APPROVAL OF MINUTES: Commissioner Bagg made the following corrections: Meeting of September 27, 1988: Add: Commissioners Absent: Les Bagg. Mr. Bagg noted Mr. Hirsch's comment and stated that his absence was not a reflection on the occasion of the resolution presented to Mr. Hirsch. MSP (Slater/Fernald) to approve. Vote: 3-0 (Bagg abstained) Meeting of September 20, 1988: MSP (Bagg/Fernald) to approve. Vote: 4-0 Meeting of August 23, 1988: Commissioner Bagg asked for confirmation of Commission decision that inspections on the wall on the Frick property be on an annual basis. CASE NUMBER: 88-109 APPLICANT: Carolynne Manka LOCATION: 758 Rancho Santa Fe Road DESCRIPTION: Acceptance of Resolution relative to approval of the fence height Variance application to exceed the 3.5' allowable fence height in the exterior side yard setback by 2.5' for a total fence height of 6'. Staff stated that the applicant has asked for the following changes: Page 6A-3 -- 1. strike residential use as no longer her residence. -- 3. (4th line). Change: "The adjoining residents of the residential uses..." To: "One of the adjoining residents of the residential uses..." Page 6A-4 -- 3. Staff thought the gate was to be locked. Dr. Manka feels that was not the Commission's direction. The Commission confirmed that it was to be a . locked gate. Dr. Manka asked if she abandoned the request for a variance would she have to "do these things". Staff replied, "No, and the present fence would need to be removed." Dr. Manka asked that this item be pulled from the Consent Calendar. MOTION: Commissioner Slater to remove 6A from the Consent Calendar. Staff Report. Dr. Manka feels that to blow a horn each time the gate is to be used would create additional "hassle". It may be necessary to use the gate for handicapped and elderly clients. state requirements include accessibility for these special groups for all businesses. Dr. Manka also feels that she cannot accomplish grading to construct a road. Staff asked if a statement were obtained from the resident by the applicant, would the Commission be agreeable. Applicant: Carolynne Manka, 758 Rancho Santa Fe Road. She is not comfortable asking the resident for a statement. Would like to be able to abandon the procedure as it is not solving her problem. Commission Discussion: Commissioner Slater stated that she could not support the gate not being locked unless the other party is present. commissioner Hano supports unlocking the gate on a "emergency" basis only which could be accomplished by Dr. Manka's staff as clients are scheduled. If a compromise could be reached by the applicant and the resident, she would support that compromise. She asked if staff could . get in touch with the resident. staff replied that they could do this. Staff stated if a complaint is received, Code Enforcement would verify and the Variance could be revoked. Dr. Manka referred to page 6A-4, Item 2. She suggested that the "good neighbor" fence be constructed only if the existing fence had to be taken down. Commissioner Hano felt this was the case and Commissioner Slater stated only if completely reconstructed. MOTION: Commissioner Slater to continue this item to the November 15 meeting. Lot line adjustment and minor modification to major use permit 84-031 necessary to delete one lot and unit from previous County approval. ENVIRONMENTAL STATUS: Previous Negative declaration certified by County of San Diego in conjunction with subdivision review and approval. Approved on the Consent Calendar. C. CASE NUMBER: 88-188 MUP/DR/EIA APPLICANT: D.E.B. Development LOCATION: 1725 Olivenhain Road DESCRIPTION: Major Use Permit, Design Review and Environmental Initial Assessment for a day care center in a residential zone, maximum . number of children not to exceed 120. ENVIRONMENTAL STATUS: Negative declaration pending certification. Staff Report: New Encinitas CAB recommends approval. Originally 144 students proposed. New residents of adjoining subdivision and applicant agreed to reduce students to 120. Removing two classrooms and reducing staff by two; freeing up more parking spaces. One concern of the residents of the McMillin subdivision and the applicant was regarding the City's acoustical consultant stating that the noise attenuation wall along Olivenhain Road be 8 feet high. Mr. Kamp indicated that when study done, the computer model used a 8' high truck and a 5' person -- to soften the noise to an acceptable level would need