RELATING TO THE INCLUSION OF CERTAIN LAIVDS
AND ORDERING HPARING
WHEREAS, there has been filed with the SAid DIEGUITO
IRRIGATION DISTRICT the Petition of Iva A. Shirley, as ouvn-
er of the property hereinafter described, praying that the
bouridaries of the SAN DIEC7UIT0 IRRIGqTION DISTRICT be so
changed as to include within said District the certain lands
therein and hereinafter described; and
VifHEREAS, upon the filing of said petition, the Board
considered tY?e same and has found and determined that the
lands descrzbed in said petition can bo irrigated frorn some
of the existing works of' the Irrigation District and that
said lands are susceptible of irrigation and will be bene-
fited"by inclusion in the District and that said petition,
as filed, complies' with the California 'U9Vater Code; and
WHEREA.S, it has been determined and agreed upon that
all extensions of water lines from existing vvorks of the
lrrigation District to the proporty hereinafter described
vvill be done by, and at the expense of, the aUove petition-
er; and IYHEREAS, petitioner has advancod to the Socretary of
the SAN DIEGUITO IRRIGATION DISTRICT sufficient money to
pay for the publication of the NoticQ of the Inclusion
Hearing; and
WHEREAS, consent is given in the above mentioned I'e-
tition that if the certain lands therein and hereinafter
described are included in the SAN DIEGUITO IRRIGATION DIS-
TRICT, the petitioners will Deed to the SAN DIEGUITO IRRI-
GATIOTd DISTRICT for recreational purposes only, upon its
exclusion from the SAN DILGUITO IRRIGATIUN DISTRICT, the
following described proparty:
That portion of the North Half of the SE-1 of the NM2
of Section 15, T. 13 S, R4W, S.B.M. located in San
Diego County, State of California, and according to
U.S. Government Survey described as follovrs:
Beginning at the SW Corner of said SE~ of the N6v~ of
Section 15; Thence North 1°48t East along the West
line of said SE~ of NW¢ a distance of 665.20 feet to
the South line of the North Half of the SE` of Nff-;'~~
of Section 15; and the true point of beginning.

WHEREAS, petitioner by filing its petition did and
does assent to the inclusion of the lands described here-
inafter and in said petition and consents to the change of
boundaries of SAN DIEGUITO IRRIGATION DISTRICT so as to
include the said lands,
NOV11, THEREFORE, the Board of Directors of SAN DIEGUI-
TO IRRIGATION DISTRICT d'oes hereby resolve that the proper
notices of the Hearing of said petition be given and that
the matter for inclusion be heard and determined at the

first regular meeting of the Board of Directors of SAN DIE-
GUITO IRRTGATION DISTRICT after the giving of such notices
is completed.

RESOLUTION R49-28
RELATING TO EXCLUSIOIJ OF CERTAIN LANDS
WHEREAS, On January 4, 1949, a"Resolution of the Board
of Directors of the SAV DIEGUITO IRRIGATION DISTRICT Re1at-
ing to the Exclusion of Certain Lands" was passed and adopt-
ed and was rQCOrded in the minutos of the SAN DIEGUITO IRRI-
G!1TION DISTRICT as Resolution R49-1 and in the Official Re-
cords of 'San Diego County on February 8, 1949 as Document No.
12007, and
tiUHEREAS, It appears that the aforementioned Resolution
R49-1 contains certain clerical errors of omission in the de-
scription of properties therein set forth, vlhich creates am-
biguity in said description, now therofore
BE IT RESOLVED that the description of lands heretof'ore
set forth in said Resolution R49-1 is hereby declared null
and void, and
BE I1^ FURTHER RESOLVED, DETLRMIIvED AND ORDERED, that the
lands hereinafter in this Resolution described are hereby ex-
cluded from and are hereafter not a part of the SA%1 DIEGUITO
IRRIGATION DISTRICT, and that sucn determination is in accord-
ance vrith the regular hearing proc.eedings held on January 4,
1949.
That a certified copy of this order shall be filed for record
in the ofS'ice of the County Recorder of San Diego CouM9, , Cal-
ifornia, and theroupon and retroactive to January J~, the
lands~described herein shall not be a part of this District.
