NOTICE OF DECISION

This letter is to inform you that the Planning and Building Director has approved your application
for the following Administrative Permit far property located in the City of Encinitas:
11-037 ADR/CDP (Verizon Wireless) - A request for an Administrative Design Review and
Coastal Development Permit to install l2 panel antennas (3 sectors of 4 antennas each) mounted
to the faCade of an existing building behind RF transparent screens; and construction of a CMLT
equipment enclosure (12-feet tall by 20-feet 4-inches long by 10 feet 6 inches width) containing
equipment cabinets and associated equipment inside. Two AC condenser units and one
emergency power generator receptacle are to be installed next to the CMLJ enclosure. The subject
property is located at 169 Sa�cony Road (APN 258-111-25) within the OP (Office Professional)
Zoning District and Coastal Zone within the Community of Old Encinitas.
Project Description and Discussion: The project site is located at an office professionaUbusiness
park (169 Saxony Road) located at the northeast corner of Seacrest Way and Saacony Road. The
existing building on which the wireless facility is to be installed was approved by Planning
Commission Resolution 99-27 (Case No. 99-030 DR/CDP) approved on June 10, 1999.
Wireless Facilities Ordinance
The project site is zoned Office Professional (OP) and is a preferred location for wireless facilities
per Section 9.70.040 (Preferred Locations). The properties that surround the project site are office
professional and general commercial to the south, and multi-family residential to the north and east.
Consistent with Section 9.70.040 (Preferred Locations), the proposed wireless facility is located
within the OP zone and no closer than 100 feet from the nearest residential dwelling; therefore an
Administrative Design Review Permit is required.
The information listed in Section 9.70.080 (Supplementary Materials) as submitted and were
reviewed as part of the Administrative Design Review Permit. The entire arrangement of antennas
and equipment are designed to provide both reasonable operational characteristics and adequate
concealment.
The proposed wireless facility consists of 12 panel antennas (3 sectors of 4 antennas each) mounted
to the fa�ade of an existing building behind RF transparent screens; and construction of a CMU
equipment enclosure (12-feet tall by 20-feet 4-inches long by 10 feet 6 inches width) containing
equipment cabinets and associated equipment inside. Two AC condenser units and one emergency

power generator receptacle are to be installed next to the CMU enclosure. The proposed project will
be designed to stealth the antennas from view by integrating them into the design of the building
parapet. The equipment will be recessed into an existing hillside and partially in view. Therefore,
the proposed project will not have a significant visual impact on the surrounding area.
The project as proposed effectively conceals the proposed wireless telecommunications facility.
No additional conditions regarding visual impact need to be applied. In order to assess the
visibility of the proposed facility from Saxony Road and adjacent properties, photo simulations
were submitted showing the proposed antennas incorporated within the design of the building
parapet.
The coverage objective for the proposed wireless communication facility is to meet the Verizon's
wireless network's current capacity and coverage needs in this area. The proposed facility is
intended to address this need. The site will also provide coverage to the surrounding residential
community.
Third Party Wireless Review
The City retained a Third Party Wireless Consultant, Kramer Firm, Inc., to review and assess the
technical data of the proposed wireless facility. Kramer Firm, Inc., through the analysis
contained in the applicant's Radio Frequency Emission study about power, antenna height and
other elements, confirmed that the proposed wireless communications facility is in compliance
with the FCC OET 65 requirements. The wireless communications facility as proposed will
operate in full compliance with the standards for radio frequency emissions (RF) as adopted by
the Federal Communications Commission (FCC). The Third Party Wireless reports are part of
the administrative record.
Public Participation
The applicant mailed a newsletter to all property owners within 500-feet of the project site in
accordance with the Citizen Participation Program (CPP) provisions of Chapter 23.06 (Citizen
Participation Program). Newsletter recipients were given time to respond and make comments
by August 20, 2011. The concerns received and the applicant's responses are summarized
below.

The Final CPP Report is available for review within the administrative file.
A standard public notification to all property owners and tenants within 500 feet of the project
site was issued for the application, which allowed for a minimum 10-day comment period prior
to the Administrative Public Hearing in accordance with the provisions of Section 30.01.070
(Noticed, Public Hearings) of the City of Encinitas Municipal Code. No comments were
received prior to the Administrative Public Hearing.
The Planning and Building Department conducted an Administrative Public Hearing on Monday,
November 28, 2011. Only the applicant and staff were present at the public hearing. No
objections or comments were received prior to the close of the Administrative Public Hearing.
However, one citizen who lives near the proj ect site arrived late to the meeting and inquired
about the noise that could be generated from the CMU enclosure (closest to his residence)
located in the northwest corner of the project site. Submitted by the applicant on Apri125, 2011,
a Noise Impact Analysis was prepared by Helix Environmental Planning on April 7, 2011 which
stated that the wireless facility "would have a noise impact of 47.9 dBA at the closest property
line located east of the facility. The proposed air conditioning units would comply with the
City's Municipal Code's m�imum allowable noise level of 50 dBA for a continuously operating
system in a multi-family residential area." The citizen was satisfied with the report since his
home is at least 100 feet away east of the CMU enclosure and the noise level would diminish as
the noise moves towards his home.
This approval is based on the following findings:
FINDINGS FOR DESIGN REVIEW
STANDARD: Section 23.08.072 of the Encinitas Municipal Code provides that an
application for a design review permit must be granted unless, based upon the information
presented in the application and during the Public Hearing, the authorized agency makes any
of the following regulatory conclusions:
a. The project design is inconsistent with the General Plan, a Specific Plan, or the provisions of
the Municipal Code.
Facts: The application is for an Administrative Design Review and Coastal Development Permit to
install 12 panel antennas (3 sectors of 4 antennas each) mounted to the fa�ade of an existing
building behind RF transparent screens; and construction of a CMiJ equipment enclosure (12-feet
tall by 20-feet 4-inches long by 10 feet 6 inches width) containing equipment cabinets and
associated equipment inside. Two AC condenser units and one emergency power generator
receptacle are to be installed next to the CMLJ enclosure.
Discussion: The project site is zoned Office Professional (OP) and is a preferred location for
wireless facilities per Section 9.70.040 (Preferred Locations). The properties that surround the
project site are office professional and general commercial to the south, and multi-family residential

to the north and east. Consistent with Section 9.70.040 (Preferred Locations), the proposed wireless
facility is located within the OP zone and no closer than 100 feet from the nearest residential
dwelling; therefore an Administrative Design Review Permit is required.

reviewed as part of the Administrative Design Review Permit by the City's 3`a Party wireless
consultant, the Kramer Firm, Inc., and was found to meet the technical requirements of the city's
wireless ordinance. The entire arrangement of antennas and equipment are designed to provide both
reasonable operational characteristics and adequate concealment.
The proj ect as proposed effectively conceals the proposed wireless telecommunications facility.
No additional conditions regarding visual impact need to be applied. In order to assess the
visibility of the proposed facility from Saxony Road and adjacent properties, photo simulations
were submitted showing the proposed antennas incorporated within the design of the building
parapet.
Conclusion: The Planning and Building Department finds that the project design as proposed and
conditioned is consistent with the General Plan and the provisions of the Municipal Code.
b. The project design is substantially inconsistent with the Design Review Guidelines.
Facts: The application is for an Administrative Design Review and Coastal Development Permit to
install 12 panel antennas (3 sectors of 4 antennas each) mounted to the fa�ade of an existing
building behind RF transparent screens; and construction of a CMU equipment enclosure (12-feet
tall by 20-feet 4-inches long by 10 feet 6 inches width) containing equipment cabinets and
associated equipment inside. Two AC condenser units and one emergency power generator
receptacle are to be installed next to the CNIU enclosure.
Discussion: The project site is zoned Office Professional (OP) and is a preferred location for
wireless facilities per Section 9.70.040 (Preferred Locations). The properties that surround the
project site are office professional and general commercial to the south, and multi-family residential
to the north and east. Consistent with Section 9.70.040 (Prefened Locations), the proposed wireless
is located within the OP zone and no closer than 100 feet from the nearest residential dwelling;
therefore an Administrative Design Review Permit is required.
The proposed project will be designed to stealth the antennas from view by integrating them into the
design of the building parapet. In order to assess the visibility of the proposed facility from Saxony
Road and adjacent properties, photo simulations were submitted showing the proposed antennas
integrated well within the design of the building parapet. The adjacent equipment will be recessed
into an existing hillside and partially in view. Therefore, the proposed project will not have a
significant visual impact on the surrounding area in accordance with the applicable Design Review
Guidelines contained in Section 2.9 (Mechanical Equipment), Section 2.10 (Electrical Equipment),
Section 5.8 (Mechanical Equipment) of the City's adopted Design Review Guidelines. The project ,
as proposed effectively conceals the proposed wireless telecommunications facility. No additional
conditions regarding visual impact need to be applied.

Conclusion: The Planning and Building Department finds that the project design is substantially
consistent with the Design Review Guidelines.
c. The project would adversely affect the health, safety, or general welfare of the community.
Facts: The project complies with all applicable standards outlined in the Municipal Code
Discussion: No evidence has been received by the City to indicate that the proposed project would
adversely affect the health, safety, or general welfare of the site, the immediate neighborhood, or the
greater community and is exempt from environmental review per the requirements of CEQA as per
Section 15303(d) of the CEQA Guidelines. The City retained a Third Party Wireless Consultant,
Kramer Firm, Inc., to review and assess the technical data of the proposed wireless facility.
Kramer Firm, Inc., through the analysis contained in the applicant's Radio Frequency Emission
study about power, antenna height and other elements, confirmed that the proposed wireless
communications facility is in compliance with the FCC OET 65 requirements. The wireless
communications facility as proposed will operate in full compliance with the standards for radio

Code and Design Review Guidelines.
Conclusion: The Planning and Building Deparhnent finds that the project design will not adversely
affect the health, safety, or general welfare of the community.
d. The project would cause the surrounding neighborhood to depreciate materially in
appearance or value.
Facts: The project site is zoned Office Professional (OP) and is a preferred location for wireless
facilities per Section 9.70.040 (Preferred Locations). The properties that surround the project site
are office professional and general commercial to the south, and multi-family residential to the north
and east. Consistent with Section 9.70.040 (Preferred Locations), the proposed wireless is located
within the OP zone and no closer than 100 feet from the nearest residential dwelling; therefore an
Administrative Design Review Permit is required.
Discussion: The proposed project will be designed to stealth the antennas from view by integrating
them into the parapet of the existing building. The equipment enclosure will be placed set into the
hillside and partially out of view. Therefore, the proposed project will not have a significant visual
impact on the surrounding area. The project site is zoned Office Professional (OP) and is a
preferred location for wireless facilities per Section 9.70.080 (Supplementary Materials).
Conclusion: The Planning and Building Department finds that the proposed project will not cause
the surrounding neighborhood to depreciate materially in appearance or value.

FINDINGS FOR A COASTAL DEVELOPMENT PERMIT
STANDARD: Section 30.80.090 of the Municipal Code provides that the authorized agency
must make the following findings of fact, based upon the information presented in the
application and during the Public Hearing, in order to approve a coastal development permit:
1. The project is consistent with the certified Local Coastal Program of the City of Encinitas;
and
2. The proposed development conforms with Public Resources Code Section 21000 and
following (CEQA) in that there are no feasible mitigation measures or feasible alternatives
available which would substantially lessen any significant adverse impact that the activity
may have on the environment; and
3. For projects involving development between the sea or other body of water and the nearest
public road, approval shall include a specific finding that such development is in conformity
with the public access and public recreation policies of Section 30200 et. seq. of the Coastal
Act.
Facts: This application is for an Administrative Design Review and Coastal Development
Permit to install 12 panel antennas (3 sectors of 4 antennas each) mounted to the fa�ade of
an existing building behind RF transparent screens; and construction of a CMLT equipment
enclosure (12-feet tall by 20-feet 4-inches long by 10 feet 6 inches width) containing 3
equipment cabinets and associated equipment inside; and two (2) AC condenser units to be
installed next to and north of the CN1U enclosure.
Discussion: Related to finding No. 1, with the approval of the Administrative Design Permit
and Coastal Development Permit request, the proposed project will comply with all
applicable Section s of the City's Municipal Code, General Plan, and certified Local Coastal
Program. Related to finding No. 2, no adverse impacts to the environment are associated
with the project and the project is exempt from the requirements of CEQA. The project site
is located at an office professionaUbusiness park (169 Saxony Road) at the northeast
corner of Encinitas Boulevard and Saxony Road, therefore finding No. 3 is not applicable
since the project is not located between the sea or other body of water and the nearest public
road.
Conclusion: The Planning Commission finds that 1) the project is consistent with the
certified Local Coastal program of the City of Encinitas; 2) no potentially significant
adverse impacts to the environment will result and the project is exempt from the
requirements of CEQA as per Section 15303(d) of the CEQA Guidelines, and 3) finding No.
3 is not applicable to the project since it is not located between the sea or other body of
water and the nearest public road.
ENVIRONMENTAL STATUS: The project has been determined to be exempt from
environmental review pursuant to Section 15303(d) of the California Environmental Quality Act
(CEQA) Guidelines. Section 15303(d) exempts water main, sewage, electrical, gas, and other
utility extensions, including street improvements, of reasonable length to serve such
constructione

