Vulcan Ave. Encinitas, CA 92024 (619) 633-2710 NOTICE OF DECISION DCD-94-019 April 6, 1994 This letter is to inform you that the Director of Community Development has approved your application for: 94-034 BA (Greg Brown) - Boundary Adjustment among 4 residential parcels located at the easterly terminus of Dusty Trail (APN: 264-221-16 through 19). This approval is subject to the following findings, per Section 24.70.060 of the Municipal Code: 1. The proposed boundary adjustment will result in lots which meet or exceed zoning and development regulations, including access, dimensions, lot size, and parking and setbacks. The RR zoning district specifies a minimum lot size of 2 acres. The four subject lots each meet the minimum 2 acres net lot area. 2. The application does not propose alterations which would result in conditions which do not comply with building regulations. 3. The boundaries of the proposal do not extend beyond the City limit boundary. 4. The project does not require any substantial alteration of any existing improvement or create a need for any new improvement. 5. The adjustment does not adjust the boundary between lots which are subject to an agreement for public improvements. 6. The boundary adjustment is found to be exempt from Environmental Review pursuant to CEQA Section 15305(A). This approval is subject to the following conditions: 1. GENERAL CONDITIONS A. This approval will expire in two years, on April 6, 1996, at 5:00 p.m., permitting time to record Certificates of JK/94034DEC (4-6-94) Compliance, unless the conditions have been met or an extension has been approved by the Authorized Agency. B. Project is approved as submitted as evidenced by the adjustment plat dated received by the City of Encinitas on March 17, 1994. C. Nothing in this permit shall relieve the applicant from complying with the conditions and regulations generally imposed upon activities similar in nature to the activity authorized by this permit. D. Approval of this request shall not waive compliance with any sections of the Municipal Code and all other applicable City Ordinances in effect at the time of Building Permit issuance unless specifically waived herein. E. The owners shall cause to be recorded deeds and legal descriptions transferring the property as shown on the resubmittal plat (if in separate ownership). F. Completion of this lot line adjustment shall require the recordation of a Certificate of Compliance for each lot as adjusted. New legal descriptions reflecting the adjusted parcels shall be prepared to the satisfaction of the City Engineer. APPLICANT SHALL CONTACT THE ENCINITAS FIRE PROTECTION DISTRICT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 2. FIRE A. Fire apparatus access roadways shall have an unobstructed paved width of not less than 24 feet and an unobstructed vertical clearance of not less than 13 feet, 6 inches. Access to one single family residence shall not be less than 16 feet in paved width. EXCEPTION: With an automatic fire sprinkler system installed, a fire access roadway providing access to not more than three single-family dwellings shall not be less than 16 ft. in paved width with an unobstructed vertical clearance on not less than 13 ft. 6 inches. B. All dead-end fire access roadways in excess of 150 ft. in length or serving four or more dwelling units shall be provided with a cul-de-sac. The cul-de-sac radius for public streets shall comply with City road standards. Streets constructed to private road standards where a turnaround is required shall have a cul-de-sac with a paved radius of not less than 36 ft. Alternate types of turnarounds may be considered by the Chief as needed to accomplish the purpose of this code. JK/94034DEC (4-6-94) C. Prior to the delivery of combustible materials to the project site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide a permanent all-weather surface for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire District. D. Address numbers shall be clearly visible from the street fronting the structure. The height of the numbers shall conform to Fire District Standards. Where structures are located off a roadway on long driveways, a monument marker shall be placed at the entrance where the driveway intersects the main roadway. Address numbers shall be affixed to this marker. E. Structures shall be protected by a fire sprinkler system installed to the satisfaction of*the Fire District. F. Prior to the granting of final recordation or development approval, the applicant shall submit a letter from the Fire District stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District. G. Smoke detectors shall be installed in any future structures and inspected by the Fire Department. In accordance with the provisions of the Municipal Code, this decision may be appealed to the City Council within ten (10) calendar days of the date of this determination. This notice constitutes a decision of the Community Development Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the property owner's responsibility to obtain all necessary permits required for the type of project proposed.
