The foregoing resolution having been put to a roll-call vote was adopted by tne following vote, to wit: AYES: Directors wagner, Hales, Petzold, Cook and Blecha NOES: None ' ABSENT: None RESOLUTION R55-14 November 8, 1955 RESOLUTION OF THE BOARD OF DIRECTORS OF THE SAN DIEGUITO IRRIGATION DISTRICT RELATING TO THE INCLUSION OF LAND OWNED BY PAUL AND MACxDALENA ECKE WHER.EAS, the Board of Directors of the San Dieguito Irriva- tion District, at a regular meeting of said Board on the 8th day of November, 1955, a quorum of said Board being present, proceeded to the consideration and determination of the pe- tition of Paul Ecke and Magdalena Ecke, as owners of the property hereinafter described, praying that the land here- after described be included within said District; and VPHEREAS; the hearing thereof has been fully concluded: NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED:. that the following facts be, and they are, hereby found from the evidence and proof introduced at said hearing, and the facts so found are hereby adopted as findings of this Board: ' 1. Said petition, was duly ackriotivledged and was duly filed with the Secretary of this Board on the 16th day of Septernber, 1955; 2. Said Paul and Ma.gdalena Ecke are the owners in fee • of all the land described in said petition; 3. Said petition co mplies with all the provisions of the Water Code of the State of California; 4. Notice of this hearing ha.s been given as required by law by posting notice thereof in three public places in the San Dieg~o Irxigation District for at least twenty (20) days prior to the hearing of the petition, and publication of notice of filing and hearing of said petition in the Coast Dispatch of Encinitas, California, a newspaper published in the County of San Diego, state of California, where the offices of the Board of Directors of San Dieguito Irrigation District are kept., once a week for three (3) weeks immediately preceeding the regular meeting of the Board of Directors at tivhich the petition was heard; 135 5. On the 8th day of November, 1955, said day being the day fixed in said notice for the hearing of said petition, at a regular meeting of the Board, said petition came on for hearing at the hour of 1:30 o'clock P.M., and the Board proceeded to hear evi- _ dence and proofs offered and introduced on behalf of said petition; 6. No protests have been presented in writing against the inclusion of the lands described in said peti- tion and no objection has been filed in Mriting showing cause why the lands described in said peti- , tion should not be included in the District as pro- posed therein; 7. The lands described in the petition, and herein- after described, can be served by means of some of the present works of the District, or practicable extensions thereof, and axe susceptible of irriga- tion and will be benefited by inclusion within the District, and such inclusion will be for the b est interests of the District. 8. The inclusion fee for said land should be and is hereby fixed at the sum of $503.75 per acre. The petitioners have advanced to the Secretary of the Dis- trict sufficient money to pay for all expenses of the in- clusion of said lands, and have paid in full the above determined inclusion fee, and by filing their petition have assented to the inclusion of the lands set forth in said petition and hereinbelow described, and to the change of boundaries of the District so as to include saicl lands, and have assented to the inclusion of said lands within the San Diego County Water Authority, and within the metro- politan Water District of Southern California, and have agreed to assume all of the obligations involved thereby.
