2. Side-yard setback. A porUon of the two-unit structure along the east elevation
encroaches approximately five feet into the required 10-fo4t side -yard setback along the
eastern property line.
3. No two-car garages. EMC 30.54.030A (Schedule of Required Off-Street Parking)
requires a two-family attached structure to have two enclosed parking spaces for each
unit. The two-unit structure lacks a garage for each unit. Therefore, the lack of a garage
for each unit is legal nonconforming.

Any future tenants shall qualify as "low" income (80% of the Regional Median Household
Income) with verification of income level annually. Additionally, the owner shall comply with the
maximum affordable rent level for a "low" income unit. The property owner shall record a
covenant setting forth that the unit be reserved as affordable housing for "low' income
households for 20 years.

Affordable Unit Policy (AUP) projects qualify as a ministerial action and therefore, this project is
exempt from the provisions of Chapter 23.06 (Citizen Participation Plans) and the public notice
requirements of Title 30 (Zoning).
The project has been determined to be exempt from environmental review pursuant to the
California Environmental Quality Act (CEQA) Guidelines Section 15268(a), which exempts
ministerial projects from environmental review. The project meets the criteria for the exemption.
The project does not qualify as one of the exceptions prescribed under Section 15300.2 of the
CEQA Guidelines and no historic resources are affected by the proposed project.
