NOTICE OF DECISION
June 15, 1990
This letter is to inform you that the Director of Community
Development has approved your application for:
90-075 ADP - PACIFIC SERENA HOMEOWNERS ASSOCIATION.
Administrative Design Review for the placement of
two 19" x 31" residential identification signs
located at 726 Snapdragon Street and 763 Teaberry
Street.
Approval subject to findings and conditions as indicated within the
attached resolution DCD 90-023.
This approval is based upon the finding that the proposal is in
substantial compliance with the City's Design Review Guidelines and
Technical Development Standards, and that none of the regulatory
conclusions contained in Chapter 23.08 of the City of Encinitas
Municipal Code can be made.
This approval is valid for two years, to expire on June 15, 1992,
unless prior to that time the applicant has obtained a building
permit and has performed substantial construction in reliance on
this permit.
Pursuant to Section 23.08.200 of the City of Encinitas Municipal
Code, this decision of the Director may be appealed within fifteen
calendar days of the date of this notice. This notice constitutes
a decision by the Planning Department only. Building Permits may
also be required.
This project is exempt from Environmental Review per Section 15303
of CEQA.

RESOLUTION NO. DCD 90-023
A RESOLUTION OF THE DIRECTOR OF
PLANNING AND COMMUNITY DEVELOPMENT OF
THE CITY OF ENCINITAS APPROVING DESIGN
REVIEW APPLICATION 90-075 ADP FOR PROPERTY LOCATED AT
726 SNAPDRAGON STREET AND 763 TEABERRY STREET, ENCINITAS
WHEREAS, Pacific Serena Homeowners Association applied for a
Design Review Permit for two 19" X 31" residential identification
signs located at two entrances to the development (726 Snapdragon
and 763 Teaberry Street) pursuant to Chapter 23.08.040 (Design
Review) of the City of Encinitas Municipal Code;
WHEREAS, public notice was given to the application by the
Director to allow all parties to submit information prior to April
24, 1990, and all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. Site plan submitted by the applicant as received by the
City of Encinitas on April 6, 1990 dated April 2, 1990.
b. Written information submitted with the application;
C. Oral and written testimony from staff, applicant, and
public made a part of the administrative record
considered by the Director.
WHEREAS, the City of Encinitas has not been provided evidence
that the message of the sign is accurate, the City can not verify
the accuracy of message nor can restrictions be placed on the
content of sign message since the Municipal Code provides for
message neutral signs.
NOW THEREFORE, BE IT RESOLVED by the Director of Planning and
Community Development of the City of Encinitas that the
Administrative Design Review Permit is hereby approved subject to

the following findings:
23 08.072 Regulatory Conclusions - Generally.
A. The project design is inconsistent with the General Plan,
a Specific Plan or the provisions of this Code.
Evidence: The proposed placement of two 19" x 31" residential
identification signs are consistent with the General Plan and
the provisions of this Code. Chapter 30.60.070 of the
Encinitas Municipal Code establishes permanent residential
sign standards. This Chapter permits one 5 square foot sign
a maximum of 4 feet in height to be placed a minimum of 2 feet
from a property line or public right-of-way on a residential
lot. Since the proposed signs are to be placed on separate
lots within the guidelines described above, this project is
consistent with the General Plan and the provisions of this
Code.
B. The project design is substantially inconsistent with the
Design Review Guidelines.
Evidence: The proposed signs are consistent with the Design
Review Guidelines which encourage signs that: are
architecturally compatible in size, shape and color with the
surrounding neighborhood; that are not obtrusive and convey
the message legibly and clearly; and that are constructed of
durable, weather resistant materials. The proposed signs are
to be in scale with the surrounding structures. They are
proposed to be rectangular in shape, four feet in height and
less than 5 square feet in area.
The colors to be used in the proposed signs are a white and
gold background with black block lettering. This color scheme
provides an effective contrast to convey the message "Pacific
Serena Homes: A senior community" legibly and clearly. The
proposed signs are to be constructed of exterior grade plywood
with 1" x 2" painted wood posts. This proposed signage
appears to be constructed of durable and weather resistent
materials. It is the opinion of staff that the proposed signs
are substantially consistent with the Design Review
Guidelines.
C. The project would adversely affect the health, safety or
general welfare of the community.
Evidence: No negative effects on the health, safety or
general welfare of the community can be identified in
conjunction with this project. Several citizens expressed
concerns that the identification of this housing development
as a senior community may result in an increase in robberies
or other crimes, however, no evidence has been submitted to

substantiate this concern.
D. The project would tend to cause the surrounding
neighborhood to depreciate materially in appearance or value.
Evidence: No evidence has been submitted which suggests that
the proposed signs would tend to cause the surrounding
neighborhood to depreciate materially in appearance or value.
IT IS HEREBY RESOLVED BY THE DIRECTOR THAT CASE NO. 90-075 ADP
(Pacific Serena) is approved subject to the following conditions:
1) This approval is valid for two years, to expire on June
151 1992, unless prior to that time the applicant has
performed substantial construction in reliance on this
permit.
2) The size, location, and colors of the proposed signs will
be in compliance with the plans submitted April 6, 1990,
and dated approved by the City of Encinitas Community
Development Department on June 151 1990.
3) The applicant shall notify the City of Encinitas
Community Development Department when the signs are in
place to enable the Department to verify that the signs
are pursuant to this approval. Following the approval
by the Department of Community Development, any remaining
funds in the applicants account shall be released to the
applicant.
THIS DECISION was rendered by the DIRECTOR OF PLANNING AND
COMMUNITY DEVELOPMENT on June 15, 1990 and may be appealed to the
City Council pursuant to Section 23.08.200 and Chapter 1.12 of the
Municipal Code.
