NOTICE OF DECISION
DCD-97-44

This letter is to inform you that the Director of Community Development has approved your
application for the following Discretionary Permit for property located in the City of Encinitas:
97-097 ADR (Castillero) - Administrative Design Review application to allow a proposed single
family dwelling to exceed the standard height envelope for property located 3346 Lilac Summit
(APN: 264-091-26).
Project Description and Discussion: Pursuant to Municipal Code Section 30.16.010.B.7.d, the
applicant proposes to exceed the 26-foot height standard, to an approximate height of 29 ft. 6 in. for
the primary roof ridge, and 30 feet for a chimney, for a new single family dwelling proposed within
the RR Zoning designation.
Staff conducted site / field analyses and concluded that no significant neighborhood view impacts
would result from the project. The building will not be out of scale with other properties in the
vicinity, and the portion of the project outside of the standard height envelope will not result in the
blockage of any significant views
A standard public notification was issued for the project, with no comments having been received.
Municipal Code Section 30.16.010.B.7.dpermits residential structures to exceed the 26-foot height
standard to a maximum of 30 feet provided the following findings can be made:
Design Review to Exceed the Standard Height Envelope
1. The portion of the building outside of the standard height envelope maintains some of the
significant views enjoyed by residents of nearby properties.
2. The building is compatible in bulk and mass with buildings on neighboring properties.
Conclusion: Staff conducted a site analysis and concluded that no significant view impacts would
result from the project. The primary roof ridge of the proposed dwelling will exceed the standard
height envelope by approximately 3.5 ft., which will not constitute a significant impact to
neighboring views. The home-sites in the subject area are sufficiently separated both horizontally

and vertically such that any view related impacts from the portion of structure exceeding the 26 ft.
envelope are minimal.
The building will not be out of scale with existing residences in the vicinity given that the home is
found to be consistent with the surrounding pattern of residential development in the area.
California Environmental Quality Act: The project is found to be exempt from Environmental
Review pursuant to California Environmental Quality Act (CEQA) Guideline Section 15303(a).
This approval is subject to the following conditions:
1. This Administrative Design Review approval shall expire on June 11, 1999, two years from
the date of this approval, unless development, as approved herein, is initiated in reliance on
this approval, or an extension of time has been granted pursuant to Municipal Code
provisions.
2. Project is conditionally approved as submitted as evidenced by the application and project
plans dated received by the City of Encinitas on May 14, 1997, consisting of 5 sheets total,
and signed by a City Official as approved by the Community Development Department on
June 11, 1997, and shall not be altered without Community Development Department
review and approval.
3. Prior to final framing inspection of the subject dwelling, the licensed surveyor or civil
engineer shall submit a letter to the Building Department documenting that the structure
complies with this approval and with any other applicable Municipal Code requirements.
4. Building height will be measured from the pad elevation as established by the subdivision
map.
APPLICANT SHALL CONTACT THE FIRE DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
5. Submit to the Community Development Department a letter from the Fire Department
stating that required fire/fuel breaks have been provided to the satisfaction of the
Department.
6. Address numbers shall be placed in a location that will allow them to be clearly visible from
the street fronting the structure. The height of the numbers shall conform to Fire
Department standards.
7. Structures shall be protected by an automatic fire sprinkler system installed to the
satisfaction of the Fire Department.

8. Prior to building permit issuance, the applicant shall pay all development impact, plan
check and/or cost recovery fees to the satisfaction of the Encinitas Fire Department.
APPLICANT SHALL CONTACT THE BUILDING DIVISION REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION:
9. The applicant shall submit a complete set of construction plans to the Building Division
for plancheck processing. The submittal shall include a Soils/Geotechnical Report,
Structural calculations, and State Energy compliance documentation (Title 24).
Construction plans shall include a site plan, a foundation plan, a floor framing plan, a
floor plan, section details, exterior elevations, and materials specifications. Submitted
plans must show compliance with the latest adopted editions of the California Building
Code (The Uniform Building Code with California Amendments, the California
Mechanical, Electrical and Plumbing Code). Commercial and multi-residential
construction must also contain details and notes to show compliance with State disabled
accessibility mandates. These comments are preliminary only. A comprehensive
plancheck will be completed prior to permit issuance and additional technical code
requirements may be identified and changes to the originally submitted plans may be
required.
In accordance with the provisions of Municipal Code Chapter 1. 12, this decision may be appealed
to the City Council within fifteen (15) calendar days of the date of this determination. The appeal
must be filed, accompanied by a $100.00 filing fee, prior to 4:00 pm on the 15th calendar day
following the date of this notice of decision. This notice constitutes a decision of the Community
Development Department only. Additional permits, including Building Permits, may be required
by the Building Department or other City Departments. It is the property owner or applicant's
responsibility to obtain all necessary permits required for the type of project proposed.
