A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ENCINIT AS APPROVING A DESIGN REVIEW PERMIT TO ALLOW
FOR THE RENOVATION OF AN EXISTING MOTEL SITE, INCLUDING
THE ADDITION OF A 660 SQ. FT. PORTE-COCHRE,A SWIMMING POOL,
ENCLOSURES OF STAIR CASES AND RAILINGS, AND CONSIDERATION
OF A REDUCTION OF PARKING STANDARDS FOR THE
PROPERTY LOCATED AT 133 ENCINITASBLVD.
(CASE NO. 98-054 DR; APN: 258-090-26)
WHEREAS, a request for consideration of a Design Review Permit application was filed by
the Trigild Corp. to allow for the renovation of an existing motel, including the addition of a 660 sq. ft.
porte-cochre, a swimming pool, enclosures of stair cases & railings, and consideration of a reduction
of parking standards in accordance with Chapter 23.08 of the Encinitas Municipal Code, for the
property located in the VSC Zone, legally described as:
That portion of the Northwest Quarter of the Northwest Quarter of Section 15, Township 13 South,
Range 4 West, San Bernardino Meridian, in the County of San Diego, State of California, according to
Official Plat thereof, and more fully described in the title report from Westland Title Co., No. 212316-
2, dated 2-25-93, and contained in the project file.
WHEREAS, the Planning Commission conducted a noticed public hearing on the application
on April 23, 1998, at which time all those desiring to be heard were heard; and
WHEREAS, the Planning Commission considered, without limitation:
1. The April 23, 1998, agenda report to the Planning Commission with attachments;
2. The General Plan, Specific Plan, Municipal Code, and Associated Land Use Maps;
3. Oral evidence submitted at the hearing;
4. Written evidence submitted at the hearing;
5. Application dated received by the City on March 13, 1998,
6. Application dated received by the City on March 13, 1998, and Project Plans dated
received by the City on April 7, 1998, consisting of 6 sheets including cover sheet, land
survey (two sheets), site plan, dimension floor plan, and building elevations.
7. Parking Accumulation Curve Analysis and parking count submitted by the applicant.
WHEREAS, the Planning Commission made the following findings pursuant to Chapter
23.08 of the EncinitasMunicipal Code:

NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Encinitas hereby approves application 98-054 DR subject to the following conditions:

BE IT FURTHER RESOLVED that the Planning Commission, in its independent
judgment, finds that this project is categorically exempt from environmental review
pursuant to Section 15301(e) of the California Environmental Quality Act (CEQA)
Guidelines.

FINDINGS
Findings for Desil!n Review
Standard: Section 23.08.072 of the Encinitas Municipal Code provides that an
application for a design review permit must be granted unless, based upon the
information presented in the application and during the Public Hearing, the
authorized agency makes any of the following regulatory conclusions:
A. The project design is inconsistent with the General Plan, a Specific Plan, or the
provisions of the Municipal Code.
Facts: The project site is located in the VSC zone and the subject motel use is permitted
by-right therein. The applicant proposes to initiate architectural and site enhancements
to the project site, including the addition of a 660 sq. ft. porte-cochre, a swimming pool,
enclosures of stair cases & railings, and consideration of a reduction of parking standards
to accommodate the pool.
Discussion: As noted, the subject use is permitted by right. Architectural enhancements
and site modifications are proposed which comply with development standards. A
reduction of parking requirements is requested on the basis of information submitted by
the applicant, indicating that the actual parking demands of the site should not exceed
149 spaces at peak usage. The site will provide a total of 153 spaces, four in excess of
the anticipated peak. The Traffic Engineer has reviewed the information submitted and is
in agreement with its conclusions.
Conclusion: The Planning Commission determines that the proposed use is consistent
with the General Plan and with all applicable development standards, and that the
information submitted justifies the proposed reduction in parking requirements.
B. The project design is substantially inconsistent with the City's Design Review
Guidelines.
Facts: Chapter 23.08 of the Municipal Code contains Design Review Guidelines with
which the authorized agency must find the project substantially consistent in order to
grant approval.
Discussion: 1. Site design: With regard to Design Guidelines 1.1 -1.11, the Commission
finds that the proposed project adequately addresses these required elements.
Specifically, regarding Guideline 1.4, the project adequately provides for views "to the
site" in that the project proposes architectural enhancements to an existing motel

building. By enclosing existing exposed stairways and railings, by adding an auto
canopy to match the existing building, and by adding a pool feature in an area presently
occupied with paving, the overall appearance of the site will be enhanced. With respect
to views "through the site", the project will not result in the blockage of any significant
VIews.
2. Building design: The project will add a 660 sq. ft. auto canopy ("Porte Cochere"),
architecturally integrated with the primary building, and will make other architectural
enhancements to the existing building. The overall site modifications will constitute an
improvement to the property and will therefore comply with Design Review Guidelines
2.1 - 2.12. Regarding Guidelines 2.3 - 2.6, as discussed above, the project would
constitute an enhancement to the property and surrounding area.
3. Landscape Design: With the addition of the pool and associated landscaping, to be
located in an area now consisting of paving, an overall enhancement to the appearance of
the site will be realized.
4. Sign Design: No sign modifications are proposed with this application. Any future
sign modifications would be required to receive approvals from the City.
Conclusion: The Commission finds that the building, site, and landscape design
substantially comply with the Design Review Guidelines, and would constitute an
enhancement to the project site and the surrounding area.
C. The project would adversely affect the health, safety, or general welfare of the
community.
Facts: The project consists of minor alterations to a legal-conforming use. The project
is exempt from Environmental Review, as per CEQA Section 15301 (e).
Conclusion: The Commission finds that the project would not adversely affect the
health, safety, or general welfare of the community.
D. The project would cause the surrounding neighborhood to depreciate materially in
appearance or value.
Facts: The applicant proposes to initiate architectural and site enhancements to the
project site, including a 660 sq. ft. porte-cochre, a swimming pool, enclosures of stair
cases & railings.
Discussion: The project consists of voluntarily initiated enhancements to an existing
site. The overall project therefore will constitute an enhancement to the surrounding
area.

Conclusion: The Commission finds that the project would not cause the surrounding
neighborhood to depreciate materially in appearance or value.

CONDITIONS
Project No.: 98-054 DR
Applicant: Trigild Corp.

SCI SPECIFIC CONDITIONS:
SC2 This approval will expire on April 23, 2000 at 5:00 pm, two years after the approval
of this project, unless the conditions have been met or an extension of time has been
approved pursuant to the Municipal Code.
SC5 This project is conditionally approved as set forth on the application dated received
by the City on March 13, 1998, and revised project plans dated received by the City
on April 7, 1998, consisting of 6 sheets including cover sheet, land survey (two
sheets), site plan, dimension floor plan, and building elevations, and shall not be
altered without express authorization by the Community Development Department.
SCA Any future sign modifications on the project site shall receive appropriate approvals
from the City prior to installation.
SCB Fencing enclosing the pool area shall be metal vertical pickets, the specific design
for which must be approved by the Community Development Department prior to
building permit issuance. Fencing shall not be chain link.
Gl STANDARD CONDITIONS:
CONTACT THE COMMUNITY DEVELOPMENT DEPARTMENT REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
DRI Any future modifications to the approved project will be reviewed relative to the
findings for substantial conformance with a design review permit contained in
Section 23.08.140 of the Municipal Code. Modifications beyond the scope
described therein may require submittal and approval of an amendment of the
design review permit by the authorized agency.
G2 This approval may be appealed to the City Council within 15 calendar days from the
date of this approval in accordance with Chapter 1.12 of the Municipal Code.

G4 Prior to building permit issuance, the applicant shall cause a covenant regarding
real property to be recorded. Said covenant shall set forth the terms and conditions
of this grant of approval and shall be of a form and content satisfactory to the
Community Development Director.
G5 Approval of this request shall not waive compliance with any sections of the
Municipal Code and all other applicable City regulations in effect at the time of
Building Permit issuance unless specifically waived herein.
Bl BUILDING CONDITION:
CONTACT THE ENCINITAS BUILDING DIVISION REGARDING
COMPLIANCE WITH THE FOLLOWING CONDITION(S):
B2 The applicant shall submit a complete set of construction plans to the Building
Division for plancheck processing. The submittal shall include a Soils/Geotechnical
Report, structural calculations, and State Energy compliance documentation (Title
24). Construction plans shall include a site plan, a foundation plan, floor and roof
framing plans, floor plan(s), section details, exterior elevations, and materials
specifications. Submitted plans must show compliance with the latest adopted
editions of the California Building Code (The Uniform Building Code with
California Amendments, the California Mechanical, Electrical and Plumbing
Codes). Commercial and Multi-residential construction must also contain details
and notes to show compliance with State disabled accessibility mandates. These
comments are preliminary only. A comprehensive plancheck will be completed
prior to permit issuance and additional technical code requirements may be
identified and changes to the originally submitted plans may be required.
