NOTICE OF DECISION

This letter is to inform you that the Director of Planning and Building has approved your
application for:
03-109 CDP (San Dieguito Storm Drain- Phase II Project) - Coastal Development
Permit to allow the construction of a storm drainage system along San Dieguito Dr. from
Requeza St. to Melba Rd., Melba Rd. from San Dieguito Dr. to Arden Dr., Arden Dr. from Melba
Rd. to Santa Fe Dr., and Santa Fe Dr. from Arden Dr. to 200 feet east of Arden Dr..
Project Description and Discussion: The City of Encinitas Engineering Department proposes
to install a storm drain along San Dieguito Dr., Melba Rd., Arden Dr., and Santa Fe Dr.. On San
Dieguito Dr. a 48 inch storm drain shall be installed from Requeza St. to Melba Rd.. Catch
basins will be installed along San Dieguito Dr. and will be connected to the 48 inch storm drain
by 18 inch connector pipe. On Melba Rd. a 48 inch storm drain will be installed from San
Dieguito Dr. to 200 feet east of San Dieguito Dr., and a 36 inch storm drain will be installed from
200 feet east of San Dieguito Dr. to Arden Dr.. Catch basins will be installed along Melba Rd.
and will be connected to the 48 inch and 36 inch storm drains by 18 inch connector pipe. On
Arden Dr. a 36 inch storm drain will be installed from Melba Rd. to 240 feet south of Melba Rd.,
and a 30 inch storm drain installed from 240 feet south of Melba Rd. to Santa Fe Dr.. Catch
basins will be installed along Arden Dr. and will be connected to the 36 inch and 30 inch storm
drains by 18 inch connector pipe. Finally, on Santa Fe Dr. a 30 inch storm drain shall be
installed from Arden Dr. to 200 feet east of Arden Dr..
Existing development within and adjacent to the project site consists entirely of residential use.
Topographically, the project site is relatively flat. There are several minor sumps along San
Dieguito Dr., Melba Rd., Arden Dr., and Santa Fe Dr.. San Dieguito Dr., Melba Rd., Arden Dr.,
and Santa Fe Dr. just east of Arden Dr. do not have existing drainage facilities to relieve chronic
ponding and flooding problems. The proposed storm drain system will eliminate these ponding
and flooding problems.
Oil/Water separators will be installed in all catch basins on the project.
The proposed drainage improvements are part of the City's capital Improvement Plan. The
Engineering Department has conducted an environmental analysis of the project, which resulted
in a Negative Declaration that was adopted by the City of Encinitas City Council on June 28,
2000. A standard Public Notice was issued for the Coastal Development Permit on May 20,
2003 which allowed for a 10-calender day public review and comment period. No negative
comments were received as a result of the notice.

FINDINGS FOR A COASTAL DEVELOPMENT PERMIT
STANDARD: Section 30.80.090 of the Municipal Code provides that the authorized
agency must make the following findings of fact, based upon the information presented
in the application, in order to approve a coastal development permit:
1. The project is consistent with the certified Local Coastal Program of the City of Encinitas;
and,
2. The proposed development conforms with Public Resources Code Section 21000 and
following (CEQA) in that there are no feasible mitigation measures or feasible
alternatives available which would substantially lessen any significant adverse impact
that the activity may have on the environment.
Facts: The City's General Plan and Municipal Code are applicable components of the City's
Local Coastal Plan. The project consists of the construction of a storm drain system along San
Dieguito Dr. from Requeza St. to Melba Rd., Melba Rd. from Santa Fe Dr. to Arden Dr., Arden
Dr. from Melba Rd. to Santa Fe Dr., and Santa Fe Dr. from Arden Dr. to 200 feet east of Arden
Dr.. The Public Safety Element of the General Plan specifies goals and policies for the City to
develop and implement a master plan for drainage and flood control and to improve local
drainage systems. The proposed drainage improvements implement the goals and policies of
the General Plan.
Conclusion: Since the project complies with the goals and policies of the General Plan, the
Planning and Building Department finds that the project is consistent with the certified Local
Coastal Program of the City of Encinitas. In addition, required finding #2 is not applicable since
no significant adverse impact is associated with the project.
The approval of this Coastal Development Permit satisfies the requirements of the Encinitas
Local Coastal Program.
Environmental Review:
A Negative Declaration has been prepared for this project, and was acknowledged by the State
Clearinghouse on May 12, 2000 (SCH#2000041042), and adopted by the City Council on June
28,2000.
This approval is subject to the following conditions:
SCI SPECIFIC CONDITIONS:
SC2 This approval will expire on June 4, 2005 at 5:00 p.m., two years after the
approval of this project, unless the conditions have been met or an extension of time has
been approved pursuant to the Municipal Code.
SC6 This project is conditionally approved as set forth on the application and project
plans dated received by the City on May 20, 2003. It consists of 9 sheets including
drainage plans along San Dieguito Dr., Melba Rd., Arden Dr., and Santa Fe Dr., all

designated as approved by the Planning and Building Director on June 4, 2003.
Approved plans shall not be altered without the express authorization of the Planning
and Building Department.
SCA Contractor shall only use City right of way on San Dieguito Dr. from Requeza St. to
Melba Rd., Melba Rd. from San Dieguito Dr. to Arden Dr., Arden Dr. from Melba Rd. to
Santa Fe Dr., and Santa Fe Dr. from Arden Dr. to 200 feet east of Arden Dr. as a
staging/storage area.
SCB All mitigation measures specified in the negative declaration prepared for the
project shall be met.
81 STANDARD CONDITIONS:
CONTACT THE PLANNING AND BUILDING DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION(S):
82 This approval may be appealed to the City Council within 15 calendar days from the date
of this approval in accordance with Chapter 1.12 of the Municipal Code. The appeal
must be filed, accompanied by a $100.00 filing fee, prior to 4:00 p.m. on the 15th
calendar day following the date of this notice of decision. The action of the Planning and
Building Department in reference to the above item may not be appealed to the Coastal
Commission.
83 This project is not located within the Coastal Appeal Zone and may not be appealed to
the California Coastal Commission pursuant to Coastal Act Section 30603 and Chapter
30.04 of the City of Encinitas Municipal Code.
This notice constitutes a decision of the Planning and Building Department only. Additional
permits may be required by the Building Department or other City departments. It is the
applicant's responsibility to obtain all necessary permits required for the type of project
proposed.
