1998-082CITY OF ENCINITAS COMMUNITY DEVELOPMENT DEPARTMENT 505 So. Vulcan Avenue Encinitas, CA 92024 (760) 633-2710 NOTICE OF DECISION DCD-98-82 August 5, 1998 This letter is to inform you that the Director of Community Development has approved your application for: 98-167 CDP (Goldstein) - Coastal Development Permit to allow for the construction of a single- family dwelling at 391 North Vulcan Avenue in the NR-8 zone (APN: 256-300-22). Project Description and Discussion: The applicant proposes to construct a one-story, single-family dwelling on an existing legal lot within the NR-8 zoning district. The NR-8 zone of the North 101 Corridor Specific Plan allows for the construction of single-family homes on legal lots of record. This lot was created with the recordation of Parcel Map No. 18050, recorded on June 17, 1998, in the offices of the San Diego County Recorder. The site is relatively flat with a average lot slope well below 10%- grade. Access to the home is proposed from a 16'-wide driveway easement off North Vulcan Avenue. The proposed dwelling will comply with all applicable residential development standards (setbacks, FAR, lot coverage, height etc.). The subject dwelling will be required to comply with applicable building codes through the standard plan-checking process. A publicly noticed comment review period was established and no comments or letters of concern were received. This approval is based upon the following findings: The project is consistent with the certified Local Coastal Program of the City of Encinitas; and 2. The proposed development conforms with Public Resources Code 21000 and following in that there are no feasible mitigation measures or feasible alternatives available which would substantially lessen any significant adverse impact that the activity may have on the environment. Conclusion: The City's General Plan and Municipal Code are applicable components of the City's Local Coastal Plan. The subject zoning is NR-8, which permits proposed single-family dwelling cm/f./98167cdp.dcd units in both the Municipal Code and General Plan. No aspect of the project has been identified which could have an adverse impact on coastal resources or any natural resources. The project will comply with the applicable development standards (lot coverage, setbacks, floor area ratio, etc.) as per the Encinitas Municipal Code. Since the project complies with all applicable provisions of the City's Municipal Code, the Community Development Department finds that the project is consistent with the certified Local Coastal Program of the City of Encinitas, and that required finding #2 is not applicable since no significant adverse environmental impact is associated with the project. The approval of this Coastal Development Permit satisfies the requirements of the Encinitas Local Coastal Program.
