Vulcan Avenue - Encinitas, CA 92024 (619) 633-2710 NOTICE OF DECISION DCD-95-79 January 22, 1996 This letter is to inform you that the Director of Community Development has approved your application for: 95-296CDP (San Elijo Joint Power Authority) - Coastal Development Permit for the construction of tertiary treatment facilities at the San Elijo Water Pollution Control Facility (SEWPCF) for the property located at 2695 Manchester Avenue (APN 261-010-13). Project Description and Discussion: SEWPCF proposes the construction of tertiary treatment facilities to produce 2.48 mgd of Title 22 reclaimed water. The new elements will include filter feed facilities, rapid-mix and flocculation facilities, filtration facilities, disinfection facilities, reclaimed water pumping facilities, feed facilities, chemical storage and storage building. This approval is based upon the following findings: The project is consistent with the certified Local Coastal Program of the City of Encinitas; and 2. The proposed development conforms with Public Resources Code 21000 and following in that there are no feasible mitigation measures or feasible alternatives available which would substantially lessen any significant adverse impact that the activity may have on the environment. The subject zoning is Public/Semi-Public, which permits a sewage treatment plant and conforms with all development standards as set forth in the Municipal Code. All aspects of the project which could have an adverse impact on coastal or any natural resources have been identified and mitigated pursuant to the final environmental impact report dated March 1993, State Clearing House #920910009. The Community Development Department finds that the project is consistent with the certified Local Coastal Program of the City of Encinitas. pa/f:admin/95296CDP.DEC (1-22-96) 1 Environmental Review: Environmental review for this project was conducted in the final environmental impact report dated March 1993, State Clearing House #920910009. All impacts and mitigation measures were reviewed in accordance with the California Environmental Quality Act (CEQA). This approval is subject to the following conditions: 1. This Coastal Development approval shall expire January 22, 1998, two years from the date of this approval, unless development, as approved herein, is initiated in reliance on this approval. 2. The approved project shall conform to the application 95-296 CDP submitted to the City and dated received on October 17, 1995, and shall not be modified without prior city approval. 3. Provide placards on all hazardous material tanks, buildings, enclosures, etc. per National Fire Protection Association (NFPA) standard 704. Place said placards on all sides. In accordance with the provisions of Municipal Code Chapter 1. 12, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of this determination. The appeal must be filed, accompanied by a $100.00 filing fee, prior to 4:00 pm on the 15th calendar day following the date of this notice of decision. This notice constitutes a decision of the Community Development Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the property owner or applicant's responsibility to obtain all necessary permits required for the type of project proposed. This action of the Community Development Director is not appealable to the Coastal Commission.
