A RESOLUTION OF THE BOARD OF DIRECTORS
OF SAN DIEGUITO WATER DISTRICT
APPROVING QUITCLAIM OF
DEED RESTRICTIONS ON
LOT 15, BLOCK 5 OF MAP NO. 148
(APN 258-083-013-00)
WHEREAS, the San Dieguito Irrigation District granted the Lot 15 of Block 5 Map No. 148 to
Archie J. Hicks and Ethel A. Hicks per grant deed recorded August 22, 1947 as Book 2478,
Page 129 of Official Records (APN 258-083-013-00); and
WHEREAS, Janet R. Grice, as Trustee of The Grice Living Trust dated March 15, 1977, as to
an undivided one-half (1/2) interest and Karen Sinai, Successor Trustee of The Lund Family
Trust dated July 16, 1991, as to an undivided one-half (1/2) interest is the current owner of Lot
15 of Block 5 Map No. 148 (APN 258-083-013-00); and
WHEREAS, said grant deed was made and accepted with expressed covenants,
restrictions, and conditions, whereas a breach of any one would cause the property to revert
immediately to the grantor; and
WHEREAS, the San Dieguito Water District is successor in interest to the San Dieguito
Irrigation District as grantor; and
WHEREAS, any covenant, condition, or restriction indicating a preference, limitation or
discrimination based on race, color, religion, sex, sexual orientation, familial status, and
disability is a violation of United States law, 42 U.S.C. § 3604(c) and is thereby non-
enforceable; and the other two restrictions are outdated and/or covered by the City of Encinitas'
Municipal Code;
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the San
Dieguito Water District order as follows:
1. That the quitclaim deed abandoning deed restrictions be granted and is approved.
2. That the General Manager of the San Dieguito Water District is authorized and
directed to execute the quitclaim deed on behalf of the District.
PASSED AND ADOPTED at a regular meeting of the Board of Directors of San Dieguito
Water District held on the 19th of October 2016, by the following vote:
AYES: Blakespear, Gaspar, Kranz, Muir, Shaffer
NOES: None
ABSENT: None
ABSTAIN: None

FOR VALUABLE CONSIDERATION, the receipt of which is hereby acknowledged SAN
DIEGUITO WATER DISTRICT, an Irrigation District of the State of California does hereby
remise, release, vacate, abandon, and forever quitclaim all conditions,restrictions, and easements
of record as granted August 22, 1947 in Book 2478, Page 129 of Official Records, to Janet R.
Grice, as Trustee of The Grice Living Trust dated March 15, 1977, as to an undivided one-half
(1/2) interest and Karen Sinai, Successor Trustee of The Lund Family Trust dated July 16, 1991,
as to an undivided one-half(1/2) interest; the real property is in the City of Encinitas, County of
San Diego, State of California.
