A RESOLUTION OF THE ENCINITAS PLANNING COMMISSION
APPROVING A TENTATIVE MAP FOR CONVERSION OF
NINE EXISTING RESIDENTIAL UNITS
INTO A ONE LOT AIRSPACE CONDOMINIUM FORM OF OWNERSHIP,
LOCATED AT 660 WESTLAKE STREET (87-138TM)
WHEREAS, a request for approval of a Tentative Map was filed
by Mr. Anthony Mahon for conversion of nine existing residential
units into a one lot airspace condominium form of ownership for the
property located at 660 Westlake Street, legally described as Lot
11 of Rancho Requeza, in the County of San Diego, State of
California, according to the Map thereof No. 2133, filed in the
Office of the County Recorder of San Diego County October 11, 1928;
and
WHEREAS, a public hearing was conducted on the application by
the Old Encinitas Community Advisory Board on February 18, 1988,
and on March 15, 1988 by the Encinitas Planning Commission; and
WHEREAS, the Planning Commission considered:
1. The staff reports dated January 20, 1987, February 11,
1988 and March 7, 1988;
2. The Tentative Map submitted by the applicant;
3. Oral evidence submitted at the hearing,
4. Written evidence submitted at the hearing.
NOW THEREFORE, BE IT RESOLVED Tentative Map 87-138TM is hereby
approved subject to the following conditions:

Prior to recordation of a Final Map, the applicant shall
submit satisfactory evidence to the Community Development
Department that the provision of the State Map Act
relating to notification to tenants that a conversion
condominium has been applied for (Section 66452.8,.9
et.al.) have been complied with if occupancy of any one
or more of the dwelling units has been allowed.

Each living unit shall be provided with approved
detectors of products of combustion other than heat
conforming to the latest U.B.C. standards, mounted on the
ceiling or wall at a point centrally located in the
corridor or area giving access to rooms used for sleeping
purposes.
Maintenance 'of Fire Protection Systems. Ail fire
hydrants, fire alarm systems, portable fire extinguishers
and other fire protective appliances shall be retained in
an operable condition at all times.
Each unit shall have at least 200 cubic feet of enclosed
weather-proofed and lockable private storage space in
addition to closets customarily provided. Such space may
be provided in any location approved by the Department of
Planning and Community Development, but shall not be
divided into two or more locations.
Each dwelling unit shall be separately metered for gas
and electricity. A plan for equitable sharing of
communal water metering shall be developed prior to final
map approval and include in the covenants, conditions and
restrictions.
A laundry area shall be provided in each unit; or if
common laundry areas are provided, such facilities shall
consist of not less than one automatic washer and dryer
· for each five units or fraction thereof.
The applicant shall furnish the Community Development
Department with a Coastal Development Permit or Notice of
Exemption from the California Coastal Commission prior to
recordation.
Prior to recordation of the Final Map, the applicant'
shall obtain final occupancy approval for the structures
and furnish the Community Development Department with
satisfactory evidence of such approval.
Prior to final occupancy, the owner shall pay all
development fees required under the City of Encinitas'
Municipal Code, including flood control,traffic
mitigations, fire mitigation, and park fees.
Prior to recordation of the Final Map, the owner shall
execute a recordable covenant with the City for the
purpose of notifying all prospective residents of the
project of the presence of licensed dog kennels in the
vicinity.

Note: Pursuant to city of Encinitas Subdivision Ordinance
Section 24.50.130, the Final Map must be recorded on or before
5:00 p.m. on March 15, 1991, or this approval will no longer
be valid.
PASSED AND ADOPTED this 15th day of March, 1988, by
the following vote, to wit:
