RECOMMENDED ACTION:
Authorization to File a "Notice of Completion" (NOC) for a Water Main Replacement Located in
North County Transit District (NCTD) Right -of -Way.
STRATEGIC PLAN:

FISCAL CONSIDERATIONS:
The fiscal impact associated with the staff recommendation is included in the approved budget.
The construction contract was awarded in the amount of $126,999 with a 10% contingency for
change orders. Two change orders, which totaled $1,222.24, were issued, bringing the total
construction contract to $128,221.24. The Performance Bond in the amount of $126,999 will be
held for one year to cover the warranty period.
BACKGROUND:
A water main break occurred on March 3, 2016. The break was located 750 linear feet (LF)
north of Encinitas Boulevard in the North County Transit District (NCTD) right -of -way. The
water main was isolated and turned off. NCTD was notified of the break. NCTD inspected the
tracks and resumed rail service. No District customers are affected by the temporary isolation
of this water main, but the main is needed for redundancy in the water distribution system.
District staff obtained a permit from NCTD on March 17, 2016 to expose the water main and
evaluate the best means for repair. Inspection revealed that the water main break was located
in a steel casing underneath the train tracks. District staff determined that the repair would
require the replacement of 170 LF of 10 -inch steel main. District staff developed plans and
specifications to replace the water main and issued a Public Notice Inviting Bids on April 1,
2016. The District originally opened bids on April 26, 2016. The District received a bid protest,
and based on the opinion of legal counsel, the most prudent course of action was to reject all
bids and rebid the project in order to obtain a clean bid. On May 18, 2016, the District Board
rejected all bids and directed staff to re -bid the project.

District staff rebid the project and on June 15 2016 the District Board awarded the construction
to PAL General Engineering, Inc. (PAL). The Notice to Proceed was given on November 7,
2016 after a slight delay in the District obtaining insurance and a permit from NCTD. The
project was substantially completed on December 29, 2016, with only punch list items to
complete. The City of Encinitas signed off the project on April 3, 2017.
ANALYSIS:
PAL is requesting that the San Dieguito Water District file a NOC for the construction of the
project (see Attachment 2). The project was installed in accordance with the District- approved
plans and specifications, under District inspection. Board approval of the filing of the notice will
allow staff to make the final payment thirty days from the date of recording the NOC.
ENVIRONMENTAL CONSIDERATIONS:
The action being considered by the District Board is exempt from the California Environmental
Quality Act (CEQA) because it is not a "project' per Section 15378(b)(5) of the CEQA
Guidelines. The action involves an organizational or administrative activity of government that
will not result in the direct or indirect physical change in the environment. The action involves
the filing of a Notice of Completion.

NOTICE OF COMPLETION
Pursuant to the contract agreement for the "SDWD Water Main Repair /Replacement Project
CW16X" between the San Dieguito Water District, an Irrigation District of the State of
California and PAL General Engineering, Incorporated dated July 12, 2016, which included the
completion of the following work:
1. Replacement of 170 linear feet of 10 -inch water main located in North County Transit
District approximately 250 feet North of A Street in the City of Encinitas, California.
Said Agreement, including the plans and specifications for said improvements, is on file in the
Office of the Clerk of the Board of Directors.
Whereas, San Dieguito Water District, an Irrigation District of the State of California located at
160 Calle Magdalena, Encinitas, CA 92024 entered into an agreement as "Owner" in fee; and
Whereas, PAL General Engineering, Incorporated located at 5374 Eastgate Mall, San Diego, CA
92121 entered into an agreement as "Contractor" to construction improvements for the San
Dieguito Water District;
The Faithful Performance and a Labor and Materials Bond are covered in Bond No. 54- 210911
by United Fire and Casualty Company in the amount of $126,999 and will remain in full force at
this time and shall be released at the end of the one -year warranty period.
All requirements of said Agreement have hereby been satisfied except for warranty.
Said improvements were completed and accepted by the San Dieguito Water District Board of
Directors on the 17th day of May, 2017.
The San Dieguito Water District Board of Directors on the 17'h day of May, 2017 authorized the
General Manager to record the "Notice of Completion."

Neither acceptance of said improvements by the Board of Directors nor this Notice constitute a
waiver of any defects in the work of the construction or installation of said improvements.