This approval is subject to the following conditions:
SCl SPECIFIC CONDITIONS:
SC2 At any time after two years from the date of this approval, on December 1, 2013 at 5:00 pm,
or the expiration date of any extension granted in accordance with the Municipal Code, the
City may require a noticed public hearing to be scheduled before the authorized agency to
determine if there has been demonstrated a good faith intent to proceed in reliance on this
approval. If the authorized agency finds that a good faith intent to proceed has not been
demonstrated, the application shall be deemed expired as of the above date (or the expiration
date of any extension). The determination of the authorized agency may be appealed to the
City Council within 15 days of the date of the determination.
SC6 This project is conditionally approved as set forth on the application and project drawings
stamped received by the City on September 26, 2011, consisting of 12 sheets including
Title Sheet (Sheet T-1), Site Plan (Sheet A-0), Enlarged Site Plan (Sheet A-0.1), Water
Pollution Control Plan (Sheet A-0.2), Roof Plan and Antenna Plans (Sheet A-1),
Equipment Floor Plan (Sheet (Sheet A-2), Exterior Elevations (Sheets A-3 and A-4), and
Site Surveys (LS-1 through LS-4) - all designated as approved by the Planning and
Building Director on December 1, 2011, and shall not be altered without express
authorization by the Planning and Building Department.
SCA The following conditions shall be completed and/or fulfilled to the satisfaction of the
Engineering Services Department:
The applicant shall obtain a grading permit from the Engineering Department for the
proposed development that includes grading on a slope of 25% or greater.
2. The applicant shall design and install standard stormwater treatment IlVIP facilities to
the satisfaction of the Engineering Services Department.
No work within the public right-of-way is authorized with this application. Any
utility trenching within the right-of-way shall be permitted by the Engineering
Services Department.
SCB Prior to issuing a final inspection on the required building permit, the following conditions
shall be completed/fulfilled to the satisfaction of the Planning and Building Department:
The antenna, radio equipment, and other associated equipment shall be actively and
continuously maintained. The overall condition of the radio equipment and antenna
must be maintained such that any visible areas do not become unsightly.
2. The applicant shall not enter into any special arrangements or take any actions
precluding any other telecommunications providers from utilizing the site as a base
of operations unless it is demonstrated to the satisfaction of the Planning and

Building Deparirnent that any such preclusion was predicated upon verifiable
technical considerations, such as potential radio interference.
3. All facilities and related equipment shall be maintained in good working order and
free from trash, debris, graffiti, and designed to discourage vandalism. Any
damaged equipment shall be repaired or replaced within 30 calendar days.
Damaged, dead ar decaying plant materials shall be removed and replaced within 30
calendar days.
4. Routine maintenance may be conducted only during the hours of 8 a.m. to 5 p.m.
on weekdays, not including holidays. Emergency repairs and maintenance shall
be conducted only in the cases of power outages and equipment failure or
malfunction. The applicant shall notify the Planning and Building
Department of any emergency repairs at the time of the maintenance when
feasible or soon thereafter.
5. Once the wireless communications facility is operating, the City may require the
Applicant/Permittee to submit documentation that the facility is operating within the
technical standards as described in the application and the Federal Communications
Commission pernut. Independent field strength or power density measurements
shall be provided to the Planning and Building Director within 30 days of written
request to the Applicant/Permittee.
6. Within thirty (30) days before or after the first annual anniversary of when the City
issues any permit authorized by Chapter 9.70 of the Municipal Code, and thereafter
at five-year intervals, the Applicant/Permittee shall submit the following
information, in writing, to the Planning and Building Director:
A. Confirmation that the facility continues to operate in compliance with all
terms and conditions of approval by the City.
B. Independent field strength or power density measurements taken within
the past 30 days that verify that the facility continues to operate in
compliance with all terms and conditions and emissions standards
imposed by the Federal Communications Commission.
C. Confirmation that there is no equipment available that would enhance
the safety, efficiency or visibility of the facility or reduce the size of the
facility.
D. Confirmation that there are not more appropriate locations available for
the facility.
E. Confirmation that the facility continues to function as an essential
element of the Applicant/Permittee's network.
F. Documentation of any complaints received by the Applicant/Permittee
since the inception of operations regarding the operation and
maintenance of the facility, including the Applicant's/Permittee's
actions to address the complaints.

7. All wireless communications facilities which receive a building permit under
Chapter 9.70 of the Municipal Code shall be completed and operational within
180 calendar days of the issuance of the building permit and all related permits or
licenses. The construction time may be extended for an additional 180 calendar
days upon a showing of good faith efforts to complete the facility, which shall
take into account complications beyond the control of Applicant/Permittee. If the
facility is not completed and operational by the end of the extension period, then
the permit shall expire, and the Applicant/Permittee must reapply for the permit;
however, this provision shall not apply when the Applicant/Permittee
demonstrates to the satisfaction of the Planning and Building Director that the
operational delay is due entirely to factors beyond the control of the
Applicant/Permittee, in which event the Director may extend the construction
time in his or her discretion.
8. Any facility that ceases operating for more than 90 consecutive days shall be
considered abandoned. In such an event the Applicant/Permittee must either 1)
apply for all permits required at the time of expiration to reactivate the operation,
or 2) remove all elements of the facility and restore the site. In the event the
Applicant/Permittee fails to apply for permits or perform the removal and
restoration within these 90 days, the property owner shall have the facility
removed.
9. Prior to issuing a final inspection on the required building permit, the applicant shall
provide a survey from a licensed surveyor or a registered civil engineer verifying
that the facility's height is in compliance with the approved plans.
10. Any future modifications to the RF-transparent screening wall warranted during the
building permit review and construction phase for the proposed upgrades shall cause
the replacement of the entire screening wall with new, continuous screening
materials to avoid seems in the screening extensions. The-RF transparent screening
materials shall be colored and textured to match the existing building.
SCC Prior to issuing a final inspection on the required building permit, the following conditions
pursuant to the existing FCC OET Bulletin 65 rules regarding RF safety shall be
completed/fulfilled to the satisfaction of the Planning and Building Department:
All access doors/hatches to the roof are to remain locked at all times, except during
active maintenance by Verizon personnel.
2. Verizon shall place and maintain permanent RF Notice signs in English and Spanish at
all roof access points. The signage must be a minimum of 8-inches wide by 12-inches
high, compliant with FCC OET Bulletin 65 or ANSI C95.2 for colar, symbol and
content conventions. All such signage shall at all times provide a working local or toll-
free telephone number to its network operations center, and such telephone number shall
be able to reach a live person who can exert transmitter power �lown control over this

site as required by the FCC. The location of the sign must ensure that anyone
approaching may clearly see the sign before entering the roof area.
3. Verizon shall place and maintain permanent RF Notice signs in English and Spanish
adjacent to each antenna sector visible from the roof area behind each goup of antennas.
The signage must be a minimum of 8-inches wide by 12-inches high, compliant with
FCC OET Bulletin 65 or ANSI C95.2 far colar, symbol and content conventions. All
such signage shall at all times provide a working local or toll-free telephone number to
its network operations center, and such telephone number shall be able to reach a live
person who can exert transmitter power -down control over this site as required by the
FCC. The location of the sign must ensure that anyone approaching the antenna sectors
from the roof will clearly see the sign before coming within three (3) feet of the rear of
the antenna sectors.
G1 STANDARD CONDITIONS:
CONTACT THE PLANNING AND BUILDING DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION(S):
G2 This approval may be appealed to the City Council within 15 calendar days from the date of
this approval in accordance with Chapter 1.12 of the Municipal Code.
G4 Prior to building permit issuance, the owner shall cause a covenant regarding real property
to be recorded. Said covenant shall set forth the terms and conditions of this grant of
approval and shall be of a form and content satisfactory to the Planning and Building
Director. The Owner(s) agree, in acceptance of the conditions of this approval, to waive any
claims of liability against the City and agrees to indemnify, hold harmless and defend the
City and City's employees relative to the action to approve the proj ect.
GS Approval of this request shall not waive compliance with any Section s of the Municipal
Code and all other applicable City regulations in effect at the time of Building Permit
issuance unless specifically waived herein.
G12 Prior to any use of the project site pursuant to this permit, all conditions of approval
contained herein shall be completed or secured to the satisfaction of the Planning and
Building Department.
G13 The applicant shall pay development fees at the established rate. Such fees may include, but
not be limited to: Permit and Plan Checking Fees, Water and Sewer Service Fees, School
Fees, Traffic Mitigation Fees, Flood Control Mitigation Fees, Park Mitigation Fees, and Fire
Mitigation/Cost Recovery Fees. Arrangements to pay these fees shall be made prior to
building permit issuance to the satisfaction of the Planning and Building and Engineering
Services Departments. The applicant is advised to contact the Planning and Building
Department regarding Park Mitigation Fees, the Engineering Services Departrnent regarding
Flood Control and Traffic Fees, applicable School District(s) regarding School Fees, the Fire

