2012-17 Cardiff Specific Plan amendments ORDINANCE 2012-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,CALIFORNIA ADOPTING MODIFICATIONS SUGGESTED BY THE COASTAL COMMISSION TO THE CARDIFF-BY-THE-SEA SPECIFIC PLAN, SP-5; LOCATED BETWEEN THE WEST SIDE OF SAN ELIJO AVENUE AND THE WEST SIDE OF THE ALLEY BETWEEN NEWCASTLE AVENUE AND MANCHESTER AVENUE; AND FROM THE SOUTH SIDE OF MOZART AVENUE TO THE NORTH SIDE OF ORINDA DRIVE. CASE NUMBER: 04-266 GPA/SPA/LCPA/EIA WHEREAS, the Planning Commission conducted a Public Hearing on December 6, 2012 and considered public testimony and made a recommendation to approve the suggested modifications requested by the California Coastal Commission to the City Council; WHEREAS, the City Council conducted a Public Hearing on January 9, 2013 and considered public testimony relative to the modifications to the Cardiff-by-the-Sea Specific Plan, SP-5 as suggested by the Coastal Commission; and WHEREAS, the City Council finds that the Cardiff-by-the-Sea Specific Plan is consistent with the adopted Local Coastal Plan (LCP) in that the Specific Plan addresses applicable goals, policies, and provisions of the LCP that pertain to land use, housing, public safety, resource management,recreation and noise; and NOW, THEREFORE, the City Council of the City of Encinitas hereby ordains as follows: SECTION 1. The Cardiff-by-the-Sea Specific Plan (SP-5), which was adopted by City Council Ordinance 2010-03 on July 21, 2010, is hereby amended with suggested modifications by the Coastal Commission as shown in Attachments "1" through "4" to this Ordinance. This Specific Plan is adopted for the purpose of implementing the Encinitas General Plan for the Specific Plan area. SECTION 2. This Ordinance does not affect Council Ordinance 2010-04 which amends the Encinitas Municipal Code and Zoning Map or Council Resolution 2010-04 which amends the General Plan Land Use Map and Table 4, Distribution of Land Use: Cardiff-by-the-Sea, in the Land Use Element of the General Plan, both of which are still in effect. SECTION 3. This Ordinance is intended to be carried out in a manner in full conformance with the California Coastal Act of 1976 and the Planning and Building Director is 1 hereby authorized to submit this Ordinance as part of the Local Coastal Program Amendment to the California Coastal Commission for their review and adoption. SECTION 4. Pursuant to the California Environmental Quality Act (CEQA), the City Council of the City of Encinitas on July 21, 2010 reviewed the proposed application and adopted a Negative Declaration finding, in its independent judgment, that the project would not have a significant effect on the environment and finds that additional environmental review is not required for the modifications to the Cardiff-by-the-Sea Specific Plan as suggested by the Coastal Commission. SECTION 5. This Ordinance shall take effect on the date of adoption by the California Coastal Commission, but not sooner than thirty (30) days after its adoption by the City Council. SECTION 6. Height (1) Height. In all zones,the maximum height shall be as specified in Table 3-2 above. 3.5.2 Overlay Requirements �I The provisions, restrictions, and requirements of the following overlays i apply in addition to site-specific zoning established under.this Specific Plan. See Figure 5,Setbacks&Seepbacks. A. Setback and Lot Dimension Overlay. i The Setback and Lot Dimension Overlay is intended to recognize that different standards must apply in different Planning Areas based on community objectives. Minimum lot size,dimensions, and setbacks vary by Planning Area in order to reinforce the desirable characteristics of the existing development pattern, encourage more pedestrian activity, and provide adequate buffers between non-residential and adjacent residential uses. k (1) Setbacks.Setback shall mean the area which defines the depth of the required front, side, or rear yard, as defined as per Municipal Code Section 30.04. All new construction must adhere to the minimum setback requirements of this Specific Plan, Figure 5, Setbacks & Stepbacks, illustrates the required pattern of building setbacks for new development within the Specific Plan area. Detailed minimum lot size,lot dimension,and building setback requirements for each zone are shown in Table 3-2 above. (2) Lot Size and Dimensions. Stepbacks A stepback is a setback.located on the second floor of a building,typically to r reduce the bulk and mass of a building or to provide outdoor floor space, y! Comer Setback Overlay i Corner Setback Overlay is intended to recognize that street corner setbacks in the Cardiff-by-the-Sea Specific Plan area provide opportunities for views of the ocean, views into alleys, visual sight lines for pedestrians and vehicles, i and pedestrian gathering spaces. Implementation of corner setbacks will protect important public views, increase safety, and improve the built environment for pedestrians. ; I Figure 6, Corner Treatments, illustrates the locations of corner setbacks. Corner setbacks; classified as either primary or secondary, are considered minimums,and may be increased by the Setback Overlay requirements in the .j preceding.section. Figure 7, View Corridors - Sight Lines at Streets, details the minimum dimensions of corner setbacks,while Figure 8, View Corridors and Open Corners, General Concepts, details concepts that allow the opportunity to maintain ocean views. i In addition to these minimum requirements, corner setbacks may be increased to achieve a minimum visibility triangle as required in Chapter 14.54 of the Encinitas Municipal Code. (1) Primary Corner Setbacks i� (a) These regulations apply to San Elijo Avenue at Birmingham Drive Liverpool Drive Aberdeen v ` , rp Drive, and Chesterfield I Drive. r (b) No building may encroach within a triangular area created by connecting two imaginary points, each measured 20 feet back from the property corner. Where vehicular access from San Elijo Avenue is necessary,access shall be limited to one point for each 300 feet of frontage or one point per parcel if frontage is less than 300 feet. E I B. Access points to adjoining lots shall be shared wherever feasible. Reciprocal ingress and egress, circulation, and parking arrangements shall be required to facilitate the ease of vehicular movement between adjoining properties where feasible. ` C. In all zones,off-street parking requirements are described in Section 5.6 of this Specific Plan. V D. On-site parking areas abutting all roads within the Specific Plan area f shall be screened by landscaping, low decorative walls, lowering the parking area below street grade, or a combination of any of these methods so long as required sight lines are not diminished. B. In most communities, the streets are the major public spaces that everyone enjoys. In Cardiff-by-the-Sea,this is particularly the case. The } r: narrow, comfortable streets form an easily navigated system within a modified grid. The overall street system appears much as a ladder in plan with San EIijo Avenue and Newcastle Avenue forming the side rails with Chesterfield Drive, Aberdeen Drive, Liverpool. Drive and ' Birmingham Avenue forming the rungs of the ladder. This simple street ! r system lends itself to a clear and effective streetscape.program. i I B. Major gateways can provide a visual announcement of entry into the business disfrict. In addition, intersection improvements, primarily , E involving special surface treatment such as enhanced paving, encourage 1 motorists to slow down and provide visual cues to pedestrians. ' i C. The Streetscape Concepts provided in this section apply to all designated f areas of the public right-of-way within the Cardiff Specific Plan area. is They provide the design criteria that the City and future developers will follow in the preparation of plans for improvement of the various rights- of-way.When improvement of-designated streets or portions of rights-of way is proposed by the City, or required of any developer or agency in ; conjunction with land use or other development, such improvement shall ? �X 4 be consistent with these Streetscape concepts. Consistent. with City regulations,requirements to install street improvements may be satisfied by other applicable measure(s) when it is determined that incremental improvements are inappropriate.
