NOTICE OF DECISION
DCD-98-34

This letter is to inform you that the Director of Community Development has approved your
application for:
98-065 EXT (Sinclair) - Time extension for a previously approved Design Review
permit for a medical office building (95-178DR/CDP/EIA) (APN: 260-340-01).
The Encinitas City Council approved the subject application on March 27, 1996, after
appeal from a Planning Commission approval. The approval, granted on March 27,
1996, was set to expire on March 27, 1998. The time extension application was
submitted in a timely manner on March 24, 1998. This approval extends the valid
period two additional years to March 27, 2000, as per Municipal Code Section
23.08.160-B.
All requirements and conditions contained in Resolution No. 96-22 remain in full force
and effect.
Findings
Time Extension, Design Review - This approval is based upon the following findings as
per Municipal Code Section 23.08.160-B
The Director may, upon written request by the proponent, grant reasonable extensions
of up to a total of two (2) years for the Design Review Permit, provided no change in
City policies has occurred which would be in conflict with the project.
Conclusion: No changes in City policies which would have a bearing on this project
have occurred, and no need to add conditions has been found by the City.

This approval is subject to the following conditions:
G1 STANDARD CONDITIONS:
CONTACT THE COMMUNITY DEVELOPMENT DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION:
G2 This approval may be appealed to the City Council within 15 calendar days from the
date of this approval in accordance with Chapter 1.12 of the Municipal Code.
SCI SPECIFIC CONDITIONS:
SC2 This approval will expire on March 27, 2000, at 5:00 pm, two years after the approval
of this project.
SC5 This project is conditionally approved as set forth on the application dated received by
the City on March 24, 1998, designated as approved by the Community Development
Department on May 14, 1998, and shall not be altered without express authorization by
the Community Development Department.
SCA This approval extends the valid period for subject case 95-178DR/CDP/EIA, for two
years to March 27, 2000, at 5:00 p.m.
SCB All conditions as specified in Resolution No. 96-22 shall remain in full force and
effect.
In accordance with the provisions of the Municipal Code, this decision may be appealed to the
City Council within fifteen (15) calendar days of the date of this determination. This notice
constitutes a decision of the Community Development Department only. Additional permits,
including Building Permits, may be required by the Building Department or other City
Departments. It is the property owner's responsibility to obtain all necessary permits required
for the type of project proposed.
