RESOLUTION 2009-06
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS
MAKING THE REQUIRED CEQA FINDINGS, CERTIFYING THE FINAL
ENVIRONMENTAL IMPACT REPORT, AND ADOPTING THE MITIGATION
MONITORING AND REPORTING PROGRAM, FOR THE PROPOSED FRITZ
'T'ENTATIVE MAPS AT 645 SAXONY ROAD
(CASK NOS. 06-111 TM/DR/CDP/EIR, APN: 254-351-32 &
06-112 TM/DR/DR/CDP/EH2, APN: 254-351-30 & -31)
WHEREAS, a Final Environmental Impact Report (EIR) was prepared for the Fritz
Tentative Map projects (Case Nos. 06-0111 TM/DR/CDP/EIR & 06-112 TM/DR/CDP/EIR)
pursuant to the California Environmental Quality Act (CEQA); and
WHEREAS. a Notice of Preparation (NOP) was prepared and circulated for public and
agency comments for 30 days commencing November 17, 2008 and ending on December 18,
2006; and
WHEREAS- a 45-day public anti agency review and comment period of the completed
Draft EIR was conducted from Apri14, 2008 to May 19, 2008; and
WHEREAS, the City Council of the City of Encinitas has reviewed and considered the
information in the Final EIR.
NOW THEREFORE, BE IT RESOLVED that the attached Findings reflect the City
Council's independent judgment and analysis as the Lead Agency and that they have been
completed in compliance with CEQA as presented in this resolution as follows:

BE IT FURTHER RESOLVED that the City Council hereby certifies the Final EIR and
adopts the Mitigation Monitoring and Reporting Program presented as follows:
