Vulcan Avenue Encinitas, CA 92024 (619) 633-2710 NOTICE OF DECISION DCD-96-83 November 1, 1996 This letter is to inform you that the Director of Community Development has approved your application for: 96-191 CDP (Berend) - Coastal Development Permit to allow the construction of a new single family dwelling on a vacant lot for the property located at 1242 Hermes Ave. (APN 254-253- 46). Project Description and Discussion: The applicant proposes to locate a manufactured single family dwelling of approximately 1424 sq. ft., an attached accessory unit of approximately 424 sq. ft., and a two car attached garage of approximately 400 sq. ft. The subject site is relatively flat with an existing shed that is proposed to be removed. The subject property is located within the R-8 district of the Zoning Map. The proposed structure meets zoning and development standards and will be required to comply with applicable building codes. The applicant is proposing the third parking space required for the accessory unit in the interior side yard setback. Pursuant to the City of Encinitas Offstreet Parking Design Manual, parking is permitted in an interior side yard setback when separated from adjacent property by a 6' high solid fence or wall. This approval is based upon the following findings: The project is consistent with the certified Local Coastal Program of the City of Encinitas; and 2. A coastal development permit application for the project has been acted upon by the Community Development Director. This decision is appealable to the City of Encinitas, in accordance with the provisions of the Municipal Code, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of the determination. This notice is dated November 1, 1996. f:dcd/96191cdp.doc 1 Conclusion: The site is designated as Residential 5.01 - 8.0 du/ac on the Land Use Designation map of the General Plan and is zoned R-8 on the Zoning Map. The proposed project is in conformance with the development standards (density, lot coverage, height, setbacks, FAR, etc.) of the R-8 zone found in Chapter 30.16 of the Municipal Code. Accessory units are permitted by right pursuant to Municipal Code Section 30.48.040 (V), Accessory Units. The proposed accessory unit conforms with all development standards in terms of size, location, design, setbacks and parking requirements. No aspect of the project has been identified which could have an adverse impact on coastal or any natural resources. The approval of this Coastal Development Permit satisfies the requirements of the Encinitas Local Coastal Program. The Community Development Department finds that the project is consistent with the certified Local Coastal Program of the City of Encinitas and that required finding #2 is not applicable since no significant adverse impact is associated with the project. Environmental Review: The project is found to be exempt from Environmental Review, as per CEQA Guidelines Section 15303(a). This approval is subject to the following conditions: 1. This Coastal Development approval shall expire November 1, 1998, two years from the date of this approval, unless development, as approved herein, is initiated in reliance on this approval. 2. The approved project shall conform to the application and plans submitted to the City and dated received on October 10, 1996, and shall not be modified without prior city approval. 3. The proposed structure is subject to the height limitations pursuant to Municipal Code Section 30.16.010B (7) for residential structures. 4. Applicant shall construct a 6' high solid fence or wall to screen the parking space located in the interior side yard setback from the adjacent property, or relocate the parking space out of the interior side yard setback area. f:pa/dcd/96191CDP.DEC (10-30-96) 2 APPLICANT SHALL CONTACT THE ENCINITAS FIRE DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 5. Prior to building permit issuance, the applicant shall pay all development impact, plan check and/or cost recovery fees to the satisfaction of the Fire Department. 6. Address numbers shall be placed in a location that will allow them to be clearly visible from the street fronting the structure. The height of the numbers shall conform to Fire Department Standards. APPLICANT SHALL CONTACT THE ENCINITAS BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION: 7. The applicant shall submit a complete set of construction plans to the Building Division for review. As applicable, the submittal shall include structural calculations and details, complete framing plans and details, a site plan and floor plan, State Energy compliance documentation and a Soils report which includes recommendations for the design of the foundation. Submitted plans will be reviewed for compliance with State Title 24, the 1991 Editions of the Uniform Building Code, the Uniform Mechanical Code, the Uniform Plumbing Code and the 1990 Edition of the National Electrical Code. Please note that project review comments are not intended to be a comprehensive plan review of applicable Building Codes and additional comments will be made after plans have been submitted to the Building Division for plancheck. In accordance with the provisions of the Municipal Code, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of this determination. This notice constitutes a decision of the Community Development Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the applicant's responsibility to obtain all necessary permits required for the type of project proposed. The action of the Community Development Department in reference is not appealable to the Coastal Commission.