Department regarding Fire Mitigation/Cost Recovery Fees, and the applicable Utility
Departments or Districts regarding Water and/or Sewer Fees.
DESIGN REVIEW
DR1 Any future modifications to the approved project will be reviewed relative to the findings
for substantial conformance with a design review pertnit contained in Section 23.08.140 of
the Municipal Code. Modifications beyond the scope described therein may require
submittal of an amendment to the design review permit and approval by the authorized
agency.
B 1 BUILDING CONDITION(S):
CONTACT THE ENCINITAS BUILDING DIVISION REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITION(S):
B2 The applicant shall submit a complete set of construction plans to the Building Division for
plancheck processing. The submittal shall include a Soils/Geotechnical Report, structural
calculations, and State Energy compliance documentation (Title 24). Construction plans
shall include a site plan, a foundation plan, floor and roof framing plans, floor plan(s),
section details, exterior elevations, and materials specifications. Submitted plans must show
compliance with the latest adopted editions of the California Building Code (The Uniform
Building Code with California Amendments, the California Mechanical, Electrical and
Plumbing Codes). Commercial and Multi-residential conshuction must also contain details
and notes to show compliance with State disabled accessibility mandates. These comments
are preliminary only. A comprehensive plancheck will be completed prior to permit
issuance and additional technical code requirements may be identified and changes to the
originally submitted plans may be required.
Fl FIRE CONDITION(S):
CONTACT THE ENCINITAS FIRE DEPARTMENT REGARDING COMPLIANCE
WITH THE FOLLOWING CONDITION(S):
F7 RESPONSE MAPS: Any new development, which necessitates updating of emergency
response maps by virtue of new structures, hydrants, roadways or similar features, shall
be required to provide map updates in one of the following formats (AutoCad DWG,
DXF, ESRI shapefile, ESRI personal geodatabase, or XML format) and shall be charged
a reasonable fee for updating all response maps.
F13 ADDRESS NUMBERS: Approved numbers and/or addresses shall be placed on all new
and existing buildings and at appropriate additional locations as to be plainly visible and
legible from the street or roadway fronting the property from either direction of approach.
Said numbers shall contrast with their background, and shall meet the following
minimum standards as to size: 4" high with a 3/8" stroke for residential buildings, S"
high with a%z" stroke for commercial and multi-family residential buildings, 12" high

with a 1" stroke for industrial buildings. Additional numbers shall be required where
deemed necessary by the Fire Marshal, such as rear access doors, building corners, and
entrances to commercial centers.
F18 CLASS "A" ROOF: All structures shall be provided with a Class "A" Roof coverin� to
the satisfaction of the Encinitas Fire Department.
F23 CELL SITES:
The equipment enclosure shall be labeled to indicate "Telecommunications
EquipmenY' or equivalent to the satisfaction of the Fire Department. If batteries are
used in the telecommunications equipment cabinet, provide the proper labeled NFPA
(National Fire Protection Association) 704 placard that indicates the hazard. A sign
identifying the electrical power shutoff shall be posted to the satisfaction of the Fire
Department. Emergency contact information shall be labeled on the enclosure to the
satisfaction of the Fire Department prior to Certificate of Occupancy. The signage
shall remain in good condition in perpetuity.
2. The owner/applicant shall provide a Knox key box for emergency Fire Department
access.
E1 ENGINEERING CONDITIONS:
CONTACT THE ENGINEERING SERVICES DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION(S):
EGl Grading Conditions
EG3 The developer shall obtain a grading pernut prior to the commencement of any clearing or
grading of the site.
EG4 The grading for this project is defined in Chapter 23.24 of the Encinitas Municipal Code.
Grading shall be performed under the observation of a civil engineer whose responsibility it
shall be to coordinate site inspection and testing to ensure compliance of the work with the
approved grading plan, submit required reports to the Engineering Services Director and
verify compliance with Chapter 23.24 of the Encinitas Municipal Code.
EGS No grading shall occur outside the limits of the project unless a letter of permission is
obtained from the owners of the affected properties.
EG6 Separate grading plans shall be submitted and approved and separate grading permits issued
for borrow or disposal sites if located within the city limits.
EG7 All newly created slopes within this project shall be no steeper than 2:1.

