OHDERING THE INCLUSION WITHIN THE BOUNDARIES
OF THE SAN DIEGUITO IRRIGATION DISTRICT AND
. ESTABLISHING THE CONDITIGNS TO WHICH SUCH
INCLUSION IS SUBJECT.
WI-iEREAS, petitbns for the inclusion of certain lands
in such petitions and hereinafter particularly described
within the boundaries of the SAN DIEGUITO IRRIGATION DISTRICT
and for the annexation of -such lands to the San Diego County
Water Authority and to The Metropolitan Water District of
. Southern California concurrently with such inclusion have

WHEREAS, by resolution No. 59-10 ad opted on the 9th
day of February, 1959, the governing body of said Irrig-
ation District, to wit: its Board of Directors, applied
to the Board of Directors of the San Diego County Water
Authority for consent to annex to said County Water 'Auth-
ority and to The Metropolitan Water District of Southern
California the lands referred to in such petitions; and
WHEREAS, by resolution No. 512 adopted on the 9th day
of April, 1959, a certified copy of which was immediately
thereafter transmitted to the Board of Directors of said
Irrigation District, the Board of Directors of said County
Water Authority consented to said concurrent annexation,
and prescribed the terms and conditions upon which it might
occur, including compliance with the terms and conditions
prescribed by the Board of Directors of The Metropolitan
Wdter District of Southern California by its r.esolution
No. 5470 adopted March 249 1959, consenting to said con-
current annexation; and
WIiEREAS, each of saia petitions for inclusion and con-
current annexation of said lands was regularly set for
hearing, and notice of the day, hour and place of the hear-
ing of each of said petitions was duly and regularly given
in the manner and for the perbd of time required by law; and
WHEREAS, at the time set for the hearing of each of
said petitions the Board of Directors of said Irrigation
District proceeded with the hearing upcn said petitions,
and did then duly continue the hearing upon each of said
petitions from meeting to meeting of said Board to and in-
cluding the regular meeting of the Board of Directors of
said Irrigation District on May 8t 1959; and
WEREAS, at said regular meeting of the Board of
Directors of SAN DIEGUITO IRRIGATION DISTRICT on May 8,
1959, the said Board proceeded with said hearing, and did •
find and determine that the inclusion of such lands without
condition, including the compliance with the terms and con=
ditions of concurrent annexation of said lands to the San
Diego County Water Authority as recited in its resolution
No. 512t and to The Metropolitan Water District of Southern
Calif ornia as recited in its said resolution No. 5470, would
work an injury as to the land already within the Irrigation
District, and did adopt resolution No. R59-18 adjourning
the hearing until June 9, 1959, prescribing the conditions
proposed on the inclusion of said lands, and ordering that
notice of the adjourned hearing be given, all in the IDanner
provided by Sections 26938 to 26948, both inclusive, of the
Water Code of the State of California; and
WHEREAS, on the day and haur to which such hearing
was adjourned as prescribed in said resolution No. R59-18,
the Board proceeded to the consideration and determination
of said petitions, and said hearing being duly concluded,
NOW, THER.EFORE, IT IS RESOLVED, DETERMINED7 FOUND AND
ORDERED:
1. That petillitions signed by the owners above named
have been duly filed with the Secretary of the said Board.
2. That at the time of fiii.tag of said petitions the
pet;it.ion.ers _,orastituted themajo~it~ of the holders of title
to the tracLs of Zand described in their respective petitions
and were the holders of title to one-half or more of the
area of said lands described in said respective petitions.
3. That notice of the filing of eaah of said petitions,
and of the hearings thereon, were duly, properly and regularly
posted and published in the mantler and #'or the period of time
prescribed by I,aw.
' 4. - That said petitions, and eaeh of them, comply with,-
' Article 11 Chapter 21 Part 11, Division 119 of the Water
• Cbde of the State of California.
5. That on the date set in the notice of ~he hearing
of each of said petitions, said date being a regular meet-
ing aay of said Board of Directors, said Board at regular
meet ing assembled and at the hour of 1:30 P.M. proceeded
to hear evidence introduced on behali of each of said
petitions, and thereafter the hearing upon each of said
petitions was duly and regularly continued from meeting
to meeting until the 8th day of May, 1959; said Board did
then determine that the inclusion of such lands without
condition would work an injury as to land already within
the District, and did prescribe certain conditions upcn the
inclusion of such lands, and did thereupon adjourn said
meeting until 1:30 P.N.. June 9, 1959•
6. That notice of the time and place of said ad-
journed hearing in which was set out at length the con-
ditions proposed to be imposed, was duly and regularly
given for the period of time and in the manner and form
required by law.
7. That on the 9th day of June, 1959, at 1:30 P.Mo,
that being the day and hour to which such hearing was ad-
journed, the Board proceeded with the hearing and the con-
sideration of such inclusion and the conditions to which
such lands would be subjected.
8. That protests in writing against the inclusion
of the lands in said petitions described have been presented
to said Board, but that said protests and objections which were
filed prior to the hearing of said petitions were not
signed by three percent of the holders of title to the
land within the District who were also the holders of
title to not less than three percent in value of the land
within the District according to the last equalized assess-
ment of the District, and that said protests were, and are,
insufficient to require an inclusion election to be held
within the District to determine whether or not the lands
hereinbelow described shall be included under the conditions
referred to in paragraph 5 above. That the purported pxo-
~ests filed June 9, 1959 were not filed within the time
prescribed by the Water Code of the State of Califorria and
it is unnecessary to determine whether they are signed by
the number of persons specified in Section 26965 of said
Code.
9. That the inclusion of the lands in said petitions
and hereinafter described within the boundaries of said
Irrigation District, subject to the conditions herein estab-
lished, would be for the best intei%t and benefit of said
District.
10. That the lands hereby included would be benefited
by such inclusion within the boundaries of said District
upon the conditions herein established.
11. That said lands can be supplied with water by means
of the works of said District, or by practicable works
connecting therer►ith.
12o That the conditions upon which said lands are
hereby iracluded within the boundarie5 of° sa.id District are
hereby adopted an3 presc.-ibed, as followno