a 8' high wall. Preschool people would be 3 feet tall. with a build out of 45,000 ADT along Olivenhain Road a 6 foot wall would be high enough. Would continue the aesthetics of existing wall at the subdivision. A new Plot Plan was given to staff by the applicant which the Board members have not received. The building has been reduced by about 800 sq.ft. Changes need to be made to the resolution that the CAB approved. . Commissioner Bagg asked if the sign for the project will be in the same script and letter style as the sign for McMillin's subdivision: material, color, etc. (Yes) PCMR1/0CT25-88.MIN (12/15/88) 5 II P.C. Min. 10/25/88 . Public Hearing opened at 8:05 PM. Timothy D. Ramsey, Biggs Engr., for D.E.B. Development, 11388 Lake Rim Road, San Diego, CA 92131. Page 7C-5. At the last Community Advisory Board meeting, residents and CAB agreed to: 1. Hours of Operation - could be 6 AM to 6:30 PM. 2. Adul t meetings - instead of 1 night per month that 18 meetings be authorized per year. No classes will be held on weekends. 5. Number of students in playground at any one time. Outdoor area up to 24: agreed the number not be counted but the noise level is to be between 60-65 decibels. Has no objections to the 6 foot attenuation wall. Page 7C-6. 1. six feet high along Olivenhain Road. 2. Signage - same as McMillin tract. 3. Playground area - 75 sq. ft. per child is still computed on 144 children. No. of classrooms is not being reduced, the size of classrooms being reduced. 4. Topography - children basically 14 feet below the upper wall. 5. Underground parking; adjacent property owners on the south side have asked for a 6 foot wall . three feet back. With suggested landscaping they will never see the wall. commission Discussion: Commissioner Slater asked about an aide to sign people in and out so that they would not have to go in and out of the building, tying up parking spaces. Applicant stated one space is allowed for drop off. Ken Krysko, 2411 La Pluma Lane, Carlsbad, CA 92009, representing Early Explorations. Above procedure not necessary for full day children. Do plan to have someone go outside to assist in the signing in and out for a half day program (if offered). Douglas Barnhart 16981 Via Tazon, San Diego 92127. There are a couple of changes on the agreement per existing agreement with homeowners: Page 5 - The hours of 6:00 AM-6:30 PM are correct. Need to add: 1. There would no class on the weekends. 2. A covenant is to be entered into stating there would no staff parking on the street. . commissioner Bagg emphasized that it should be very pointed that staff will not park on the streets. Min. 10/25/88 if the number 65 refers to no more than 65 children would . be on the playground at a given time. staff stated the 24 (Page 7C-5, last line) is what was used in previous daycare resolutions. Mr. Barnhart Page 7C-6: 1. There is to be downlighting in the parking area. 2. The building would be 800 sq.ft. less (6600 square feet), creating two more parking spaces. Page 7C-4, h. (last paragraph): The size of building would be approx. 6600 sq.ft. instead of 7400 sq.ft. Public Hearing closed at 8:20 PM. Commission Discussion: Commissioner Fernald supports using the noise level (decibels) instead of number of children. Two prints with revision date of 9/28. Square footage discussed-- determined that there is approximately 6300 square feet in the current design. commissioner Bagg made the following corrections to the . resolution: Page 7C-3: 1) Add August 16 to CAB meeting. 2) After October 3, should be an "and". 3) Blank under 2 - October 20, 1988. Page 7C-5: 1) Item 1 (Specific Conditions) - change hours to 6:00-6:30 and add no classes on weekends. 2) Parent meetings are to be 18 nights per year. 3) Add absolutely no employee parking on the street. 4) Item 5 - change language to state decibel level with some way to monitor--only on complaints or on a regular basis. Staff stated if a complaint, the County Noise Officer would go out. Asked about 65 students. Commissioner Bagg stated the important thing is the noise level. Page 7C-6: 1) Item 6. Add language that indicates downlighting. Since now there will be a 6 foot high wall, might be a place to get lighting into the parking lot. 2) Item 7. Is this a 5 foot wall or fence? . Min. 10/25/88 to be 6' high. commissioner Bagg stated that . the wall along Olivenhain Road is a 6' wall. 3) The sign is to match the subdivision. Page 7C-8: 1) Item M (top of page) - submitted/modified - pick one of them. Should be "as modified". 2) Item 2A - site "plan" not "plans". Indented paragraph should be removed. Also the said site plan is approved. Better be on the drawings. Color board goes into the file. Page 7C-10: 1) Fire requirement is heavy duty. Item 7A is a standard condition but isn't really necessary because of road along there. One design issue: Hip appendage not large enough to be treated that way--should be treated the same as the trellis over the entry way. Not enough to make a statement. Now that building is smaller, treating those two elements the same would be preferable. The columns are fine. MOTION: Commissioner Bagg to approve the resolution with the corrections/additions listed above. Second: Commissioner Slater . Applicant: Didn't want that architecture anyway-- prefers the trellis. It was a compromise in one of the meetings in order to look more like a residence. commissioner Bagg stated that either a trellis or a solid roof would be acceptable, whichever works best. Staff asked that the applicant provide a plan which reflects the changes and elevations of what they will be building--a modified plan and elevation sketch. David L. Weiland, 2727 Hoover Avenue, National city 92050., representing . McMillin Communities, Scotts Valley Partnership. The recommendation was from McMillin. Their preference would be a hip treatment over the entry as well instead of the two trellis. Commissioner Fernald felt the trellises could be connected with a fascia. Commissioner Bagg felt the hip treatment would be too heavy--the aim is to keep the building low and as far back as possible. Trellis looks more residential. APPLICANT: st. John's Church LOCATION: 1001 Encinitas Boulevard DESCRIPTION: Modification of Major Use Permit for Phase 2 of st. John's Church for redesign of an Approximately 14,000 sq. ft. Parish Center and offices, and to allow placement of two temporary classroom/office trailers on site until completion of the permanent structures. ENVIRONMENTAL STATUS: The proposed modification is consistent with the Negative Declaration previously approved and certified for the church complex. Approved on Consent Calendar. E. Referral of General Plan Review Items to the Planning commission for consideration and recommendation. The Chair stated the absent member wants to be present. Since one member has not been for all the hearings the Chair stated there should four members that know the issues well. Would like to honor this request. Staff stated hesitancy because of emergencies that occur. Commissioner Slater stated she feels prepared and the Commission needs to go ahead. . Staff stated Commissioner Reed could submit her comments in writing; the Commission cannot delegate the veto power. This was agreeable. This is a report item, not a public hearing as indicated on the agenda. CIRCULATION PLAN (PP 7E-1,2) (See attached) MacKinnon Avenue - Delete from Circulation Element Map south of Via Cardiff; designate via Cardiff as a Local from MacKinnon south to Birmingham. General plan projected about 8,000 local trips. County General Plan calls its villa Cardiff. (same as Via Cardiff) - should be Villa Cardiff. Support above recommendation. VOTE: 4-0 Orpheus Avenue - Delete from Circulation Map between Leucadia Blvd. and Vulcan Avenue. 3-4,000 a day projected. VOTE: 4-0 Lake Drive. Delete from the map south of Birmingham. VOTE: 4-0 Requeza Street and Nardo Road. Delete Requeza east of Westlake . and Nardo south of Requeza from the map. Traffic for Nardo is 2,000 ADTs and Requeza is about the same. Commissioners Hano asked date of last study. Staff stated that the Terry Austin PCMR1/0CT25-88.MIN (11/2/88) 9 ~ P.C. Min. 10/25/88 study on the sphere did not change these earlier figures. . Commissioners Slater and Hano questioned the validity--feels it would be more like 6,000 ADTs. Commissioners Fernald and Slater would like to see both remain as Locals. Commissioner Bagg is neutral but feels they carry more than 2,000 ADTs. Commissioner Hano stated Santa Fe Drive via Nardo to Requeza carries the largest volume--intense. Most traffic goes down Westlake. Entire length of Requeza should be a Local. VOTE: 4-0 that it remain a Local. Village Park Avenue. Delete from Circulation Elememt Map north of Mountain vista. Commissioner Hano stated the Encinitas Union School District Board has requested again that this road be opened. Commissioner Bagg doesn't support opening this