EG8 A soils/geologicaUhydraulic report (as applicable) shall be prepared by a qualified engineer
licensed by the State of California to perform such work. The report shall be submitted with
the first grading plan submittal and shall be approved prior to issuance of any grading permit
for the project.
EG9 Prior to hauling dirt or construction materials to any proposed conshuction site within this
project the developer shall submit to and receive approval from the Engineering Services
Director for the proposed haul route. The developer shall comply with all conditions and
requirements the Engineering Services Director may impose with regards to the hauling
operation.
EG10 In accordance with Section 23.24.370 (A) of the Municipal Code, no grading permit shall be
issued for work occurring between October lst of any year and April 15th of the following
year, unless the plans for such work include details of protective measures, including
desilting basins or other temporary drainage or control measures, or both, as may be deemed
necessary by the field inspector to protect the adjoining public and private property from
damage by erosion, flooding, or the deposition of mud or debris which may originate from
the site or result from such grading operations.
ED1 Drainage Conditions
ED2A An erosion control system shall be designed and installed onsite during all construction
activity. The system shall prevent discharge of sediment and all other pollutants onto
adjacent streets and into the storm drain system. The City of Encinitas Best Management
Practice Manual shall be employed to deternune appropriate storm water pollution control
practices during construction.
ED3 A drainage system capable of handling and disposing of all surface water originating within
the project site, and all surface waters that may flow onto the project site from adjacent
lands, shall be required. Said drainage system shall include any easements and structures
required by the Engineering Services Director to properly handle the drainage.
EDS The owner shall pay the current local drainage area fee prior to issuance of the building
permit far this project or shall construct drainage systems in conformance with the Master
Drainage Plan and City of Encinitas Standards as required by the Engineering Services
Director.
ES1 Street Conditions
ESS Prior to any work being performed in the public right-of-way, a right-of-way construction
permit shall be obtained from the Engineering Services Director and appropriate fees paid,
in addition to any other permits required.

EU1 Utilities Conditions
EU4 All proposed utilities within the project shall be installed underground including existing
utilities unless exempt by the Municipal Code.
ESW1 Storm Water Pollution Control Conditions
ESWS The project must meet storm water quality and pollution control requirements. The
applicant shall design and construct landscape and/or turf areas and ensure that all flows
from impervious surfaces are directed across these areas prior to discharging onto the
street. A Grading Plan identifying all landscape areas designed for storm water pollution
control (SWPC) and Best Management Practice shall be submitted to the City for
Engineering Services Department approval. A note shall be placed on the plans
indicating that the modification or removal of the SWPC facilities without a permit from
the City is prohibited.
ESW9 For storm water pollution control purposes, all runoff from all roof drains shall discharge
onto grass and landscape areas prior to collection and discharge onto the street and/or into
the public storm drain system. Grass and landscape areas designated for storm water
pollution control shall not be modified without a permit from the City. A note to this effect
shall be placed on the Grading plan.
This notice constitutes a decision of the Planning and Building Department only. Additional
permits, including Building Permits, may be required by the Building Division or other City
Departments. It is the property owner's responsibility to obtain all necessary permits required for
the type of project proposed.
In accordance with the provisions of Municipal Code Section 1.12, this decision may be appealed to
the City Council within fifteen (15) calendar days of the date of this determination. The appeal
must be filed, accompanied by the appropriate filing fee, prior to 5:00 p.m. on the 15th calendar day
following the date of this notice of decision.
