A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ENCINITAS, CALIFORNIA,
CERTIFYING AND APPROVING A
NEGATIVE DECLARATION
WHEREAS, the CITY COUNCIL of the CITY OF ENCINITAS, CALIFORNIA, is
considering the formation of a special assessment district, pursuant to the
terms and provisions of the "Municipal Improvement Act of 1913", being
Division 12 of the Streets and Highways Code of the State of California,
for the installation of certain works of improvement, together with
appurtenances, in a special assessment district known and designated as
ASSESSMENT DISTRICT NO. 92-01 (SEEMAN DRIVE SEWERS) (hereinafter referred
to as the "Assessment District"); and,
WHEREAS, at this time all environmental evaluation proceedings have
been completed to the satisfaction of this legislative body, and there has
been submitted for final approval and certification a Negative Declaration
on the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Encinitas, California that the following actions be taken:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That it is hereby certified that all environmental
evaluation proceedings have been completed and that the project is in
compliance with the provisions of the California Environmental Quality Act,
and it is hereby determined that there ~ are no significant adverse
environmental impacts resulting from the project.
SECTION 3. That it is hereby ordered and authorized that a NOTICE OF
DETERMINATION be immediately filed in the Office of the County Clerk.
