RESOLUTION NO. 2005-20
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINIT AS,
CALIFORNIA DECLARING ITS INTENTION TO ESTABLISH THE ENCINIT AS
LANDSCAPE AND LIGHTING DISTRICT NO. 2005-1 FOR FY2005/2006 AND
OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO
WHEREAS, the City Council of the City of Encinitas adopted Resolution No. 2005-19
initiating proceedings for the formation of the Encinitas Landscape and Lighting District No.
2005-1,
(hereinafter referred to as the "ELLD No. 2005-1 It); and,
WHEREAS, at this time there has been presented and approved by this City Council, the
preliminary Engineer's Report ("Report") as required pursuant to the provisions of Streets and
Highways Code Section 22586 and Section 4(b) of Article XIIID of the Constitution of the State
of California ("Article XIIID"), and this City Council is desirous of moving forth with the
proceedings for said annual levy.
NOW, THEREFORE BE IT RESOLVED that the City Council ofthe City of Encinitas
does hereby order as follows:
1. That the above recitals are all true and correct.
2. NOTICE IS HEREBY GIVEN THAT AT 6:00 P.M., JUNE 15, 2005, AT THE
REGULAR MEETING OF THE ENCINITAS CITY COUNCIL, AT THE CITY
COUNCIL CHAMBERS, 505 S. VULCAN AVENUE, ENCINIT AS, CALIFORNIA, IS
THE TIME AND PLACE FIXED BY REFERENCE FOR A PUBLIC HEARING AS
REQUIRED BY THE LIGHTING AND LANDSCAPING ACT OF 1972 AND
ARTICLE XIID, AT WHICH ANY AND ALL PERSONS HAVING ANY OBJECTION
TO FORMATION OF THE ASSESSMENT DISTRICT, MAY APPEAR AND SHOW
CAUSE WHY SAID ASSESSMENT DISTRICT SHOULD NOT BE ESTABLISHED
IN ACCORDANCE WITH THE RESOLUTION OF INTENTION ADOPTED BY THE
CITY CO1.JNCIL. THE CITY COUNCIL OF THE CITY OF ENCINIT AS WILL
CONSIDER ALL ORAL AND WRITTEN OBJECTIONS OR PROTESTS.
3. The City Clerk shall cause to be mailed to the record owner of each parcel to be assessed
within the boundaries of the proposed assessment district at least 45 days prior to the date of
the public hearing a Notice which describes the proposed assessment and shall contain a
ballot whereby the property owner may indicate his or her support or opposition to the
proposed assessment.
4. The City Clerk shall caused to be published a notice pursuant to Section 6063 of the
Government Code. The publication of notice of hearing shall be completed at least 10 days
prior to the date of hearings.
