RESOLUTION NO. 92-01
A RESOLUTION OF THE BOARD OF DIRECTORS OF
SAN DIEGUITO WATER DISTRICT ADOPTING THE
WATER SHORTAGE CONTINGENCY PLAN
WHEREAS, the California Legislature enacted Assembly Bill 11
during the 1991 Extraordinary Session of the California Legislature
(An Act to Amend California Water Code sections 10620, 10621, 10631
and 10652, and to add section 10656 to the California Water Code,
relating to water); and
WHEREAS, AB11 mandates that every urban water supplier
providing municipal water directly or indirectly to more than 3,000
customers or supplying more than 3,000 acre-feet of water annually
to develop a Water Shortage Contingency Plan; and
WHEREAS, AB11 mandates that said Plan be filed with the
California Department of Water Resources by January 31, 1992; and
WHEREAS, the San Dieguito Water District is an urban water
supplier within the meaning of the Act; and
WHEREAS, the District has drafted such a plan, made the Plan
available for pUblic inspection at the adjourned noticed meeting
of December 10, 1991; and

NOW THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED
by the Board of Directors of the San Dieguito Water District as
follows:
1. That the Water Shortage Contingency Plan, attached as
Exhibit "A" hereto, is hereby adopted and ordered filed with
the Secretary of the District.
2. That the Secretary of the District be and he is autho-
rized and ordered to file with the Department of Water
Resources of the State of California a copy of the District's
Plan no later than January 31, 1992.
3. That the District shall implement its Plan in accordance
with the schedule set forth in the Plan.
PASSED AND ADOPTED at a regular meeting of the Board of
Directors of the San Dieguito Water District held on the 21st day

CHAPTER I
INTRODUCTION
This Plan has been prepared in compliance with the
mandates contained within Assembly Bill 11X. An amendment to
the Urban Water Management Act, Water Code sections 10610
through 10656 wnich were added by statutes 1983, Chapter 1009,
and became effective on January 11, 1984.
AB 11X requires each urban water supplier to amend their
Urban Water Management Plan to include a Water shortage
contingency Plan, as specified. Plans are to be prepared,
adopted and submitted to the Department of Water Resources by
January 31, 1992.
This Plan is, therefore,
the requirements of AB 11X.
Appendix "A".
A. Preparation & Adoption of Plan
This Plan was prepared by the staff of the San Dieguito
Water District.
A Draft Plan of the Water Shortage contingency Plan was
presented at the San Dieguito Water District Board meeting on
the formal document to satisfy
A copy of AB 11X is included as

December 10, 1991 for the purpose of obtaining public comment
and input from the District's Board of Directors.
The final Plan was adopted by the Board of Directors of
the San Dieguito Water District on January 21, 1992, by
Resolution No. 92-01, included as Appendix "B".

CHAPTER II
WATER SUPPLY AND DEMANDS
A. Supplv bv Source - For the Next Three Years
Historically, imported water purchased from the San Diego
County Water Authority (CWA) has accounted for 65% of supplies.
Local water in Lake Hodges accounted for 35% of supplies. Due
to drought conditions in 1977-78, imported water made up 94% of
supplies. In 1985-86, due to extremely wet conditions, Lake
Hodges water accounted for 59% of total supplies. Under
normal conditions, the figures of 65% imported water and 35%
local water could be used for planning purposes. However, for
"Worst Case" scenarios it should be assumed that no local water
would be available.
Table No. 1 shows the "Worst Case" supply projections.
1989-90 is the Base Year and assumes no local water is
available and imported supply deliveries are reduced by 50%.
The reader is referred to CWA' s contingency Plan for their
supply projections.

B. Normal Demand Reauirements
As identified in the 1990 San Dieguito Water District
(SDWD)
Master Plan,
annual water consumption has been
increasing at a rate of about .12 MGD per year.
However,
agricultural demand has been decreasing and will likely
continue this trend.
Once accounting for approximately 20
percent of the District I s overall usage, agricul tural usage
will drop to between 5 to 15 percent of the District's total
water demand.
Table No. 2 reflects a slight decrease in
agricultural demand beginning in 1991-92 with a corresponding
increase in residential demand.
Currently, single-family customers account for 46 percent
of overall demand followed by multi-family customers at 21
percent of demand.
Figure No. 1 shows five customer
classifications and the percentage of demand.

C. population Trends
The latest growth forecast available from SANDAG shows an
annual growth rate of approximately 1.2 percent. The current
SDWD Master Plan, in determining the ultimate water demand,
also took into account the growth control provisions of the
1989 city of Encinitas General Plan. (It is likely that growth
within the SDWD will experience an increase at a slower rate
than most of San Diego County). See Table No.3.
SANDAG's Series No. 8 Growth Forecast based on the 1990
census for Special District's will not be available until late
Spring or early Summer of 1992.

CHAPTER III
EMERGENCY CONDITIONS
The San Dieguito Water District has several different
water sources, which gives the District multiple options to
weather emergency conditions.
The R.E. Badger Filtration Plant, located in Rancho Santa
Fe, is jointly owned by San Dieguito Water District and Santa
Fe Irrigation District. Unlike most water agencies in San
Diego county, the filtration plant gives San Dieguito Water
District the flexibility to be supplied water by San Diego
county Water Authority's (SDCWA) treated and untreated
pipelines.
Another source of water supply is Lake Hodges. Currently,
San Dieguito and Santa Fe Water District's have agreements with
the city of San Diego to utilize water from Hodges when
available, although the amount of water available cannot always
meet 100% of both District's demands, it would definitely be
invaluable if SDCWA's pipelines failed.
Lastly, if the water supply shortage is primarily focused
on San Dieguito Water District's system, San Dieguito currently
has agreements with neighboring water district's to utilize
existing interconnections.

