VULCAN A VENUE CALL TO ORDER / ROLL CALL Mayor Davis called the meeting to order at 7:00 P.M. Page 1 Mtg#93~ ,Bk#7,Page~'~ 09/14/93 Special Council Meeting Community Development Director Murphy gave an overview of the format of the meeting. City Planner Weedman Commission, CABs, and decision making process. reviewed the duties of the Planning Staff relative to the City's land use Mr. Murphy reviewed the Planning Department's 1992/93 activities. The following comments were made: CAB Member Birnbaum stated he was pleased with the process, however, he suggested findings made by the CABS on projects be communicated to the Planning Commission and Council. CAB Member Wells stated he was pleased with the process but said the parameters of the role for CAB members were sometimes confusing and asked for more clarification. CAB Member Greer stated he felt the CABs played an important role in the land use decision making process. CAB Member Bode said, in addition to the CAB's present role, he felt the CABs should evolve into more of an "information gathering Board" for the purpose of such issues as General Plan amendments. CAB Member Kitnick requested that CAB members receive their meeting agenda packets in a more timely manner to provide time enough to thoroughly review the issues. In addition, he asked for training on more substantive issues. Planning Commissioner Lanham said he would like the graphs presented by Staff showing the 1992/93 activities to designate which projects went to the CABs, which went to Staff, or which went directly to the Planning Commission. Planning Commissioner Bagg suggested extending CABs' and Planning Commissioners' terms to 3 years to provide continuity. In addition, he asked if CAB members and Planning Commissioners personally protected by the City in the event of a law suit. CAB Member Beck said she felt the CAB system provided a service to the community and was pleased with the streamlining of the system. CAB Member Edde commended the Planning Commissioners for represent- ing the CABs' intent when reviewing projects. He suggested eliminating the five CABs and having one member from each of the five communities to make up a "Super CAB." 09/14/93 Special Mtg. Page 2 Mtg#93-~ ,Bk#7,Page~ 09/14/93 Special Council Meeting CAB Member Crimmins suggested that when there is an appeal of a CAB decision to the Planning Commission, CAB findings be communicated to the Commission. CAB Member Eldon suggested the appeal process go from the CAB directly to the Council. CAB Member Hughes asked for feedback from the Planning Commission to the CABs when their decisions were overruled. CAB Member Buck also recommended 3 year terms for CAB members. She asked if CAB members were allowed to appear at Planning Commission appeal hearings to voice their concerns on projects. Planning Commissioner Jacobson stated that if CAB members wanted Planning Commissioners to hear the issues which had been raised at the CAB level, she could be contacted or she would, if requested, listen to a tape of the CAB meeting. City Attorney Krauel addressed the issue of malpractice' insurance stating members were protected by the City to the extent they were acting within the scope of their responsibility. Further, he said it was very important to have every CAB resolution reflect the CAB's position on a project. Then, no further CAB communication to the Planning Commission should be necessary. CAB Member Eldon asked that CABs be notified when their decisions are appealed. CAB Member McFall said Resolutions were never returned to the Board. As Chairperson of the Cardiff CAB he had never been asked to sign a CAB resolution and therefore, could not verify accuracy of the Resolutions. Staff was directed to research and respond to Mr. McFall's comments. CAB Member Bode said he would like to use the CABs to increase communication within the community but that CAB meetings were not conducive to communications. Council Members thanked the Planning Commissioners and CAB members for their dedication and hard work and urged them to contact Council Members with any concerns they may have.
