NOTICE OF DECISION

This letter is to inform you that the Director of Community Development has approved your
application for:
99-077 EXT (Dierkes): Time Extension for a previously approved variance and
boundary adjustment for the property known as 806 Hermes Avenue (APN: 256-040-35).
Project Description and Discussion: The Planning Commission approved Case No. 97-002
VBA on March 27, 1997, for a lot line adjustment and variance to allow the existing single-
family residence to encroach a maximum of 17 feet into the 25 foot required rear yard setback of
one of the resulting lots (ResolutionNo. PC-97-20). The initial approval was valid for two years,
having an expiration date of March 27, 1999. This time extension application was submitted in a
timely manner on March 16, 1999. This Decision extends the subject approval to March 27,
2000.
This determinationof approval is based upon the following findings:
Lot Line Adjustment - Municipal Code Section 24.70.100; Variance - Municipal Code
Section 30.78.070
An application for an Extension of Time shall be approved unless findings of fact are made based
upon the information presented in the application. The Director shall consider the current
circumstances of the site, the site and surrounding area.
1. The lot line adjustment/variance for which an extension is granted and conditions of
approval shall remain substantially unchanged from the original approval. No need to alter
conditions, attach additional development fees, or alter design are required or proposed for the
subject project. No change in City policies has occurred that would be in conflict with the project
as approved per Resolution No. PC-97-20.

A standard public notification was required as part of this application. No adverse comments or
concerns were received from the neighborhood or general public.
This approval is subject to the following conditions:
SC1 SPECIFIC CONDITIONS:
SC2 This approval will expire on March 27, 2000, at 5:00 PM, one year after the approval of
this project, unless the conditions have been met or an additional extension of time has
been approved pursuant to the Municipal Code.
SC6 This project is conditionally approved as set forth on the application and project plans
dated received by the City on March 14, 1997, consisting of 5 sheets designated as
approved by the Planning Commission on March 27, 1997, and shall not be altered
without express authorization by the Community Development Department.
SCA All conditions as specified in ResolutionNo. PC-97-20 remain in force.
In accordance with the provisions of the Municipal Code, this decision may be appealed to the
City Council within ten (10) calendar days of the date of this determination. This notice
constitutes a decision of the Community Development Department only. Additional permits,
including Building Permits, may be required by the Building Department or other City
Departments. It is the property owner or applicant's responsibility to obtain all necessary permits
required for the type of project proposed.