A. Potential Emeraencv Conditions
The 1990 San Dieguito Water District Water Master Plan
evaluates several potential emergency scenarios and suggests
alternatives to increase the reliability of the distribution
system.
Table No. 4 summarizes the discussion by identifying:
1. The likelihood of the event.
2. The probable duration.
3. The effects.
4. Mitigation options.
See Appendix C,
Chapter 5, Evaluation of Emergency
conditions, Wat~r Master Plan.
It should be noted that the mitigation measures presented
in the Master Plan mostly recommend capital Improvement
Projects involving upgrading the distribution system and
constructing new water storage facilities. It is unlikely that
these measures will be in place within the 3 year time frame of
this contingency Plan.
However, emergency connections and
agreements are in place with neighboring Districts.

The physical interconnection of the District facilities
with those of adjacent water agencies increases system
flexibility and provides alternate sources of water to the
District during emergencies and short-term planned system shut
down. The District currently has system interties with two of
its neighboring water agencies; the Olivenhain Municipal Water
District and Santa Fe Irrigation District. A third intertie is
planned with the Car1sbad Municipal Water District. These
interconnections are for the purpose of transferring limited
amounts of water between agencies during emergencies and short-
term planned, or unanticipated water system outages.
Currently, however, no agency adjacent to the District has
local water supply storage that can satisfy more than a
fraction of its own demands, much less provide additional
supplies to another agency, other than for short-term.

CHAPTER IV
WATER SHORTAGE - MITIGATION OPTIONS
A. Increase Supplies
Since SDWD relies on the San Diego County Water Authority
for the majority of its water supply, any increase in supplies
would have to come from that agency and the reader should refer
to CWA's contingency Plan.
B. Demand RedUctions
In order to mitigate a water shortage, SDWD may implement
any of the following programs or methods to reduce demands.
Water allotments by customer class.
Specific use prohibitions.
Prohibitions against wasteful uses with penalties.
An increasing block rate schedule.
Penalties and/or charges for excessive use.
Mitigation measures for new connections.
Plumbing fixture retrofit programs.
Incentives for conservation, including rebates.
Public information and education programs.
Some of these options are discussed and described in more
detail in the following sections.
1. Determination of Water Manaaement staaes
During water shortages, the District will impose
water uses regulations in stages previously adopted by

Resolution No. 91-20.
(See Appendix "D") The stages are
a sequential, regulatory program of increasingly more
stringent prohibitions on the use and amount of water

delivered within the District. When the District declares
that a particular water management stage is in effect, the
regulations contained in the declared stage are to be
complied with by all persons using water delivered by the
District.
The District will monitor the proj ected supply of
water, both local and imported, and the demand for water.
In conjunction with those agencies providing water to the
District, it will be determined when a particular water
management stage is required in order for the District to
mitigate water shortages.
Water Shortages occur when the amount of water
available from all sources is below the amount ordinarily
available.
Total usage in the Base Year 1989-90 is the
amount of water "Ordinarily Available."

2. Mandatorv Prohibitions
The District has declared, and prohibited, that at no
time shall water be wasted or used unreasonably.
Unreasonable uses of water include, but are not limited
to, the following:
a. Allowing water to leave a customer's property by
drainage onto adjacent properties, public or private
roadways or streets due to excessive irrigation
and/or neglect.
b.
Failure to repair a water leak.
c. using water to wash down sidewalks, driveways,
parking areas, tennis courts, patios or other paved
or hard areas.

Each water management stage also contains
prohibitions on certain water use practices, such as;
specific landscape watering times, washing of vehicles,
filling of swimming pools, operation of ornamental
fountains, etc. Violation of prohibitions may result in
receiving a warning notice, fines, restriction of service
or the discontinuance of service. (See Appendix "D")
3 . Allocations
The allocation system adopted by the District is
intended to be flexible and fair to all customers taking
into account the impacts on business, employment and
quality of life.
The system recognizes those customers who have
conserved and requires those who have used more water to
reduce their consumption by a larger percentage. Each
residential account receives an allocated amount of water
plus a percentage of previous use. The allocation is
based on the District's estimate of average residential
use. The additional percentage of previous use accounts
for seasonal variations in consumpticn. This additional
percentage will change depending on the Stage of required
reductions. Adjustments to a customer's allocation can be
considered for such reasons as: having more than four
permanent people in a single-family home (more than two in
a multi-family unit), where no consumption history exists,
medical reasons, etc. Customers who exceed their
allocation are subject to financial penalties and
possible restriction of service.

The District determined that for residential
customers usage reductions up to 20% (stages 1 - 4) could
be obtained through a combination of public information
programs, education programs, incentive programs and the
inverted block rate schedules. To obtain more than a 20%
reduction (stages 5, 6 & 7) the allocation program would
be implemented. See Table No.5.

4. Excess User Fees
Any customer who violates a water management
allowance when stage 5 or greater is declared to be in
effect, will pay an Excess User Fee in accordance with the
following schedule:
a. First billing period after the effective date of
this resolution will be considered an adjustment
period during which no excess user fee will be
imposed for water usage above one's allocation.
b. First Occasion After Adjustment Period: 3 x the
highest unit water rate charge for the amount used in
excess of the allowance for that customer.
c. Second Occasion After Adjustment Period: 6 x
the highest unit water rate charge for the amount
used in excess of the allowance for that customer.
d. Subsequent Occasions: 9 x the highest unit water
rate charge for the amount used in excess of the
allowance for that customer.
Funds received as Excess User Fees shall be
separately accounted for. The funds shall first be used
to pay for the costs of acquiring excess water and
administrating the provisions of these regulations.
Thereafter, the funds shall be used to fund conservation
programs approved by the District.
S. Water Rates

