A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ENCINITAS
ACCEPTING A PORTION OF AN IRREVOCABLE
OFFER OF DEDICATION ALONG NORTH SIDE
OF RANCHO SANTA FE ROAD
WHEREAS, on January 7, 1992, the Olivenhain Community Advisory
Board approved a Design Review Permit for the Encinitas Union
School District to construct a warehouse/maintenance building on
the property located at 101 South Rancho Santa Fe Road,
WHEREAS, the District was required to request the City Council
to accept that portion of the existing Irrevocable Offer of
Dedication, recorded on May 10, 1984 as File/Page No. 84-175125,
which would encompass all the public improvements to be constructed
along Rancho Santa Fe Road,
WHEREAS, on March 24, 1992, the District requested that the
City Council accept that portion of the above mentioned
Irrevocable Offer of Dedication which would encompass all the
public improvements to be Constructed as approved by the City
Engineer,
WHEREAS, Section 66477.2 of the Government Code of the State
of California provides that a rejected offer of dedication shall
remain open and subject to future acceptance by the City,
WHEREAS, the City Council has determined there is a need to
accept a portion of the existing Irrevocable Offer of Dedication
along Rancho Santa Fe Road,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Encinitas accepts that portion of the previously rejected
Irrevocable Offer of Dedication, recorded May 10, 1984 as File/Page
No. 84-175125, as described in Exhibit "A" and shown on Exhibit

OF PORTION OF EXISTING I. O. D. TO BE ACCEPTED
That portion of Block 12 in the Colony of Olivenhain in the City
of Encinitas, County of San Diego, State of California, according
to Map thereof No. 326 filed in. the Office of the County Recorder
of San Diego County on July 8, 1885, together with that portion of
the Westerly half of "D" Street adjoining said Block 12 on the East
as vacated and closed to public use included in that land described
in deed to Trico Properties, Inc., a California corporation recorded
October ll, 1979, as File/Page No. 79-424112, in the Office of the
Recorder of said County, also being a portion of "Irrevocable Offer
To Dedicate Real Property", recorded May 10, 1984, as Document No.
84-175125, more fully bounded and described as follows:
BEGINNING at the most Southerly corner of said Trico land, said
point being the intersection of the centerline of said "D" Street
and the Northerly right-of-way line of that land described in deed
of easement, for Road Survey No. 572, recorded June 21, 1933, as
Document No. 29661 in said Recorder's Office; thence along the
Easterly line of said Trico land, North 15° 34' 36" East,
34.67 feet;
thence leaving said Easterly line, North 28° 24' 00" West, 119.56
feet to the beginning of a tangent 409.48 foot radius curve concave
Southwesterly;
thence Northwesterly along the arc of said curve through a central
angle of 13° 35' 19", a distance of 97.12 feet to the beginning of
a tangent compound 1051.00 foot radius curve concave Southwesterly,
said 1051.00 foot radius curve being concentric with and 51.00 feet
Northeasterly of the centerline of Road Survey No. 458-66 as
described in a Deed to said County of San Diego recorded December
14, 1967, as File/Page No. 197006 in said Recorder's Office;
thence Northwesterly along the arc of said curve through a central
angle of 02° 40' 10", a distance of 48.97 feet to a point in said
Northerly right-of-way line of Road Survey No. 572;
thence South 28" 24' 00" East, 288.03 feet to the POINT OF BEGINNING.
