February 15, 1991
This letter is to inform you that the Director of Community
Development has approved your application for:
90-234 ADP Administrative Design Review for a 6 sq. ft.
projecting sign and a 20 sq. ft. wall sign permanently
attached to stairway railing for Coast Highway Market.
Project also includes removal of all existing nonconforming
signage that is attached to the building, including previously
approved 12 sq. ft. sign above doorway, located at 332 North
Highway 101.
Approval subject to following findings and conditions as indicated
within the attached resolution DCD 90-052.
This approval is based upon the finding that the proposal is in
substantial compliance with the City's Design Review Guidelines and
Technical Development Standards, and that none of the regulatory
conclusions contained in Chapter 23.08 of the City of Encinitas
Municipal Code can be made.
This approval is valid for two years, to expire on February 15,
1993, unless prior to that time the applicant has obtained a
building permit and has performed. substantial construction in
reliance on this permit. Removal of nonconforming signage shall
be complete by March 1, 1991.
Pursuant to Section 23.08.200 of the City of Encinitas Municipal
Code, this decision of the Director may be appealed within fifteen
calendar days of the date of this notice. This notice constitutes
a decision by the Planning Department only. Building Permits may
also be required.
This project is exempt from Environmental Review per Section
15301(g) of CEQA.

A RESOLUTION OF THE DIRECTOR OF
PLANNING AND COMMUNITY DEVELOPMENT OF
THE CITY OF ENCINITAS APPROVING DESIGN
REVIEW APPLICATION 90-234 ADP FOR PROPERTY LOCATED AT
332 North Highway 101.
WHEREAS, Alan Dorfman applied for a Design Review Permit for
a six (6) square foot projecting sign and a 20 (twenty) square foot
wall sign permanently attached to stairway railing for Coast
Highway Market. Project also includes removal of an existing
nonconforming signage that is attached to the building, including
previously approved 12 sq. ft. sign above doorway located at 332
North Highway 101 pursuant to Chapter 23.08.040 (Design Review) of
the City of Encinitas Municipal Code;
WHEREAS, public notice was given to the application by the
Director to allow all parties to submit information prior to
October 11, 1990, and all persons desiring to be heard were heard;
and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. Site plan submitted by the applicant as received by the
City of Encinitas on September 26, 1990 dated September
26, 1990, and revised on February 13, 1991;
b. Written information submitted with the application;
C. Oral and written testimony from staff, applicant, and
public made a part of the administrative record

NOW THEREFORE, BE IT RESOLVED by the Director of Planning and
Community Development of the City of Encinitas that the
Administrative Design Review Permit is hereby approved subject to
the following findings:
23.08.072 Reaulatorv Conclusions - Generall
A. The project design is inconsistent with the General Plan,
a Specific Plan or the provisions of this Code.
Evidence: The proposed six (6) square foot projecting sign
and 20 (twenty) square foot wall sign attached to stairway
railing for Coast Highway Market are consistent with the
General Plan and the provisions of this Code. The other
signage attached to the building, however, is inconsistent
with the provisions of the Code and must be removed. There
is no adopted Specific Plan for the site. Section 30.60.100D
(wall signs) of the Encinitas Municipal. Code provides for non-
residential permanent wall signs to be calculated as: one
square foot per linear foot of building on the side where the
main entrance of the establishment is located. The proposed
wall sign attached above stairway railing has a total sign
area of approximately twenty (20) square feet. The building
frontage is 20 linear feet, therefore, the proposed wall sign
is consistent with the provisions of this Code.
The six (6) square foot projecting sign is proposed to be
located in the center, top portion of the building fronting
on Highway 101. Section 30.60.100E (Projecting Signs) of the
Encinitas Municipal code provides for one six (6) square foot
projecting sign along each street frontage in addition to the
total allowable wall signage. The proposed projecting sign
is consistent with this Section and, therefore, is consistent
with the provision of this Code.
B. The project design is substantially inconsistent with the
Design Review Guidelines.
Evidence: The proposed six (6) square foot projecting sign
and twenty (20) square foot wall sign for Coast Highway Market
are consistent with the Design Review Guidelines which
encourage architecturally compatible signage. See Attachment
"A" for sign findings.
C. The project would adversely affect the health, safety or
general welfare of the community.

Evidence: No negative affects on the health, safety or
general welfare of the community have been identified in
conjunction with this project.
D. The project would tend to cause the surrounding
neighborhood to depreciate materially in appearance or value.
Evidence: No negative impact form the project on the
surrounding community can be identified. The project will
remove most of the existing signage to clean up the
"cluttered" appearance of-the existing building.
IT IS HEREBY RESOLVED BY THE DIRECTOR THAT CASE NO. 90-234
ADP is hereby approved subject to the following conditions:
1) This approval is valid for two years, to expire on
February 15, 1993._;. unless prior to that time the
.-.applicant has perLormed substantial construction in
reliance on this permit. Removal of nonconforming
signage shall be completed by March 1, 1991.
2) The size, location, and colors of the proposed signage
will be in compliance with the plans submitted September
26, 1990 and revised on February 13, 1991 dated approved
by the City of Encinitas Community Development Department
on February 15, 1991.
3) The applicant shall notify the City of. Encinitas
Community Development Department when the signage is in
place to enable the Department to verify that the project
is pursuant to this approval. Following the approval by
the Department of Community Development, any remaining
funds in the applicant's account shall be released to the
applicant.
4) The applicant shall obtain the necessary permits or
exemption from the appropriate departments and agencies,
including the State of California Coastal Commission.
5) All nonconforming signage and previously approved 12 sq.
ft. "Coast Highway Market" sign shall be removed
including the signage on the sides of the building, the
cigarette signs on either side of the building front, and
the signage on the inside of the two front doors if the
doors are to be blocked open in the daytime.

23.08.078 Regulatory Conclusions - Signs.
A. The project design fails to assure that the size and shape of
all signs are in scale with the buildings to which they are
attached.
Evidence: The proposed wall and projecting signs are in scale
with the building with which they are attached. Both signs
are consistent with Section 30.60.100 of the Encinitas
Municipal Code and all other signage attached to the building
will be removed prior to final approval.
B. The building design does not provide for adequate space and
locations on the building, in harmony with the architectural
design, for the display of signs.
Evidence: There is sufficient space on the building for
signage which is consistent with Section 30.60.100. The 20
sq. ft. wall sign is proposed to be located on the stairway
railing in front of the entrance to the market. The 6 sq. ft.
projecting sign is proposed to be located above the wall sign.
The signage will be centered on the building front in harmony
with the steep pitched roof design of the structure.
C. The project signage fails to relate well to the buildings of
the project and to the neighborhood in general in terms of
size, shape, color, texture, materials and lighting intensity,
creating a visually incompatible appearance.
Evidence: The proposed signage relates well to the building
on the site and with the surrounding commercial buildings.
The proposed wall sign is designed to be removable to enable
the applicant to place new periodic promotional signs in the
permanent frame. The applicant has stated that the primary
colors will be black, red, gold and blue with a white
background. The proposed projecting sign is designed with
bold blue, black and red lettering attached to a white,
interior lit plastic backing. The building colors are
primarily red and white, therefore this sign color scheme
matches the building colors. It is the opinion of staff that
the proposed signage is compatible with the existing signage
within the commercial district of Old Encinitas.

D. The project signing does not show subtlety, is obtrusive or
does not convey the message legibly and clearly.
Evidence: The proposed signage coveys the message legibly and
clearly. The signs will be visible from the street but also
in character with other signage in the neighborhood.
E. The proposed sign is not weather resistant or durable.
Evidence: The proposed signage is weather resistent and
durable. The plastic lettering on the projecting sign should
remain in good condition for the life of the sign. The wall
sign will attached to the stairway railing will require
periodic maintenance common to similar signs in Old Encinitas.