providing water service. In addition, the new rates
compliment the District's Emergency Water Management Plan
as one of the ways to encourage water conservation. See
Table No.6.
Rate schedules are designed to meet average
conditions for groups of customers having similar service
requirements. The groups of customers within the District
are classified as: 1.) Single-family Residential, 2.)
MUlti-family Residential, 3.) commercial, 4.) Landscape
and 5.) Agricultural.
An acceptable practice for encouraging water
conservation for residential customers is the
implementation of an inverted block rate structure, where
by the unit cost of water increases as the usage of water
increases. To obtain conservation from non-residential
customers, whose usage patterns and amounts vary, an
allocated amount of water is determined for each customer
and usage above that amount is charged at a higher rate.
The Lifeline or Baseline rate is the lowest rate
charged to residential customers. The quantity of water
charged at this rate is considered water used mostly
inside the home (20 HCF bi-monthly for single-family and
12 HCF bi-monthly per dwelling unit for multi-family. 1
HCF = 748 gallons). The Baseline is not adjustable to
individual customer conditions. While most customers will
use more than this amount for both inside and outside
usage, there are those customers whose consumption is

always less than the Baseline. There are those customers
too, who have reduced their consumption so that part of
the year their usage is at or near the Baseline amount.
The Baseline was established to ensure that low-income
customers could afford water for basic use, to recognize
customers who have made an effort to reduce their
consumption and as an incentive for other customers to
conserve. The next block of water used above the Baseline
is considered discretionary interior and exterior use and
the highest block is considered non-essential or excessive
exterior use. See Appendix "E", Resolution No. 91-16.

(1) Existing law requires every w::ban water supplier
serving water directly to customers to',. not later than
December 31, 1985, prepare and adopt an urban water
management plan. Existing law authorizes an urban water
supplier indirectly providing water to customers to adopt an
urban water management plan or to participate in urban
water management planning.
This bill would, instead, require every urban water
supplier, whether serving water directly or indirectly to
customers, to prepare and adopt an urban water management
plan. as prescribed.
(2) Existing law requires the urban water management
plan to include a prescribed description of water supply
deficiencies.
This bill would delete that provision and would require the
urban water management plan to include an urban water
shortage contingency plan, as specified. The bill would

A RESOLUTION OF THE BOARD OF DIRECTORS OF
SAN DIEGUITO WATER DISTRICT ADOPTING THE
WATER SHORTAGE CONTINGENCY PLAN
WHEREAS, the California Legislature enacted Assembly Bill
11 during the 1991 Extraordinary Session of the California
Legislature (An Act to Amend California Water Code Sections
10620, 10621, 10631 and 10652, and to add Section 10656 to the
California Water Code, relating to water); and
WHEREAS, AB11 mandates that every urban water supplier
providing municipal water directly or indirectly to more than
3,000 customers or supplying more than 3,000 acre-feet of water
annually to develop a Water Shortage contingency Plan; and
WHEREAS, ABll mandates that said Plan be filed with the
California Department of Water Resources by January 31, 1992;
and
WHEREAS, the San Dieguito Water District is an urban water
supplier within the meaning of the Act; and
WHEREAS, the District has drafted such a plan, made the
Plan available for public inspection at the adjourned noticed
meeting of December 10, 1991; and

CRAPTER 5
EVALUATION OF EMERGENCY CONDITIONS
In order to supply a safe and reliable water distribution system,
the district must anticipate and plan for a variety of emergency
conditions. This chapter evaluates several potential emergency
scenarios and suggests alternatives to increase the reliability
of the distribotion system. Particularly relevant to the current
study are those emergency scenarios that are mitigated by an ade-
quate supply of treated water storage. Note that an evaluation
of the district's raw water supply and treatment facilities is
beyond the scope of this study; hence emergency conditions af-
fecting these facilities are discussed in general terms only.
More thorough investigations are recommended to evaluate the
reliability of the district's water supply facilities.
Much of the following discussion is summarized in Table 5-1.
SCENARIO ~: DROUGHT

Periods of drought are a common occurrence in Southern Califor-
.nia. During these periods, the water quality of the district's
local supply from Lake Hodges can be expected to diminish to .the
extent that its water is unusable. Fortunately, the district's
access to the SDCWA's second aqueduct has historica~ry provided a
reliable source of both raw and treated water. The stated goal
of the SDCWA, however, is to supply peak week demands to its mem-
ber agencies; it is the responsibility of those agencies to

provide sufficient storage to accommodate the additional demands
of maximum day requirements. It is also uncertain that the SDCWA
will be able to achieve its water supply goals for future
demands. Thus, a drought might cause the SDWD difficulty in
meeting its peak demand requirements.
Ideally, the district should develop raw water storage that is
supplied by the SDCWA aqueduct. Lake Hodges, while a valuable
source of raw water supply to the District, is currently solely
dependent on local water production. A large imported raw water
reservoir could provide long term emergency storage, seasonal
storage, and storage necessary to smooth out peaking in the
treatment plant's demand. since the treatment plant is owned and
operated in association with the Santa Fe Irrigation District
(SFID), it is aavisable to study this option in greater detail in
conjunction with the SFID.

It should also be noted that the Olivenhain Municipal Water Dis-
trict (OMWD) is currently seeking agencies interested in par-
ticipating in the Mount Israel Project, which potentially in-
cludes a 24,000 AF raw water reservoir and treatment plant. This
project could provide the district with a reliable source of
water. The reservoir is well situated to supply the Badger
Filtration Plant either through the SDCWA aqueduct or through an
independent transmission main. If the SDWD is interested in this
project, OMWD will probably need a commitment to participate
within a year. It is recommended that the district initiate a
detailed investigation of the feasibility of participating in the
Mount Israel Project.

Finally, the city of San Diego and the SDCWA are considering
providing a raw water aqueduct supply for Lake Hodges. Under
this concept, the lake would be filled during late winter for use
. in the high demand summer months. The district I s participation
in this effort is encouraged.

