Approval subject to following findings and conditions as indicated within the attached resolution DCD 90-016. This approval is based upon the finding that the proposal is in substantial compliance with the City's Design Review Guidelines and Technical Development Standards, and that none of the regulatory conclusions contained in Chapter 23.08 of the City of Encinitas Municipal Code can be made. This approval is valid for two years, to expire on December 11, 1992, unless prior to that time the applicant has obtained a building permit and has performed substantial construction in reliance on this permit. Pursuant to Section 23.08.200 of the City of Encinitas Municipal Code, this decision of the Director may be appealed within fifteen calendar days of the date of this notice. This notice constitutes a decision by the Planning Department only. Building Permits may also be required. This project is exempt from Environmental Review per Section 15311 11(a) of CEQA. DCD 90-016 A RESOLUTION OF THE DIRECTOR OF PLANNING AND COMMUNITY DEVELOPMENT OF THE CITY OF ENCINITAS APPROVING DESIGN REVIEW APPLICATION 90-062ADP FOR PROPERTY LOCATED AT 1680 North Highway 101 WHEREAS, Richard Webster applied for a Design Review Permit for a wall sign and projecting sign for a commercial building at 1680 North Highway 101 pursuant to Chapter 23.08.040 (Design Review) of the City of Encinitas Municipal Code; WHEREAS, public notice was given to the application by the Director to allow all parties to submit information prior to April 17, 1990, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: a. Site plan submitted by the applicant; b. Written information submitted with the application; C. Oral and written testimony from staff, applicant, and public made a part of the administrative record considered by the Director. NOW THEREFORE, BE IT RESOLVED by the Director of Planning and Community Development of the City of Encinitas that the Administrative Design Review Permit is hereby approved subject to the following findings: CC/04/PN3-354WP5 2(12/11/90-2) CASE NO. 90-062 ADP subject to the following conditions: 1. The applicant must provide a copy of a letter of the Fire District stating that all plan check fees have been paid. 2. The applicant must obtain a building permit and a sign permit for all new signs. 3. The size, location, and colors of the proposed signage will be in compliance with the plans submitted and approved by the City of Encinitas Community Development Department on December 11, 1990. CC/04/PN3-354WP5 3(12/12/90-3) 23.08.78 Regulatory Conclusions - Signs. A. The project design is consistent with the size and shape of all signs, and are in scale with the buildings to which they are attached. Evidence: The proposed signs are a wall sign measuring 32 square feet and a projecting sign measuring 6 square feet which complies with Section 30.60.100 E.2 of the Sign Ordinance. The sizes are in scale with the building in that the size and shape of the signs does not exceed the maximum dimension allowed. B. The building design provides for adequate space and locations on the building, in harmony with the architectural design, for the display of signs. Evidence: The width of the main entrance of the buildings, (the east elevation) is 40 feet which provides more than adequate space for the 32' square foot wall sign. This meets the requirement of 1 square foot per linear foot of main building entrance per Section 30.60.100 D.1 of the Sign Ordinance. The size of the proposed projecting sign meets the requirement at 6 square feet maximum. C. The project signing relates to the buildings of the project and to the neighborhood in general in terms of size, shape, color, texture, materials and lighting intensity, creating a visually compatible appearance. Evidence: The black, soft yellow, red, and white combination of the signs adequately relates to the color of the buildings of the project and to the overall commercial center in terms of color which creates a visually compatible appearance. D. The project signing conveys the message legibly and clearly. Evidence: The black lettering with the soft yellow background does convey a clear and legible message. E. The proposed signing is weather resistant and durable. Evidence: The proposed signage materials are made of natural elements such as plywood and redwood and may have some wear and tear over a long period of time due to adverse weather conditions, however, maintaining the upkeep of the signs will allow them to be durable.
