Vulcan Avenue Encinitas, CA 92024 (760) 633-2710 NOTICE OF DECISION DCD-98-05 February 12, 1998 This letter is to inform you that the Director of Community Development has approved your application for: 97-293 CDP (Mark Goethals) - Coastal Development Permit to allow for the construction of a single-family dwelling on the property known as 816 Clark Avenue (APN 256-122-26). Project Description and Discussion: The applicant proposes to construct a two-story, single-family dwelling onto an existing vacant lot within the R-5 zoning district. The vacant lot is relatively flat and is surrounded by existing single-family residences. The proposed dwelling will comply with all applicable residential development standards. The subject dwelling will be required to comply with applicable building codes through the standard plan-checking process. A publicly noticed comment review period was established and no comments or letters of concern were received. This approval is based upon the following findings: 1. The project is consistent with the certified Local Coastal Program of the City of Encinitas; and 2. The proposed development conforms with Public Resources Code 21000 and following in that there are no feasible mitigation measures or feasible alternatives available which would substantially lessen any significant adverse impact that the activity may have on the environment. Conclusion: The City's General Plan and Municipal Code are applicable components of the City's Local Coastal Plan. The subject zoning is R-5, which permits the proposed single-family dwelling unit. No aspect of the project has been identified which could have an adverse impact on coastal resources or any natural resources. The project will comply with the applicable development standards (lot coverage, setbacks, floor area ratio, etc.) as per the Encinitas Municipal Code. Since the project complies with all applicable provisions of the City's Municipal Code, the Community Development Department finds that the project is consistent with the certified Local Coastal Program cm/f./97293cdp.dcd of the City of Encinitas and that required finding #2 is not applicable since no significant adverse environmental impact is associated with the project. The approval of this Coastal Development Permit satisfies the requirements of the Encinitas Local Coastal Program. Environmental Review: The project is found to be exempt from Environmental Review, as per CEQA Guidelines Section 15303(a). This approval is subject to the following conditions: SCI SPECIFIC CONDITIONS: SC2 This approval will expire on February 12, 2000, at 5:00 p.m., two years after the approval of this project, unless the conditions have been met or an extension of time has been approved pursuant to the Municipal Code. SC6 This project is conditionally approved as set forth on the application and project plans dated received by the City on December 31, 1997, consisting of 3 sheets including Site Plan, Floor Plans and Exterior Elevations, all designated as approved by the Community Development Director on February 12, 1998, and shall not be altered without express authorization by the Community Development Department. SCA Water District meters to parcels "A" and "B" will be installed within the Right-of-Way of Clark Avenue. The meter to parcel "B" needs to be installed next to the roadway/utility easement, outside the driveway. Building plans should be modified to reflect this condition. Contact the San Dieguito Water District regarding this condition. G1 STANDARD CONDITIONS: CONTACT THE COMMUNITY DEVELOPMENT DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): G2 This approval may be appealed to the City Council within 15 calendar days from the date of this approval in accordance with Chapter 1.12 of the Municipal Code. G13 The applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Permit and Plan Checking Fees, Water and Sewer Service Fees, School Fees, Traffic Mitigation Fees, Flood Control Mitigation Fees, Park Mitigation Fees, and Fire Mitigation/Cost Recovery Fees. Arrangements to pay these fees shall be made prior to building permit issuance to the satisfaction of the Community cm/f./97293cdp.dcd Development and Engineering Services Departments. The applicant is advised to contact the Community Development Department regarding Park Mitigation Fees, the Engineering Services Department regarding Flood Control and Traffic Fees, applicable School District(s) regarding School Fees, the Fire Department regarding Fire Mitigation/Cost Recovery Fees, and the applicable Utility Departments or Districts regarding Water and/or Sewer Fees. B 1 Building Condition(s): CONTACT THE ENCINITAS BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): B2 The applicant shall submit a complete set of construction plans to the Building Division for plancheck processing. The submittal shall include a Soils/Geotechnical Report, structural calculations, and State Energy compliance documentation (Title 24). Construction plans shall include a site plan, a foundation plan, floor and roof framing plans, a floor plan, section details, exterior elevations, and materials specifications. Submitted plans must show compliance with the latest adopted editions of the California Building Code (The Uniform Building Code with California Amendments, the California Mechanical, Electrical and Plumbing Codes). Commercial and Multi- residential construction must also contain details and notes to show compliance with State disabled accessibility mandates. These comments are preliminary only. A comprehensive plancheck will be completed prior to permit issuance and additional technical code requirements may be identified and changes to the originally submitted plans may be required. F 1 FIRE CONDITIONS: CONTACT THE ENCINITAS FIRE DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): F2 ACCESS ROADWAY DIMENSIONS: Fire apparatus access roadways shall have an unobstructed paved width of not less than 24 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. EXCEPTION: Access to one (1) single family residence shall not be less than 16 feet of paved width. F3 ACCESS ROADWAY WHEN AUTOMATIC FIRE SPRINKLER SYSTEMS INSTALLED: A fire access roadway providing access to not more than four (4) single family dwellings shall not be less than 16 feet in paved width with an unobstructed vertical clearance of not less than 13 feet 6 inches. cm/f./97293cdp.dcd F13 ADDRESS NUMBERS: Address numbers shall be placed in a location that will allow them to be clearly visible from the street fronting the structure. The height of the address numbers shall conform to Fire Department Standards. F14 ADDRESS NUMBERS FOR STRUCTURES LOCATED OFF ROADWAY: Where structures are located off a roadway on long driveways, a monument marker shall be placed at the entrance where the driveway intersects the main roadway. Permanent address numbers with height conforming to Fire Department standards shall be affixed to this marker. In accordance with the provisions of the Municipal Code, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of this determination. This decision is not appealable to the Coastal Commission. This notice constitutes a decision of the Community Development Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the applicant's responsibility to obtain all necessary permits required for the type of project proposed.