SCENARIO 2: RAW WATER SUPPLY FAILURE
Failure of the district's raw water supply could take several
forms: failure of either or both of the SDCWA's pipelines in
their second aqueduct, or failure of the Lake Hodges supply, due
to flume failure, water quality degradation, pump station
failure, etc. As independent events, the failure of the Lake
Hodges supply or the filtered SDCWA pipeline will not have a
major impact on the supply to the SDWD; the surviving raw water
pipeline (with a turnout capacity of 24.6 mgd) should be able to
provide the district's needs.
If the raw wateripipeline failed, much of San Diego county would
"
experience a water shortage. This shortage could not be met by
the filtered water pipeline alone, and the SDWD has no pre-
emptive rights to SDCWA's filtered water during an emergency.
Hence, the consequences for the SDWD could be. analogous to a
failure of both aqueduct pipelines. Also, an earthquake might
easily cause the catastrophic failure of both pipelines.
Finally, since both aqueduct pipelines share a common alignment,
the failure of a single pipeline might wash out the remaining
pipeline. Should any of these events occur, the raw water supply
for both the SDWD and the SFID would be limited to the Lake
Hodges flume capacity, currently rated at about 14 mgd (the raw
water pump station at the San Dieguito reservoir is rated at 18
mgd) . This would mean a loss of approximately 50% of the
district's current maximum day demand until the SDCWA aqueduct
can be repaired, estimated to require about one month.

In order to mitigate this event, four recommendations for further
study are made. First, the district, in conjunction with the
SFID, should investigate making improvements to the Lake Hodges
supply system to increase its capacity. The district should also
consider encouraging or participating with the city of San Diego

Assuming that the Badger clearwell were to remain.in service, the
failure of the Badger Filtration Plant, either for temporary
service or due to a major equipment failure, will have little im-
pact on the district's water supply. The SDCWA filtered water
aqueduct connection should be able to supply the district I s
needs.

SCENARIO 4: BADGER CLEARWELL FAILURE
Because the Badger clearwell is bifurcated, planned maintenance
can be conducted with little interruption to the distribution
system supply. However, there is no clearwell bypass line; any
water delivered to the distribution system, including SDCWA fil-
tered water, must pass through the clearwell. In an emergency,
the clearwell can be bypassed by draining the San Dieguito reser-
voir raw water. line and using it to connect the SDCWA filtered
water line to the 54 inch treated water transmission main. In
such a scenario, the settling basins can be used to equalize flow
demands, but this process would be difficult and require inten-
sive effort to coordinate.
Currently, the clearwell is the exclusive storage for the 409,
410, and 520 zones. The 345 and 240 zones can be served for a
limited time from the Balour reservoir, but a loss of the clear-
well will mean that water supply to the upper zones will be
severely limited.

Although a clearwell failure as described above is an unlikely
event, the construction of a clearwell bypass line is recom-
mended. Also, additional local storage should be constructed and
a pump station to supply the elevated pressure zones should be
considered. Finally, emergency connections with neighboring
agencies should be maintained and additional connections con-
structed if future opportunities develop.
SCENARIO 5: TRANSMISSION MAIN FAILURE
Consideration has been given to a loss of transmission capability
at several different locations.

54" Joint Transmission Main
:~.
The jointly owned 54" transmission main . leading from the Badger
Filtration Plant to the San Dieguito Reservoir is the only fil-
tered water connection between the plant and both the SDWD and
the SFID. When this line is taken out of service, the 30" San
Dieguito Reservoir raw water line can be drained, disinfected,
and used to bypass the 54" line. For scheduled maintenance on
the 54" line this procedure is adequate, but because it is cum-
bersome and time consuming, it is less satisfactory when the 54"
line fails in an emergency. Also, the smaller line severely
limits the amount of water available to both water districts.
Reliability and transmission capability would be enhanced by the
construction of a redundant transmission line paralleling the ex-
isting 54" line. This issue should be investigated further as
one of the many issues affecting both the SDWD and SFID.

High Pressure Transmission Mains
'-
The SDWD operates two high pressure transmission mains that serve
the 520 pressure zone: a 30" and 36" steel line. Bec.ause there
are no reservoirs for the 409, 410 and 520 pressure zones within
the district, these two lines must provide peak hour flows to
these zones, as well as providing maximum day demands to the 345
and most of the 240 zones. Under current demand conditions, and
with the satisfactory operation of the low pressure transmission
line, the failure of either of these transmission lines can be
tolerated reasonably well. As system demands increase, however,
and if the low pressure main is abandoned, the failure of either
of the high pressure lines will put severe stresses on the
remaining line.
Both mains share a common alignment for roughly 9000 ft in En-
cinitas Blvd. A simultaneous failur~ of both of these lines
would have a severe impact on the entire SDWD. All flow to the
409, 410, and 520 zones would be limited to whatever was avail-
able through emergency connections with the OMWD. The demands of
the 345 zone could be met for a time from the Balour reservoir,
but district's ability to fill this reservoir would again be
limited to the capacity of OMWD's emergency connections. The 240
zone could still be supplied through the low pressure main, but
without support from the 345 zone, areas in the north end of the
district will experience degraded system pressures.
The reliability of the distribution system could be enhanced with
the construction of additional local storage, the construction of
redundant transmission capacity, or the construction of a pump
station to boost locally stored water for use in the higher pres-
sure zones.

Low Pressure Transmission Main
The 30" low pressure transmis~ion main is the oldest of the
transmission mains and experiences the most frequent failures.
with the current arrangement of pressure reducing stations
(PRS's) throughout the district, such failures cause a slight
pressure drop (on the order of 5 PSI) in the 240 pressure zone,
but computer analyses indicate that they place undesirable stress
on upstream pressure zones. The construction of additional local
storage would reduce this effect.
SCENARIO 6: LOCAL STORAGE FAILURE
currently, the ~nly active water storage within district bound-
aries is the Balour reservoir. While planned maintenance can be
scheduled for periods of low water demand, a failure of this
reservoir during a period of high demand would place a tremendous
burden on the water distribution system with a corresponding drop
in water pressure. Emergency connections with other water dis-
tricts help reduce this burden. system reliability would be in-
creased with the construction of additional local storage.

SCENARIO 7: DISTRIBUTION MAIN FAILURE
The failure of individual distribution system mains is a rela-
tively common occurrence due to localized const=uction and the
~ging of pipes. The primary defenses against these failures are
the looping of system pipes and the provision of adequate isola-
tion valves.

A RESOLUTION OF THE SAN DIEGUITO WATER DISTRICT
ADOPTING THE "EMERGENCY WATER
MANAGEMENT REGULATIONS"
WHEREAS, San Dieguito Water District ("District" hereinafter)
conducted a noticed, public hearing in accordance with Water Code
section 375 on July 9, 1991; and
The District finds and determines that a water shortage can
arise from one or more of the following conditions:
A. A general water supply shortage due to increased demand
or limited supplies;
B. Distribution or storage facilities of the Metropolitan
Water District of Southern California ("MWD"
hereinafter), the San Diego county Water Authority ("CWA"
hereinafter), or other agencies, become temporarily or
permanently inadequate; or
C. An unexpected disruption or major failure of the supply,
storage or distribution facilities of MWD, CWA, or other
agencies.
The District also finds and determines that:
D. The conditions prevailing in the San Diego County area
and the District require that available water resources
be put to maximum, beneficial use;
E. The waste, unreasonable use, and any unreasonable method
of use of water must be prevented;
F. Encouraging the conservation of water with a view to the
maximum reasonable and beneficial use thereof is in the
interest of the people of the District;
G. There have now been four consecutive years of drought
conditions in the State of California;
H. The california Department of Water Resources has informed
MWD that it will be necessary in 1991 to reduce
deliveries to municipal and industrial contractors;

S. CWA has established procedures to preserve and allocate
available water supplies.
NOW THEREFORE, the Board of Directors of the District resolves
as follows:

Chapter 20.60
EMERGENCY WATER MANAGEMENT REGULATIONS
20.60.010. Purpose. This Chapter establishes a water
conservation policy with regulations and a water conservation and
emergency water management program in order to conserve water
supplies, minimize the effects of water supply shortages, and allow
the District to respond to water emergency conditions. (Cal.
Const. art X, ~~ 2 and 7; and WC ~ 375.)

designated "by public agencies and private schools for specific

a reduction equal to demand of the proposed use. Calculation
of demand and saving shall be performed or verified by the
member agency or the District Manager based upon non-drought
conditions.

4. "Gray Water" means household waste water other than
toilet water, i.e., water from the laundry, shower, tub,
bathroom and kitchen sinks. Its use is presently prohibited
by the San Diego County Department of Health Services. The
exception mentioned for gray water in Section 20.60.700, (1,
d) and (4) depends solely upon approval of such use by the San
Diego County Department of Health Services according to issued
rules and regulations.
5. "Micro irrigation systems/equipment" means low pressure,
low volume methods of water application. These devices
include drip emitters, T-tape, micro sprayers, mini-
sprinklers, twirlers, and spaghetti tubing. Pop-up sprinklers
are not considered low-volume, low pressure irrigation

systems/equipment~
6. "Potable water" means water delivered by a member agency
which meets drinking water standards or water delivered by
the Authority.
7. "Reclaimed water" means water which, as a result of
treatment of wastewater, is suitable for a direct beneficial
use or controlled use that would not otherwise occur. See
Water Code, Section 13050 (n).
8. "Recreational and ornamental lakes and ponds" means
bodies of water which are not swimming pools, water storage
reservoirs for potable water or irrigation purposes, or pools
which maintain rare plant or animal species.
9. "Base year" means Residential (Single-family/Multi-
family) Base Year - July 1, 1989 thru June 30, 1990; Other
(Agriculture/Commercial/Landscape) Base Year - July 1, 1987
thru June 30, 1990.
10. "HCF" 'means water usage measurement; one (1) unit = one
(1) Hundred Cubic Feet, or one (1) HCF = 748 gallons.
20.60.030. Water Conservation.
A. It is the policy of the District that all public and
private users of water delivered within the District shall use such
water for reasonable purposes and in a reasonable manner in a
conscientious effort to conserve water.
B. When the water use regulations in this Chapter are not
declared to be in effect, those regulations may still be considered
as recommended methods for voluntarily conserving water.
C. The District may initiate and maintain education programs
to encourage the conservation of water.
20.60.034 conservation Reaulations.

20.60.040. Water Manaaement Reaulations.
A. Staaes. During water shortages, the District shall
impose water use regulations in stages. Sections 20.60.100 et sea.
of this Chapter contain a sequential, regulatory program of
increasingly more stringent prohibitions on the use of water
delivered within the District. When the District declares that a
particular, water management stage is in effect, the regulations
contained in declared stage shall be complied with by all persons
using water delivered by the District.

B. Declaration of Staae.
1. The District shall monitor the projected supply of water
and the demand for water by persons within its jurisdiction
and, in consultation with those agencies providing water to
the District, determine when water management regulations are
required in order for the District to deal with water
shortages.
2. When it is determined that a particular stage of water
management regulation is required, either the District Board
of Directors or the District Manager may issue a declaration
which will announce the stage of regulatory management that
is to be imposed.
3. The declaration shall be made by public announcement
posted at the District. Also, notice shall be published a
minimum of three (3 ) consecutive times in a newspaper of
general circulation.
4. If the declaration is made by the District Manager, the
matter shall be placed on the agenda of the Board of Directors
of the District at its next meeting. The Board of Directors
shall thereupon ratify the District Manager I s declaration,
rescind the declaration, or issue its own declaration.
5. The regulatory stage announced in the declaration shall
become effective on the date announced in the declaration;
except, when STAGE 7 or greater is declared, the regulatory
STAGE shall become effective immediately upon posting.
20.60.050. Modification of Reaulation. as Applied in Special
circumstances
A. Adiustment Process. Any person subject to the
regulations and decisions imposed in accordance with the provisions
of this Chapter may submit a request for an adjustment, in writing,
to the District secretary-seeking a modification of one or more of
the regulations of this Chapter, as applied to the person's water
use.
B. The District Manager, or designee, shall review the
special circumstances set forth in the adjustment and render a
written decision within 30 calendar days of the receipt of the
adjustment.
C. Review. The Review Board shall consist of two members
of the District Board, appointed by the District Board. The Review
Board shall serve on a rotation basis, as determined by the
District Board.

An appellant who is dissatisfied with the decision of the
District Manager, or designee, may file a request for review by the
Review Board. To be acceptable for filing, the request must be in
writing, be delivered to the District Secretary within ten days of
the District Manager's, or designee's, decision and set forth all
of appellant's reasons as to why the District Manager's, or
designee's, decision was wrong. The decision of the Review Board
is final. There is no appeal to the District Board.
D. Authoritv to Modifv. The District Manager or the Review
Board on review is authorized to make minor and limited
modifications to any regulation in this Chapter when it has been
demonstrated that due to special circumstances, the application of
the unmodified regulation constitutes a threat to health, safety
or welfare or will result in an undue, unreasonable hardship on the
metered customer. Provided, however, that such modification shall
not cause water to be wasted or used in an unreasonable manner and
the purposes of this Chapter can be accomplished.
20.60.060 Prohibition
A. It is 'unlawful for any person to knowingly use water or
permit the use of water supplied by the District in a manner
contrary to any provision of this Chapter declared to be in effect.

B. The use of reclaimed or "gray" water in accordance with
the regulations of the Department of Health Services and in
accordance with any other applicable regulations, is not subject
to the regulations of this Chapter.
C. It is unlawful for any person to knowingly present false
information to the District when information is requested by the
District in accordance with this Chapter.
D. Compliance with this section is

20.60.080 Enforcement. In addition to any other remedies
for enforcing the provisions of this Chapter, a metered customer
who fails to comply with the conditions imposed upon the continued,
uninterrupted delivery of water, shall be subject to the following:

who violates a water management allowance when stage 5 or
greater is declared to be in effect, shall pay an Excess User
Fee in accordance with the following schedule:

usage above one's allocation.

a. The installation of a flow restrictor in the meter
for a minimum of 72 hours; or
b. Discontinuance of water service for a specified
period of time.
5. When it is necessary to install a flow restrict or or to
discontinue service, the customer shall pay a fee of $250.00,
payable by the metered customer as a condition to the
restoration of full service.
c. Prohibited Use
When additional conditions on uninterrupted delivery of water
are declared mandatory or water is wasted or used unreasonably as
defined in Section 20.60.060, the following Prohibited Use fee
shall apply:
1. First Violation. Written warning accompanied
of this Resolution, delivered by mail and/or
customer's door. Notice or letter will emphasize
for further violations.

If said 48 hour period ends on a weekend or holiday, full

72 hour period ends on a weekend or holiday, full service will
be restored during the next business day.
4. Fourth violation. $200.00 surcharge and termination of
service for such a period as the Board of Directors determines
to be appropriate under the circumstances, following a hearing

regarding such issue. written notice of the hearing shall be
mailed to the customer at least ten days before the hearing.
Surcharaes. Additional Charaes. Any surcharge hereunder shall
be in addition to the basic water rates and other charges of the
District for the account and shall appear on and be payable with
the billing statement for the period during which the violation
occurred; nonpayment shall be subject to the same remedies
available to the District as for nonpayment of basic water rates.
In addition to any surcharge, a customer violating this resolution
shall be responsible for payment of the District's charges for
installing and/or removing any flow restricting device and for
disconnecting and/or reconnecting service per the District's
Schedule of charges then in effect. Such charges shall be billed
along with the next water bill; nonpayment shall be subject to the
same remedies as nonpayment of basic water rates.
Non-liabilitv for Damaqe. The customer who violates this
resolution thereby assumes responsibility for injury to the
customer and/or other residents/occupants receiving service,
including emotional distress and/or damage to the customer's
private water system and/or to other real or personal property
owned by the customer or by a third party resulting from the
installation and operation of a flow restricting device or from
termination of service; said customer shall thereby be deemed to
have (1) waived any claim for injury or for damage to the
customer's property which the customer may otherwise have against
the District; and (2) agreed to indemnify, defend and hold the
District harmless from claims by third parties for injury or
property damage arising or claimed to arise out of the District's
installation and/or operation of a flow restricting device or
termination of water service.
Appeals.
A. Procedures. The District Manager, or his designated
representative, shall determine when violations have occurred and
shall issue to the customer a Notice of violation by mailing same
and/or hanging same on the customer's door at least ten days before
taking enforcement action. Said notice shall describe the action
to be taken (notice of first violation shall simply be accompanied
by a copy of this resolution) and shall be mailed or delivered at
least ten days before the proposed action is scheduled to be taken.
A customer may appeal the Notice of violation by filing a written
notice of appeal with the District no later than the close of
business on the day before the date scheduled for enforcement
action. Any Notice of violation not timely appealed shall be
final. Upon receipt of a timely appeal, a hearing on the appeal
by the Board of Directors shall be scheduled at the Board's next
regular meeting or a special meeting scheduled for the hearing; in

either case, the hearing shall be a least ten days following
receipt of the appeal, .and the District shall mail written notice
of the hearing to the customer at least ten days before the date
of said hearing. The decision of the Board of Directors of the
District shall be final and not subject to further appeal.
B. Interim Measures. Pending receipt of a written appeal or
pending a hearing pursuant to an appeal, the District Manager, or
the designated representative, if one has been designated, may take
appropriate steps to prevent the unauthorized use of water as
appropriate to the nature and extent of the violation and the
current declared water condition.
Funds received as Prohibited Use fees shall be separately
accounted for. The funds shall first be used to pay for the costs
of acquiring excess water and administering the provisions of these
regulations. Thereafter, the funds shall be used to fund
conservation programs approved by the District.
20.60.090.

20.60.100. Staae 1: Water Manaqement Reaulations.
A. stage 1 shall be declared to encourage voluntary water
conservation.
B. When stage 1 is declared and in effect, all persons shall
be urged to comply, on a voluntary basis, with all the regulations
of the stage 2 regulatory program and not to exceed the customer
allowance set forth in section 20.60.070 for times when the
ordinary amount of water is available to the District.
20.60.200 staae 2: Water Manaaernent Reaulations.
A. stage 2 shall be declared when the District determines
that water usage should be reduced approximately 10% from the
ordinary demand requirement, as determined by the District.
B. When a stage 2 is declared and in effect, metered
customers of the District shall receive uninterrupted water
delivery subject to the following conditions:
Reduction of Use
Each metered customer shall use water in an amount no more
than the allowance set forth in Section 20.60.070 when the
water available to the District is 10 percent less than the
amount ordinarily available. No metered customer shall exceed
their allowance.

When stage 2 is declared and in effect the following
Prohibitions of Use shall apply. The District shall determine at
the time of declaration that compliance is either mandatory or
voluntary.
1. Lawn watering and landscape irrigation is permitted only on
designated irrigation days and only between the hours of 4:00
p.m. and 9:00 a.m. the following morning. A "designated
irrigation day" is determined by the last digit in the street
address. Properties with addresses ending in an even number
may use water on even numbered days, and addresses ending in
an odd number may use water on odd numbered days.
Watering is permitted at any time if a hand-held hose equipped
with a positive shut-off nozzle is used, a hand-held bucket
or a drip micro irrigation system is used.
2. Agricultural users and commercial nurseries as defined in the
Metropolitan Water District code are exempt from stage 2
restrictiorrs, but will be required to curtail all non-
essential water use. The watering of livestock and
propagation beds are permitted at any time.

5. The filling, refilling or adding of water to uncovered
swimming pools, spas, wading pools, artificial lakes and ponds
is permitted only on designated irrigation days and hours as
defined in Item No. 1 above.
6. The use of water from fire hydrants shall be limited to fire
fighting and related activities, for construction activities
or other activities necessary to maintain the health, safety
or welfare of the public.

7. All restaurants are prohibited from serving water, except when
specifically requested by the customer.
8. The operation of ornamental fountains that do not recycle
water is prohibited.
20.60.300 Staae 3: Water Manaaement Reaulations.

ordinary demand requirement, as determined by the District.

amount ordinarily available. No metered customer shall exceed

the time of declaration that compliance is either mandatory or

mobile car wash operations using high pressure hoses and
nozzles not using reclaimed water shall be reduced in volume
by an amount to be determined at the time of declaration.

where health, safety, or welfare of the public is contingent
upon frequent vehicle cleaning such as garbage trucks or
vehicles used to transport food or perishables.

Prohibitions of Use shall apply. The District shall determine at
the time of declaration that compliance is either mandatory or
voluntary.

Lawn, turf and landscape irrigation shall be limited to one
day per week, between the hours of 4:00 p.m. and 9:00 a.m. the
fOllowing morning. Properties with addresses ending in an
even number may use water on Saturday evenings until the
following morning, and addresses ending in an odd number may
use water on Sunday evenings until the following morning.
Homeowner's Associations, shopping centers and other
commercial users may use water on Wednesday evenings until the
following morning. Watering is permitted on any day between
4:00 p.m. and 9:00 a.m. if a hand-held hose equipped with a

or a drip/micro irrigation system is used.
2. The washing of automobiles, trucks, trailers, boats, airplanes

the health and safety or welfare of the public is contingent
upon frequent vehicle cleaning.

A. stage 6 shall be declared when the District determines
that water usage should be reduced approximately 40% from the
ordinary demand requirement, as determined by the District.
B. When a stage 6 is declared and in effect, metered
customers of the District shall receive uninterrupted water
delivery subject to the following conditions:
Reduction of Use
Each metered customer shall use water in an amount no more
than the allowance set forth in section 20.60.070 when the
water available to the District is 40 percent less than the
amount ordinarily available. No metered customer shall exceed
their allowance.
Additional Conditions on Uninterrupted Deliverv:
Prohibited Uses
When stage 6 is declared and in effect the following
Prohibitions of Use shall apply. the District shall determine at
the time of declaration that compliance is either mandatory or
voluntary.
1. No outdoor watering shall occur between 9:00 a.m. and 4:00
p.m. except when using reclaimed or gray water (solely upon
approval of such use by the county of San Diego Health
Services according to issued rules and regulations). Anyone
using such water shall post signs of such usage. watering is
permitted one day a week using a hand-held hose with a
positive shut-off nozzle, a hand-held bucket or a drip/micro
irrigation system.

determines that water usage should be reduced approximately 50%
from the ordinary demand requirement, as determined by the
District.
B. When a Water Emergency is declared and in effect, metered
customers of the District shall receive uninterrupted water
delivery subject to the following conditions:
Reduction of Use
Each metered customer shall use water in an amount no more
than the allowance set forth in section 20.60.070 when the
water available to the District is 50 percent less than the
amount ordinarily available. No metered customer shall exceed
their allowance.
Additional Conditions on Uninterrupted Deliverv:
Prohibited Uses
When Stag~ 7 is declared and in effect the following
Prohibitions of Use shall apply. The District shall determine at
the time of declaration that compliance is either mandatory or
voluntary.
1. Irriaation of Turf. Irrigation of turf is prohibited
except under the following circumstances:
a. For active public park and school ground areas no
more than twice weekly;
b. At day care centers, where required by license, no
more than twice weekly;
c. For purposes of maintaining public safety (such as
fire protection);
d. When using reclaimed water, gray water, or private
well water; and
e. At public parks, where trees and shrubs are
interspersed amidst turf supported by the same
irrigation system provided the area of irrigation
is within the drip line of each tree or shrub and
irrigation is no more than once every two weeks.
2. Irriaation of Ground Cover. Irrigation of ground cover
is prohibited except under the following circumstances:
a. For fire protection;

Irrigation of ground cover as allowed under subsection B,

3. Irriaation of Trees. Shrubs. Includina Aaricultural
Production. Outside irrigation of trees, shrubs and other
plants which are not turf or ground cover, is allowed only by
hand-held hose with positive shutoff nozzle, bucket, or micro
irrigation systems/equipment. Sprinkler systems may only be
used for agricultural production, watering active public park
and school ground areas, maintenance of ground cover in
accordance with subsection B, subsubsection 2 of this Section
and for purposes of maintaining public safety, such as fire
protection.
4. Irriaation Waterinq Hours. No outdoor irrigation shall
occur between 9:00 a.m. and 4:00 p.m., except when using a
micro irrigation system/equipment, or for agricultural
production, or when using reclaimed water, gray water or
private well water. Anyone using such alternative water
sources shall post signs along public rights of way noticing
the type of usage.
5. Hosina or Spravina of Paved or Hard Surfaces. Hosing
paved or hard surfaces including, but not limited to,
sidewalks, driveways, patios, streets and parking areas is
prohibited except for compelling public health and safety
reasons. Allowed hosing activities shall be done only with
a hose equipped with a positive shutoff nozzle.
6. Runoff and Repairina of Leaks. All runoff, except
natural runoff from property, is prohibited. Leaks to
irrigation and plumbing systems shall be immediately repaired.

and ornamental lakes and ponds may not be filled or refilled
except with reclaimed water or other non-potable water. Lakes
and ponds utilizing reclaimed water or other non-potable water
must post signs noticing such usage.
9. Golf Course Irriaation. Golf courses may use potable
water supplied by the District only to irrigate tees and
greens. Irrigation of fairways and roughs with potable water
or any blend thereof is prohibited. Golf courses irrigating
with reclaimed water or other non-potable water shall post
signs noticing such usage.

perm~t has been heretofore issued, no new potable water
serv~ce shall be provided, no new temporary meters or
permanent meters shall be provided, and no commitments (such
as, will serve letters, certificates or letters of
availability) provide potable water service shall be issued,
except for the following circumstances:
a. The commitment includes a notice that a water shortage
emergency condition prevails resulting in a water
moratorium and no water service is currently available;
b. For projects necessary to protect the pUblic's health,
safety and welfare;
c. When it can be demonstrated that no net increase in water
use will occur; or

REVISING WATER RATES
WHEREAS, on March 26, 1991, the Board of Directors of San
Dieguito Water District directed that notice be given and a
public hearing be held on April 16, 1991 on the necessity to
revise water rates; and
WHEREAS, such hearing was duly and regularly convened at
the board room of the city of Encinitas and at said hearing all
interested persons were given an opportunity to be heard; and
WHEREAS, the Board of Directors of authority finds that it
is in the interests of the District to revise its water rates;

We have completed the requested analyses to develop water rate schedules
for the various stages of water reduction set forth in the District's
proposed Water Conservation and Emergency Water Management Program. The
results of our analyses are presented on the attached exhibit. [n
designing the alternative water rate schedules, we have endeavored to
maintain the same base rate for at least some minimum quantity of
residential usage. Thus, low volume residential users who diligently
work to reduce their usage in accordance with usage restrictions will
continue to pay the same price per unit of water. This means that they
will see a reduction in their water bills. We have also structured the
rates such that an average residential user who reduces his or her usage
commensurate with the required reductions will basically receive the
same water bill. Users who do not reduce consumption can expect
significantly increased bills.
We have not incorporated the penalty provisions of the District's
Resolution into the rate schedule. Therefore, the charges for excess
use only vary from $2.39 per HCF under Stage 1 to $3.00 per HCF under
Stage 7. However, these rates are to be multiplied by 3,6, and 9
respectively as called for in Section 20.60.080 should customers exceed
their allowances under Stages 5,6 or 7. Thus, the penalty could be as
high as $27.00 per HCF under Stages 6 or 7 if a customer continues to
exceed his or her stated allowance.

The rates for each alternative have been designed to recover the
. required level of revenue assuming no water will be sold at the excess
use rate. For Stages 1,2 3 and 4, the requirement is $5,229,000. For
Stages 5,6 and 7 the amount was reduced to approximately $4,7000,000.
We assume that all customers will reduce their usage as required. Any
revenues from penalties can then be used by the District to pay
surchages to the County Water Authority and/or be used for water
conservation programs.
In the attached exhibit, the rates for Stage 1 are the original ones we
developed during our study. The rates for Stage 3 are the ones shown in
our report. The rates for Stages 5,6, and 7 are the same as those

presented at the March 26 Board meeting, except for the excess use
charges. As discussed above, those charges have been reduced from the
levels indicated at the March 26 meeting because the Board opted for the
3,6,9 penalty provision. This means that the excess use charge need not
be the penalty rate. Rates for Stages 2 and 4 are extrapolations. We
feel confident that they would generate sufficient revenues.
For Stages 1,2,3 and 4 we would recommend that the District develop
individual allocations for only non-residential users. For Stages 5,6
and 7 all users should have allocations. We believe that usage
reductions up to 20 percent are obtainable from residential customers
through a combination of a good public relations program and the
proposed inverted block rate schedules. To obtain more than a 20
percent reduction from residential users, utilities have found it
necessary to implement allocation programs.
Because all our rate designs assume certain changes in customer
behavior, it is.likely that actual revenues may vary from projected
levels by as much as 5 to 15 percent. Variance towards the high side is
considered more likely for the higher stages of water reduction. It
will simply be too difficult for some users to cut back 30, 40 or 50
percent. For the lower stages of reduction, it would be possible to
have higher revenue shortfalls if customers overreact to the
requirements.

DISTRICT WATER RATES
NOTICE IS .HEREBY GIVEN that the Board of Directors of San
Dieguito Water District will conduct a public hearing regarding a
proposed revision of District water rates.
The hearing will be held at an adjourned meeting, Tuesday,
