NOTICE OF DECISION
April 9, 1990
This letter is to inform you that the Director of Community
Development has approved your application for:
90-054ADP - Administrative Design Permit to erect a 5 foot
high Columbia iron fence and 5 foot high hollow concrete block
wall with stucco on one residential lot in the RR-1 zone.
The fence and wall will be in close proximity-of the existing
house in the rear and side areas.
Approval subject to following findings and conditions as indicated
within the attached resolution DCD 90-011.
This approval is based upon the finding that the proposal is in
substantial compliance with the City's Design Review Guidelines and
Technical Development Standards, and that none of the regulatory
conclusions contained in Chapter 23.08 of the City of Encinitas
Municipal Code can be made.
This approval is valid for two years, to expire on April 6, 1992,
unless prior to that time the applicant has obtained a building
permit and has performed substantial construction in reliance on
this permit.
Pursuant to Section 23.08.200 of the City of Encinitas Municipal
Code, this decision of the Director may be appealed within fifteen
calendar days of the date of this notice. This notice constitutes
a decision by the Planning Department only. Building Permits may
also be required.
This project is exempt from Environmental Review per Section
15303(a) of CEQA.

RESOLUTION NO. DCD 90-011
A RESOLUTION OF THE DIRECTOR OF
PLANNING AND COMMUNITY DEVELOPMENT OF
THE CITY OF ENCINITAS APPROVING DESIGN
REVIEW APPLICATION 90-054 ADP FOR LOT 5, SIENNA CANYON
(COMMONLY KNOWN AS 1812 SIENNA CANYON DRIVE)
WHEREAS, William H. Watts applied for a Design Review Permit
for a 5 foot high Columbia iron fence and 5 foot high hollow
concrete block wall with stucco at 1812 Sienna Canyon Drive
pursuant to Chapter 23.08.040 Design Review, of the City of
Encinitas Municipal Code;
WHEREAS, public notice was given to the application by the
Director to allow all parties to submit information prior to March
28, 1990, and all person desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. Site plan submitted by the applicant;
b. Written information submitted with the application;
C. Oral and written testimony from staff, applicant, and
public made a part of the administrative record
considered by the Director.
NOW THEREFORE, BE IT RESOLVED by the Director of Planning and
Community Development of the City of Encinitas that the Design
Review Permit is hereby approved subject to the following findings:
A. The project design is inconsistent with the General Plan,
a Specific Plan or the provisions of this Code.
Evidence: The proposal is consistent with the General
Plan and the Rural Residential 1 zoning because a fence
or wall of six feet in height or less is expressly
permitted in this zone. A fence or wall is also an
acceptable and common accessory structure in a
residential district.
B. The project design is substantially inconsistent with the
Design Review Guidelines.
Evidence: The proposal is substantially consistent with
the Design Review Guidelines because it reflects an

acceptable level of design appearance with its 5 foot
high black iron fence and 5 foot high beige stucco wall.
C. The project would adversely affect the health, safety or
general welfare of the Community.
Evidence: The proposal does not adversely affect the
health, safety, or general welfare of the community
because it is located along common property lines and is
designed in such a way as to pose no apparent hazard to
the community.
D. The project would tend to cause the surrounding
neighborhood to depreciate materially in appearance or
value.
Evidence: The project will not tend to cause the
surrounding neighborhood to depreciate materially in
appearance or value because it is visually compatible
with the nearby existing primary dwelling units. The
fence and wall will compliment the landscaping which is
to be completed by Davidson Communities.
IT IS HEREBY RESOLVED BY THE DIRECTOR THAT: the proposed
Columbia iron 5 foot high fence and 5 foot high hollow concrete
block wall with stucco for 1812 Sienna Canyon Drive (lot 5 Sienna
Canyon Development) is approved for construction as shown on the
site plan submitted on March 7, 1990 which is on file at the
Department of Planning and Community Development. The approval
will be subject to the following conditions:
- The maximum height of the fence and wall shall be no more
than 5 feet in height from finished grade.
The fence and wall are approved with the setbacks shown
on the approved set of plans dated March 7 1990.
The fence hole posts and the concrete blocks at ground
level, shall be properly secured by the completion of the
project.
Prior to final approval applicant shall submit a letter
from the Fire District stating that all plan review fees
have been paid if applicable.
When the fence and walk are completed, a final inspection
from the Planning Department is required. Call the
Olivenhain Community Advisory staff one week in advance
to schedule an appointment.

THIS DECISION was rendered by the DIRECTOR OF PLANNING AND
COMMUNITY DEVELOPMENT on April 6, 1990 and may be appealed to the
City Council pursuant to Section 23.08.200 and 1.12 of the
Municipal Code.
