1992-034CITY OF ENCINITAS COMMUNITY DEVELOPMENT DEPARTMENT 527 Encinitas Blvd. Encinitas, CA 92024 (619) 944-5060 NOTICE OF DECISION DCD-92-034 November 23, 1992 This letter is to inform you that the Director of Community Development has approved your application for: 92-194 ADP (DOW Stereo / Expressive Design)- Administrative Design Review to add approximately 260 Square Feet to an approved 1,194 Square Foot addition to an existing retail store for property located at 146 North El Camino Real (Wiegand Plaza I). This approval is subject to the following conditions: (1) The project shall conform to the conditions of approval required by Resolution No. NE-92-07 (Case #92-076 DR) as approved by the New Encinitas Community Advisory Board on June 1, 1992, except as may be modified herein. (2) The applicant shall pay development fees at the established rate. Such fees may include but shall not be limited to: Permit and Plan Checking Fees, School Impact Fees, Water and Sewer Service Fees, Traffic Impact Fees and Drainage Fees. Arrangements shall be made to the satisfaction of the appropriate department or agency to pay the fees prior to Building Permit issuance or Final Occupancy approval. (3) Prior to Building Permit issuance the applicant shall submit a letter from the Fire Protection District to the Community Development Department stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District. (4) Address number(s) shall be placed on the rear door of the structure. (5) ACCESS ROADWAY: of a fire access four (24) feet. and unloading a: structure. The clear and unobstructed paved width roadway shall not be less than twenty- In addition, twelve (12) feet of loading -ea shall be provided adjacent to the A:c.olson/92-194 (6) Approval of this request does not waive compliance with any section of the Zoning Development Code and all other applicable City Ordinances. (7) This approval may be appealed to the City Council within 15 calendar days from the date of this approval in accordance with the provisions of Chapter 1.12 of the Municipal Code. A $100.00 filing fee for Appeals is required. (8) In the event that one or more of the conditions imposed on this Administrative Design Review approval is/are not satisfied, the Community Development Department shall notify the applicant of the date an opportunity will be provided for the applicant to explain why the City of Encinitas should not revoke this approval. (9) Prior to any future development of the project site, all conditions of approval contained herein shall be completed (or agreed upon) to the satisfaction of the Director of Community Development. (10) The application request is approved as submitted and shall not be altered without authorized agency review and approval. (11) Any change to the natural drainage or concentration of drainage shall be adequately handled and shall not impact adjacent properties to the satisfaction of the City Engineer. (12) A Permit or Proof of Exemption from the California Coastal Commission shall be required prior to Building Permit issuance. This approval is based upon the following findings pursuant to Section 23.08.072 of the Municipal Code: 1) The project design is consistent with the General Plan, a Specific Plan and the provisions of the Municipal Code. Facts: The additional square footage (260) proposed by this application conforms with the allowable square footage permitted to be approved administratively. The project is located in the General Commercial Zoning District and the proposed use conforms to the type of allowed uses within the District. The project is not within a Specific Plan Overlay District. Discussion: Staff can not identify any aspect of the submitted project which does not comply with Zoning Code standards or General Plan Policies. A:c.olson/92-194 Conclusion: The Community Development Department finds, therefore, that the design of the project, as conditioned, conforms to the policies and standards of the General Plan, Zoning Ordinance and Municipal Code. 2) The project design is substantially consistent with the Design Review Guidelines. Facts: The project design provides an addition which conforms to the building designs and architectural accents of other structures within the existing commercial complex. Discussion: The project design is consistent with the intent of the Design Review Guidelines in that the building addition conforms with existing structures within the complex and otherwise conforms with code requirements. Conclusion: The Community Development Department finds that the project design is consistent with the intent of the Design Review Guidelines. 3) The project design will not adversely affect the health, safety, or general welfare of the community. Facts: The project design is consistent with existing structures within the existing commercial center. Discussion: Staff can find no evidence to indicate that the project design would adversely affect the health, safety, or general welfare of the community. Conclusion: The Community Development Department finds that the project design will not adversely affect the health, safety or general welfare of the New Encinitas Community. 4) The project will not tend to cause the surrounding neighborhood to depreciate materially in appearance or value. Facts: The project design tends to be compatible with the style of commercial structures constructed within the General Commercial District. Discussion: Staff can find no evidence to indicate that the project would materially depreciate the appearance or value of the District. Conclusion: The Community Development Department finds that the project will not adversely depreciate the appearance or value of the immediate Commercial District.