Southern California subject to the terms and con-
ditions upon which such annexation may occur as
fixed and determined by the Board of Directors of
such Metropolitan Water District by its Resolution
No. 5470, adopted March 24, IL959, and wh;_ch are
substantlsily as follows :

ive flffice required by law, on or before December
1, i95y.
(2) In tlhe event of such annexation:
a. There shall be levied by The .
Metropol.itan Water District speeia2 taxes
upon taxable property within said terri-
tory, in addition to the taxes elsewhere
in the Metraplitan WateP D2strict Act
( Stats . 1927, page 6949 a;s amended) author-
ized to be levied by said Metrapolitan
Water Dis trict;
b. The aggz°egate aYnount to be raised
by such special taxes shall De $71,820.00;
c. The number of years prescribed
for raising such aggregtil.-e sum shall be
thirty years cdmmencing with thefiscal
year 1960-1911;
d. Substantially equal. amual levies
vill be made for the purgose of raising
said sum over the periryd so, prescribed .
(3) That in the event af such annexations a11
feeder gipe lines, structures, connectfons aaid other
facil3tes required for the deli.wery of waterto said
territory, f rom works owned or operated by said
Nietropolitan Water Districtg shall be consti°ucted'
provided and instal3ed without cost or expense to
said Metropolitan Water District, and said Metro-
politan Water District shall be untier no obligatian
to provide, construct, operate or maintain sueh
works.
II. Said lands, upon inclusion3 shall be concurrentl.y
annexed to the San Diego Couaity Water Authority
subject to the terms and eonditions upon which
such annexationmay occur as fixed and determined
by the IIoard of Directors of such County Water

IV. All inclusion fees referred to in Paragraph III
above as to each parcel shall be payable as follows:
(1) One-fifth or more in cash upon completion
of the inclusion and concurrent annexation to this
District, the San Diego County Water Authority and
The Metropolitan Water District of Southern Calif-
ornia;
(2) Any amount not so paid shall be entered
upon the District's Assessment Rolls in eight semi-
annual equal installments, which installments to-
gether with interest at the rate of 6% per annum
from the date of inclusion.until paid shall be
collected by the District, together with and as
an addition to the regular annual irrigation district
assessment;
(3) Any installment may be prepaid before
its due date, provided where less than all install--
ments are so prepaid the payment shall be credited
upon the installments of latest maturity dates;
(4) In the event the ownership of any part of
said parcel of lands is voluntarily transferred to
netir ownership, the 1u11 unpaid balance of said incl-
usion fee upon such part shall i.mmediately beoome
due and payable.
Y. The Irrigation District shall not be required or
obligated to serve such lands vith water unless and
until the owmer or owners of said property have
either:
(1) Paid to the Irrigation District in cash, .
, in addition to all sums theretofore due under the
' foregoing provisions of this resolution, the cost
of all works of every character necessary to bring
water in adequate quantity from the existing works
of the District to the boundary of the land upon
which the water is to b9o6sed, including without
Iimitation the cost of expanding or increasing
existing facilities bf the District if such ex-
pansion or increase is required; or
(2) Installed or constructed at their own
expense all such works mentioned in this paragraph
V, either through the formation of one or more
improvement districts pursuant to the provisions
of part 7 of Division 11 of the Water Code, or
otherwise.
VI. Any distribution system or works required for the
distribution of water within the boundaries of
said tracts of land of each inclusion parcel shall
be installed or constructed therein at the ex-
pense of the owners thereof.
VII. After inclusion, said lands shall be subject to
assessment for all lawful irrigatinn district
purposes on the sa.me basis as other lands within
the District, and in addition to the special assess-
. ments and special taxes hereinabove referred to in
this resolution. Such assessments shall begin
with those levied for the fiscal year 1960-1961.
13. That said petitions are hereby granted, and the
following described lands are hereby included within the
boundaries of the SAN DIEGUITO IRRIGATION DISTRICT subject
to and upon the conditions hereinabove recited, and the
boundaries of said Irrigtaion District are hereby changed
to include therein the following described lands, to wit:
