1. CALL TO ORDER / ROLL CALL
Mayor Shea called the meeting to order at 7:04 P.M.
Present:
Mayor Richard Shea, Council Members Marjorie Gaines,
Greg Luke, Anne Omsted, Gerald Steel.
Also
Present:
Assistant city Manager Benson, City Attorney Krauel,
City Clerk Pool, Community Development Director
Murphy, Deputy city Clerk Cervone, Fire Chief La
Marsh, Consultant Bridges.
There being a quorum present, the meeting was in order.
2. PLEDGE OF ALLEGIANCE
COUNCIL DISCUSSION ON THE PROPOSED GENERAL PLAN / LOCAL
COASTAL PLAN FOR THE CITY OF ENCINITAS.

Craig Jones, Senior Planner, recommended inserting wording in
the Land Use Element similar to the City of Carlsbad's relating
to the Transportation Corridor (from an attachment to a meno,
Craig Jones to Planning Commission, May 25, 1988, numbered p.84
in the book of issues raised during City Council hearings) He
stated that the wording was general in nature and the zoning
ordinance would have more specifics. (pages 86 and 87).
Council consensus was to direct Staff to come back with wording
that reflects their intent to protect the corridor, keeping out
encroachment of non-corridor uses, and providing for other
ancillary uses such as bicycle trails, and possible parking,
but that it not be used as a condition of approval for
development due to the need for parking.

Referring to the copy of Carlsbad's ordinance, to be used as a
model for what would go into the zoning ordinance, consensus
was to remove (5) in 21.100.020 and (2)(B) in 21.100.020.
(pages 85 and 86 in book).
Craig Jones pointed out that the site on Orpheus behind Ecke
Schook, the Lake Drive Sports Complex, and Sun VistaPark had
inadvertently missed being designated for parks/open space and
would be provided to the Planning Commision for addition to the
Land Use Map. In addition, Staff was asked to check another
park site in Leucadia, mentioned by Council Member Gaines to
see if it needed to be added.

Review City Council, Planning Commission and
Staff suggested changes.
Council amended Policy 2.4 of the Land Use Element text by
adding a second sentence as follows: "Seek to require
developments outside the City which may impact City facilities
and services to pay their share of costs for improvements of
City facilities and services. For developments within City
limits, seek to require them to pay their fair share of the
cost of improvements of regional facilities and services."
Council amended Policy 2.6 to read: "Any subdivision created by
lot averaging should not be further subdivided."
Steel moved, Luke seconded to leave the wording of Policy 2.7
unchanged. Motion carried. Ayes: Luke, Omsted, Shea, Steel;
Nays: Gaines.
On page 3 of Craig Jones' memo of 10/20/88, Staff was directed
to reword the first paragraph preceded by a dash (-( "No new or
existing link in the street and highway system " Staff was
also directed to research whether a policy could be developed
that the portion of Leucadia Boulevard from the bluff to the
freeway could not be expanded beyond four lanes without a vote
of the lecuadia CAB area, in addition to a vote of the City
Council. Further, that even if such a vote were an advisory
vote, the City would be bound by it.
Council amended Policy 3.1 to read: For purposes of growth
management, to ensure that facilities planning can be both
economical and comprehensive, the ultimate buildout figure for
residential . . .

Shea moved, Gaines seconded to keep policies 3.7, 3.8, 3.9 and
3.10 with the same wording. Motion carried. Ayes: Gaines,
Shea, Steel; Nays: Omsted, Luke.
Council Member Steel suggested that a policy be added which
would state "Once Ecke land is annexed to the City, property
zoned agriculture preserve and used for agriculture purposes
can not be changed without a vote of the people."
Staff was directed to bring back a policy for Specific Plan
criteria for the Ecke land.
Staff had proposed three additional policies (page 95-E) to
Goal 3, relative to exceptions to the requirements for voter
approval for specified General Plan Land Use map amendments.
Staff had proposed that a 4/5ths Council affirmative vote be
required on all three exceptions. Council concurred with the
three policies, however, directed Staff to change the vote
requirement to read "as approved by a unanimous Council vote".
These additions would be numbered policy 3.12, and policies
3.7, 3.8, and 3.9 and 3.10 would reference policy 3.12.
Policy 4.6: Council consensus was to remove the word "merit".
A typing error was noted in the word "build out" in policy 4.8.
Steel moved, Shea seconded to keep Policy 4.8 as proposed.
Motion ca~ied. Ayes: Gaines, Omsted, Shea, Steel; Nays:
Luke.
Policy 6.7: Council consensus was to reword it to read
"Require sufficient landscaping to soften the visual impact of
Commercial buildings and parking areas. . ."
Policy 6.2: Council consensus was to remove the words "or
nonconforming."
Policy 7.3:

Consensus was to replace the word "should" with

changes to policy 7.4 and Staff's and Deborah Frischer's
changes to policy 8.3.
Goal 8: "Environmentally and topographically" was added to the
beginning of the sentence.
Council consensus was that policy 8.4 would be replaced with
wording previously directed as to calculating density.
Council added Policy 7.6 which would state "private development

should coordinate with the City's plan for street-scapes/public
improvements, structural site design, and landscaping.
Policy 8.1:

Policy 8.7: Council concurred with the new wording recommended
by Deborah Frischer..
Policy 8.5: Council consensus was to add the words "or PRD's"
after "lot averaging" and noted that wording should be added to
reflect "75%" in the lot averaging policy in the first sentence
of the policy.
Policy 8.9: The first five words, "The Ecke holdings and
other" were deleted. Discussion on this policy was continued
to Saturday, October 22. Staff was directed to rewrite the last
part of 8.9 (page LU-15 and 16) to reflect actions taken
earlier. The words "on the Ecke holdings" were deleted at the
top of page LU-16.
