A RESOLUTION OF THE ENCINITAS PLANNING COMMISSION
APPROVING A MAJOR USE PERMIT AND NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT
FOR GRADING AND LANDSCAPE IMPROVEMENTS TO AN EXISTING PUBLIC
PARK NORTH OF "D" STREET ACROSS FROM
ITS INTERSECTION WITH CORNISH DRIVE
WHEREAS, a request for a Major Use Permit to allow grading
and landscaping improvements in order to accommodate more
active recreational uses of an existing public park was filed
by the City of Encinitas; and
WHEREAS, a public hearing was conducted on the application
by the Old Encinitas Community Advisory Board on March 24, 1988
at which the Community Advisory Board recommended Planning
Commission approval of the Major Use Permit for the proposed
improvements as submitted; and
WHEREAS, the Planning Commission conducted
hearing on the application on May 10, 1988; and

WHEREAS, the Planning Commission considered:
The staff report dated May 4, 1988;
The project grading and landscaping plans;
Written evidence submitted at the hearing;
Oral testimony given at the hearing; and
WHEREAS, the Planning Commission found that:
The location, size, design or operating characteristics of
the proposed project will be compatible with and will not
adversely affect or be materially detrimental to adjacent
uses, residences, buildings, structures or natural
resources, with consideration given to, but not limited
to:

(a)
The inadequacy of public facilities, services, and
utilities to serve the proposed project;
(b)
The unsuitability of the site for the type and
intensity of use or development which is proposed;
and
(c)
The harmful effect, if any, upon environmental
quality and natural resources of the City.
This is because the subject property is presently
neighborhood serving public park, which is not
proposed to be changed by this application. A
Negative declaration of Environmental Impact has been
prepared, and all necessary public services and
facilities are in place to maintain it.
The impa~ts of the proposed project will not adversely
affect the policies of the Encinitas General Plan or the
provisions of this Code, because the subject property is
identified as a neighborhood park in the recreational
facilities plan contained in the City's Draft General
Plan.
The project complies with all other regulations,
conditions or policies improved by the Municipal Code.
NOW THEREFORE, BE IT RESOLVED that Major Use Permit
Application 88-042 MUP is hereby approved and the associated
Negative Declaration of Environmental Impact certified subject
to the following conditions:
Prior to permit issuance, the developer shall provide
evidence of a Coastal Development Permit or Notice of
Exemption from the California Coastal Commission
satisfactory to the Community Development Department.
NOTE:
This approval is for the proposed grading and
landscape improvements only. Any other future
improvements to the site shall be subject to
Community Advisory Board review and approval.
