Vulcan Ave. Encinitas, CA 92024 (760) 633-2710 NOTICE OF DECISION PBD 2004-69 June 23, 2004 This letter is to inform you that the Planning and Building Director has approved your application for: 04-096 SIGN (Taylor Woodrow) - Sign Review an~ Coastal Development Permit application to construct an 8-foot high temporary freestanding identification sign for the Beach Street Subdivision. The project site is located in the R-8 (Residential 8) zoning district. (APN: 258-112-14) Project Description and Discussion: The Taylor Woodrow Home Inc. proposes to install a new temporary identification sign approximately eight (8) feet in height. The governing regulations for the proposed sign are Municipal Code Chapter 23 (Design Review), Chapter 30.60 (Sign) and Chapter 30.80 (Coastal Development Permit). According to Section 30.60.080H of the Municipal Code, one identification sign shall be permitted up to a maximum of 32 square feet identifying a residential development of 5 or more units. Said signs shall have a maxi~um height of eight (8) feet. The proposed sign will have a maximum height of 8 feet, located adjacent to Requeza Street, and will incorporate a simple, attractive pictorial sign copy. The sign construction will be of a double-faced wooden sign. The actual sign copies will measure approximately 4 feet high by 8 feet wide and will be secured to two (4" x 4") white painted posts. The proposed sign will not be illuminated. As a condition of approval, the sign shall be removed after six (6) months from the date of approval or the completion of the sales of the last unit of the development, whichever comes first. The Planning Department may grant a time extension provided that the applicant provides sufficient evidence supporting the need for the extension. A standard public notice was mailed on May 26, 2004, which allowed for a 10-calendar day review period. Staff received two phone calls from adjacent property owners regarding the location and the colors and materials of the monument sign. This approval is based upon the following fmdings: RS/CD/g:/NOD/04-096signcdp -1 - FINDINGS FOR DESIGN REVIEW - SIGNS 1. The project design assures that the size and shape of the sign is in scale with the building with which it is associated. Discussion: The overall sign structure of 8 feet in height, with a roughly 4' x 8' sign copy, will not be out of scale with the associated residential development. Conclusion: The size and shape of the proposed sign is in scale with the residential development with which it is associated. 2. The building site provides for adequate space and locations on the building, in harmony with the architectural design, for the display of signs. Discussion: The proposed temporary identification sign is appropriately located adjacent to Requeza Street, out of vehicular and pedestrian traffic areas, while being visible from the adjacent street. The sign is not out of scale with the site, and will occupy a place which lends itself well to the placement of the proposed freestanding sign. Conclusion: The building site provides adequate space and location, in harmony with the architectural design, for the proposed sign. 3. The project sign relates well to the bUilding on the project site and to the neighborhood in general in terms of size, shape, color, texture, materials and lighting intensity, creating a visually compatible appearance. Discussion: The sign copy of approximately 4 feet high and 8 feet wide, coordinates well with the site, utilizing three complementary colors that are visually compatible and blend well with the site. The sign construction will be of double-faced wooden sign mounted on two white-painted posts. The sign will not be illuminated. Conclusion: The project sign relates well to the building on the project site and to the neighborhood in general in terms of size, shape, color, texture, and materials, creating a visually compatible appearance. 4. The project signing shows subtlety, is unobtrusive and conveys the message legibly and clearly. Discussion: The proposed sign uses a minimum of colors, is well coordinated to the site with which it is associated, and is easily read. Conclusion: The proposed sign shows subtlety, is unobtrusive and conveys the message legibly and clearly. 