WHEREAS, it is in the interest of the District to arrend its
Mninistrative COOei
NCW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED by
the Board of Directors of San Dieguito Water District as follows:
1. '!hat the San Dieguito Water District .Administrative Code
be arrended. as set forth in Exhibit A hereto.
2. '!hat the San Dieguito Water District Administrative COde
be amended as set forth in Exhibit B hereto.
3. Ohat the foregoing arrendnent shall take effect imrediately.
PASSED AND AOOPI'ED at a regular meeting of the Board of Directors
of San Dieguito Water District held on the 23rd day of January, 1984
by the following vote, to wit:

AMENDMENT TO SAN DIEGUITO WATER DISTRICT
ADMINISTRATIVE CODE
Article 22 of the SAN DIEGUITO WATER DISTRICT ADMINISTRATIVE
CODE is amended to read 25 follows:
Article 22.
Fire Hydrants.
Sec. 22.1.
Ownership.

Sec. 22.2.
Location. Subject to section 22.6
hereof, whenever the District installs a
new water main, it shall also install,
at its own expense, such fire hydrants
as it deems beneficial to provide fire
protection service to the area. Prior
to such installation, the District shall
consult with the Encinitas Fire
Protection District ("fire agency"), but
the San Dieguito Water District shall be
the sole judge of the number, size and
locaton of such fire hydrants.
Sec. 22.3.
New Development. Whenever property is
rezoned, subdivided or otherwise
developed, the owner or developer shall
pay for the installation of such fire
hydrants as the fire agency shall
determine.
Sec. 22.4.
Hydrants Requested By Fire Aqency.
The District shall install additional
fire hydrants, or upgrade existing fire
hydrants, on existing lines of the
District upon request of the fire
agency, developer or property owner,
provided the District determines that it
has facilities to supply adequate water
thereto, and the person or organization
requesting installation pays for the
installation thereof.
Sec. 22.5.
Other New Hydrants. The District may
install additional fire hydrants, or
upgrade existing fire hydrants, on
existing lines of the District, at its
own expense, as it deems beneficial to
provide fire protection service to an
area. Prior to such installation, the
District shall consult with the fire
agency, but the District shall be the
sole judge of the number, size and
location of such fire hydrants.
Sec. 22.6.
Repairs. Repairs of fire hydrants
shall be accomplished by the District.
The fire agency shall remove weeds and
paint hydrants. The District will enter
into written agreement with the fire
agency to implement the foregOing rules
and to provide for the maintenance,

repair, replacement and use of fire
hydrants. The District shall not
install fire hydrants pursuant to
section 22.2 or 22.4 unless such an
agreement has been executed by the fire
agency.
Sec. 22.7.
Use of Fire Hydrants. No person,
other than the District or the fire
agency, shall use a District hydrant for
any purpose without the express written
consent of the District. Fire hydrants
may be used for construction purposes in
the manner provided in Article 20
hereof.
Sec. 22.8.
Liability of District. Nothing
provided in this article shall obligate
the District to install any particular
fire hydrant. Nothing provided herein
shall give any rights to third parties
or increase or otherwise change the
liabilities or responsibilities of the
District to property owners or other
members of the public.

Construction Water.
Use of Fire Hydrants. District fire hydrants may be
used to supply construction water or other temp::.rary
water in the It'anner provided in this article.
Application. Any person desiring to utilize a fire
hydrant for construction or other temporary water
use shall file an application for installation of a
construction rreter on fOITilS provided by the District.

ti.rre of the application which shall be used for the
follcwing purposes:
A dep::>sit against loss or darmge to the construction
rreter or hydrant, which shall be refunded if there is
no loss or damage.
A fee for installation, which shall not be refW1dable.
A "use" fee to be put into an account kept for the
purpose of repairs on hydrants within this District.
A deposit for water charges.
The dep:Jsi t will be refunded ufOn return of the rreter
in gcx:xl condition less the rental fee, the installation
charge and the cost of water used. No interest shall
be paid on the arrount refunded.

Water Rates. Water used through a construction rreter
shall be established by the District.
Location of Meter. The meter shall be la:::ated on the
fire hydrant designated by District. The applicant may
nove the construction IlEter within the sutxlivision
ooundaries only after permission has been obtained fran
the District. Applicant shall not nove the rreter fran
one subdivision to another. If relc:cation fran one
subdivision to another is required, this shall be
aCe<::iTplishcd by a District employee at a charge
established by the District.
