELD DRIVE TO SANTA FE
DRIVE SEGMENT PROJECT
FROM THE SAN DIEGO ASSOCIATION OF GOVERNMENTS
WHEREAS, The City of Encinitas ("City") and the San Diego Association of
Governments ("SANDAG") entered into a Memorandum of Understanding ("MOU") on
November 30, 2017 for the Coastal Rail Trail — Chesterfield Drive to Santa Fe Drive
Segment Project;
WHEREAS, the Coastal Rail Trail — Chesterfield Drive to Santa Fe Drive Segment
Project ("Project"), comprises 1.3 miles within North County Transit District and City
right-of-way;
WHEREAS, SANDAG assumed responsibility as the lead agency in the Project and
in the program implementation of the Project for the City;
WHEREAS, SANDAG performed the design, environmental, right-of-way
acquisition, and construction management of the Project in coordination with the City;
WHEREAS, the Project was completed on or about August 1, 2019 to the
satisfaction of the City.
WHEREAS, SANDAG and City have performed the final inspection and sign off on
the completion of the Project, including all punch list items ("Acceptance"); and
WHEREAS, the City agreed to maintain the Project from and after the completion
date of the construction and Acceptance of same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Encinitas
that pursuant to Section III.A.2. of the MOU, the City of Encinitas accepts the Project
and relieves SANDAG from all responsibilities for the operation and maintenance of the
Project.
PASSED AND ADOPTED by the City Council of the City of Encinitas this 21st day
of August, 2019, by the following vote, to wit:
