RESOLUTION NO. TC 00-01
A RESOLUTION OF THE TRAFFIC COMMISSION
OF THE CITY OF ENCINIT AS
RECOMMENDING ESTABLISHMENT OF A SPEED LIMIT OF 25 MPH ON BALOUR
DRIVE BETWEEN MELBA ROAD AND SANTA FE DRIVE
WHEREAS, Section 40802 of the Vehicle Code requires that an Engineering and Traffic
Survey be conducted on non-local streets or highways where enforcement involves the use of
radar or other electronic devices,
WHEREAS, Section 515 of the Vehicle Code defines the requirements for qualifying a
street as a residence district,
WHEREAS, Section 22352 of the Vehicle Code defines the prima facie speed limit as 25
mph in any residence district,
WHEREAS, the City has determined that Balour Drive qualifies as a local street and is in
a residence district and the reasonable speed limit for Balour Drive between Melba Road and
Santa Fe Drive is 25 mph,
NOW THEREFORE, the Traffic Commission of the City of Encinitas does hereby
recommend to the City Council that a 25 mph speed limit be adopted for Balour Drive between
Melba Road and Santa Fe Drive.
