2017-05 Chapter 14.35 Amend Definitions Commercial Vehicle Parking ORDINANCE 2017-05 AN ORDINANCE OF THE CITY OF ENCINITAS, CALIFORNIA, AMENDING CHAPTER 14.35 OF THE ENCINITAS MUNICIPAL CODE The City Council of the City of Encinitas, California does ordain as follows: SECTION ONE: That Section 14.35.020 Definition of the Encinitas Municipal Code is amended to read as follows: 14.35.020 Definitions. "Commercial vehicle" is a vehicle of a type required to be registered under the State of California Vehicle Code used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of property. "Large commercial vehicle" is a commercial vehicle having a manufacturer's gross vehicle weight rating of 10,000 pounds or more. "Residential district" is any property or portion thereof zoned RR (Rural Residential), RR-1 (Rural Residential), and RR-2 (Rural Residential), R-3 (Single-Family Residential), R-5 (Single-Family Residential), R-8 (Single Family Residential), R-11 (Single-Family Residential), R-11/RS-11 (Single-Family Residential), R-15 (Higher Density Single-Family and Multiple-Family Residential Zones), R-20 (Higher Density Single-Family and Multiple-Family Residential Zones), R-25 (Higher Density Single- Family and Multiple-Family Residential Zones), and MHP (Mobile Home Park). It is the purpose of this chapter to provide regulations controlling large commercial vehicles in residential districts. (Ord. 93-09) 14.35.020 Definitions. It is unlawful for the operator of any vehicle to stop, stand or park a commercial vehicle having a manufacturer's gross vehicle weight rating of 10,000 pounds or more on a street, alley or highway in any residential district within the City. (Ord. 90-13) 14.35.040 Exceptions. The prohibition in this section shall not apply to an operator who stops, stands or parks a commercial vehicle when then engaged in: A.Making a pickup or delivery of goods, wares or merchandise from or to property located on the restricted street, alley or highway on which the commercial vehicle is stopped, standing or parked; or B.Providing services to property located on the restricted street, alley or highway on which the commercial vehicle is stopped, standing or parked so long as the commercial vehicle's presence is required to provide the service; or C.Delivering materials to be used for a project for which a building permit has previously been obtained involving the repair, alteration, remodeling or construction of any building or structure located upon the restricted street, alley or highway on which a vehicle is stopped, standing or parking; or D.Buses when loading or unloading of passengers at established zones.