5. The proposed signing is weather resistant and durable. Discussion: The proposed sign is constructed of sturdy, weather resistant wood. Conclusion: The proposed sign is weather resistant and durable. RS/CD/g:/NOD/04-096signcdp -2- FINDINGS FOR A COASTAL DEVELOPMENT PERMIT STANDARD: Section 30.80.090 of the Municipal Code provides that the authorized agency must make the following findings of fact, based upon the information presented in the application, in order to approve a Coastal Development Permit: 1. The project is consistent with the certified Local Coastal Program of the City ofEncinitas; 2. The proposed development conforms with Public Resources Code Section 21000 and following (CEQA) in that there are no feasible mitigation measures or feasible alternatives available which would substantially lessen any significant adverse impact that the activity may have on the environment; and 3. For projects involving development between the sea or other body of water and the nearest public road, approval shall include a specific fmding that such development is in conformity with the public access and public recreation policies of Section 30200 et. seq. of the Coastal Act. Facts: The City's General Plan and Municipal Code are applicable components of the City's Local Coastal Plan. The project consists of a temporary 8-foot high freestanding identification sign that is consistent with all applicable provisions of the General Plan and Municipal Code. Conclusion: Since the project complies with all applicable provisions of the City's General Plan and Municipal Code, the Planning and Building Department fmds that the project is consistent with the certified Local Coastal Program of the City of Encinitas. Required finding #2 is not applicable since no significant adverse impact is associated with the project. Finding #3 is not applicable since the project does not involve development between the sea or other body of water and the nearest public road and therefore does not impact - public access to coastal resources. The approval of this Coastal Development Permit satisfies the requirements of the Encinitas Local Coastal Program. Environmental Review: The project is found to be exempt from Environmental Review pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15311(a). This approval is subject to the following conditions: SC1 SPECIFIC CONDITIONS: SC2 This approval will expire on June 23, 2006, at 5:00 p.m., two years after the approval of this project, unless the conditions have been met or an extension of time has been approved pursuant to the Municipal Code. SC6 This project is conditionally approved as set forth on the application and project plans dated received by the City on May 20, 2004, consisting of two (2) sheets including Site Plan and Sign Elevation and Detail, all designated as approved by the Planning and Building Director RS/CD/g:/NOD/04-096signcdp -3- on June 23, 2004, and shall not be altered without express authorization by the Planning and Building Department. SCA The proposed monument/identification sign shall be removed after six (6) months from the date of approval or after the closing of escrow of the last residential. dwelling unit of the development, whichever comes first. The Planning Department may grant a time extension provided that the applicant provides sufficient evidence indicating the need for the extension. No encroachment into the public right-of-way is allowed. SCB The location of the monument sign shall be field verified by the Engineering Department to avoid sight visibility impact prior to building permit fmal inspection. Gl STANDARD CONDITIONS: CONTACT THE PLANNING AND BillLDING DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): G2 This approval may be appealed to the City Council within 15 calendar days from the date of this approval in accordance with Chapter 1.12 of the Municipal Code. G5 Approval of this request shall not waive compliance with any sections of the Municipal Code and all other applicable City regulations in effect at the time of Building Permit issuance unless specifically waived herein. Bl BUILDING CONDITION(S): CONTACT THE ENCINITAS BUILDING DIVISION REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): BA The owner/applicant shall submit structural plans to the Building Division for. plan review. Fl FIRE CONDITIONS: CONTACT THE ENCINITAS FIRE DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITION(S): F13 ADDRESS NUMBERS: Address numbers shall be placed in a location that will allow them to be clearly visible from the street fronting the structure. The height of the address numbers shall conform to Fire Department Standards of eight (8) inches. This notice constitutes a decision of the Planning Department only. Additional permits, including Building Permits, may be required by the Building Department or other City Departments. It is the property owner's responsibility to obtain all necessary permits required for the type of project proposed. In accordance with the provisions of Municipal Code Section 1.12, this decision may be appealed to the City Council within fifteen (15) calendar days of the date of this determination. The appeal RS/CD/g:/NOD/04-096signcdp -4- must be filed, accompanied by a filing fee, prior to 6:00 p.m. by the 15th calendar day following the date of this notice of decision. The action of the Planning Department in reference to the above item may not be appealed to the Coastal Commission.
