Vulcan Avenue Encinitas, CA 92024 (619) 633-2710 NOTICE OF DECISION DCD-96-72 October 9, 1996 This letter is to inform you that the Director of Community Development has approved your application for: 96-174 CDP (Rotsheck) - Coastal Development Permit to allow a new single family dwelling for property located 124 E. Jason St. (APN 254-254-46). Project Description and Discussion: The applicant proposes to construct a new single family dwelling, as per the subject R-11 zoning district. The dwelling will comply with all applicable development standards. The subject dwelling will be required to comply with applicable building codes through the standard plan- checking process. A publicly noticed comment review period was established, with no comments being received. This approval is based upon the following findings: 1. The project is consistent with the certified Local Coastal Program of the City of Encinitas; and 2. The proposed development conforms with Public Resources Code 21000 and following in that there are no feasible mitigation measures or feasible alternatives available which would substantially lessen any significant adverse impact that the activity may have on the environment. Conclusion: The City's General Plan and Municipal Code are applicable components of the City's Local Coastal Plan. The subject zoning is R-11, which permits the proposed single family dwelling unit. No aspect of the project has been identified which could have an adverse impact on coastal resources or any natural resources. The project will comply with the applicable development standards as per the Encinitas Municipal Code. Since the project complies with all applicable provisions of the City's Municipal Code, the Community Development Department finds that the project is consistent with the certified Local Coastal Program of the City of Encinitas and that required finding #2 is not applicable since no significant adverse impact is associated with the project. The approval of this Coastal Development Permit satisfies the requirements of the Encinitas Local Coastal Program. Environmental Review: The project is found to be exempt from Environmental Review, as per CEQA Guidelines Section 15303(a). This approval is subject to the following conditions: 1. This Coastal Development approval shall expire on October 9, 1998, two years from the date of this approval, unless development, as approved herein, is initiated in reliance on this approval. 2. The approved project shall substantially conform to the application and plans submitted to the City and dated received on September 24, 1996, and shall not be modified without prior city approval. APPLICANT SHALL CONTACT THE FIRE DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: FIRE 3. Address numbers shall be placed in a location that will allow them to be clearly visible from the street fronting the structure. The height of the numbers shall conform to Fire Department Standards. 4. The applicant shall submit a complete set of construction plans to the Fire Department for review. 5. Prior to building permit issuance, the applicant shall pay all development impact, plan check and/or cost recovery fees to the satisfaction of the Encinitas Fire Department. APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: BUILDING 6. The applicant shall submit a complete set of construction plans to the Building Division for review. The submittal shall include structural calculations and details, complete framing plans and details, a site plan and floor plan, State Energy compliance documentation and a Soils Report which includes recommendations for the design of the foundation. Submitted plans will be reviewed for JK/f/96174CDP.DEC (10-9-96) 2 compliance with State Title 24, the latest adopted editions of the Uniform Building Code, the Uniform Mechanical Code, the Uniform Plumbing Code and the National Electrical Code. Please note that project review comments are not intended to be a comprehensive plan review of applicable Building Codes and additional comments will be made after plans have been submitted to the Building Division for plan check. In accordance with the provisions of the Municipal Code, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of this determination. This decision is not appealable to the Coastal Commission. This notice constitutes a decision of the Community Development Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the applicant's responsibility to obtain all necessary permits required for the type of project proposed. The action of the Community Development Director in reference to the above item is not appealable to the Coastal Commission.
