1991-020CITY OF ENCINITAS 527 Encinitas Boulevard, Suite 100 Encinitas, California 92024 (619) 944-5060 NOTICE OF DECISION DCD 91-020 June 14, 1991 This letter is to inform you that the Director of Community Development has approved your application for: CASE NUMBER: 91-065 SPRO APPLICANT: HUGHES ENCINITAS LTD. LOCATION: ENCINITAS BLVD. AND EL CAMINO REAL (ENCINITAS VILLAGE PLAZA) DESCRIPTION: Comprehensive Sign Program for the Encinitas Village Plaza ENVIRONMENTAL STATUS: Exempt per Section 15311 lla of CEQA This approval is subject to the following findings pursuant to Chapter 23.08 and Section 30.60.10084 of the City of Encinitas Municipal Code and conditions: FINDINGS: A. The project design fails to assure that the size and shape of all signs are in scale with the building to which they are attached. Evidence: Since the wall signs are proposed to be limited to one square foot per linear foot of building where the main entrance is located, they are in scale with the existing structures. B. The building design does not provide for adequate space and locations on the building, in harmony with the architectural design, for the display of signs. Evidence: The building facias are large enough to accommodate the accompanying Multi-retail tenant space signing and would not conflict or compete with other Local Retail Tenant Signs. The specific facias are identified on the approved plans which would mmb/91-067wp 9/4/91 allow for the multi-retail signs. Adequate space is provided for the design, size, and style of the signs on the buildings. C. The project signing fails to relate well to the buildings of the project and to the neighborhood in general in terms of size, shape, color, texture, materials and lighting intensity, creating a visually incompatible appearance. Evidence: The colors, materials, locations, and lighting reflected in the attached sign program are compatible with the structures and in visual harmony with the entire center. D. The project signing does not show subtlety, is obtrusive or does not convey the message legibly and clearly. Evidence: The channel letters proposed for the wall signs will clearly convey the sign message. Additionally, the high quality of sign proposed for the pedestrian signs would clearly depict the sign message. E. The proposed signing is not weather resistant or durable. Evidence: The materials proposed are weather resistant and durable materials and the color and quality should be retained for several years. CONDITIONS: 1. The project is approved in accordance with the sign program revised and received by the City of Encinitas on June 6, 1991. The sign program is on file in the Department of Planning and Community Development and shall not be altered without review and approval. 2. Details for attachments of signs to the structures are required for building permit issuance in conformance with the Uniform Building Code and Uniform Electrical Code. 3. The applicant shall obtain the necessary permits or exemptions from the appropriate departments and agencies, including the State of California Coastal Commission if applicable. 4. Under the General Notes section of the sign program, the following is to be added: Item #5 - If the back doors are visible to the public from the street or parking area, the square footage is to be included in the overall square footage of the sign area. mmb/91-067wp 9/4/91 MMM/91-067wp 96/3/910 Item #8 - A permit from the City of Encinitas is required prior to affixing banner to the property. 5. This sign program is not to be modified/amended without modification/amendment receiving approval from the City of Encinitas pursuant to Chapter 30.60 of the Municipal Code. It should be noted that the City of Encinitas does not consider any reference made to landlord, tenants, prices, contractors, etc. in approval or denial decisions. All approval is based on design, size, materials and location per this sign program and the Municipal Code. Pursuant to Chapter 1.12 and Section 23.08.200 of the City of Encinitas Municipal Code, this decision of the Director may be appealed within fifteen calendar days of the date of this notice. This notice constitutes a decision by the Planning Department only. Building permits may also be required. This project is exempt from Environmental Review pursuant to Section 15311 of CEQA.