road. Council doesn't feel it should be opened. Commissioner Fernald feels that something should tie through to Rancho Santa Fe Road and stated that a good portion of Olivenhain residents agree. VOTE: 2-2 (Fernald and Hano opposed) (Staff stated tie vote is a denial.) Quail Drive connection - Sidonia to Saxony: Council did try to better define where the alignment of Quail Drive would occur connecting to Saxony. The important issue . was that it would connect to Leucadia Boulevard and beyond, north to Sidonia. It is shown going through an existing residential area, connecting to Quail Hollow. It should occur east of Sidonia. Exact alignment is uncertain and exact impact is uncertain. commission reviewed attached information handed to them at the beginning of this meeting. Commissioner Slater asked if improper to consider because it did not go through environmental review as required by CEQA. Staff stated "no problem"--not that specific. When alignment study occurs, this review would be made. If Sidonia--what effect on the project? Commissioner Hano asked about impact on Quail Hollow. If alignment is not on Sidonia, there would be a potential impact on Quail Hollow. Council is specifically saying they did not want it on Sidonia or on the residential areas to the east. Question is where. Important to connect Leucadia to Saxony. Commissioner Slater stated it should not impact existing neighborhood. Saxony Hills map has been recorded. Sidonia extension does not affect the subdivision--allowances have been made. . Commissioner Fernald asked about effects on canyons, etc. Staff stated there is a severe drop to get to Sidonia. Commissioners Slater and Hano recommend none of the above, should look for another route; another route that would impact the existing neighborhood and the development in the least possible way. Bob Warren stated there is a distinct possibility that it can work with a minor impact. commissioner Bagg stated that the connection does not need to be designed to freeway standards. Can have some severe corners. Commissioner Slater stated it should be a residential road. Commissioner Hano mentioned the Speaker Slips from Coast Savings, Apec Engineering. Though not taking testimony, the Commission can ask questions. Commissioner Bagg stated connection needs to be made. Specific alignment of the road needs to impact the residential and environmentally sensitive areas as little as possible. Design a road that fits the terrain. Slater concurs. VOTE: 3-0 (Hano abstains) commission Hano asked what impact will that road have on the proposed map. She stated that they agreed to single family . detached. If the road goes through, would they have to go back to original proposal which is not single family? If back to first plan, does it open it up again. commissioner Slater feels this is set forth in the attached letter. Bill Leonard, l6935 W. Bernardo Drive, San Diego 92127, representing Coast Savings made a statement that this item was noticed as a public hearing and placed on the agenda under Public Hearings. They were advised by city staff that it was a public hearing. Staff stated it was not noticed, only listed on the agenda. Mr. Leonard asked that the letter (attached) be received into the record. LAND USE PLAN: (Page 7E-2) Southeast quadrant of El Camino Real at Olivenhain Road. Council recommends Specific Plan. Gives greater control. Bagg recommends support. VOTE: 4-0 Residential density allowance related to constraints. (See page 7E-22, Recalculation of Slope Density Analysis Per Council Request.) Council adding flood plain. A developer could achieve maximum density by making specific findings to the approving authority. These would include exceeding the . minimum development standards of the Zoning Code or the project is providing significantly more public improvements that what is required or more recreational facilities. commissioner Bagg PCMR1/0CT25-88.MIN (11/2/88) 11 P.C. Min. 10/25/88 asked if these bonus benefits are specified in the Zoning . Ordinance. staff responded that these are only examples of how it is implemented. council is talking about mid-range and maximum density and slope density; therefore this item needs to be referred back to Planning Commission. commission Bagg stated his concern was that another benefit might be thought up not covered by Zoning Code. Staff stated the Council's sliding scale should be included in the General Plan and needs Planning commission input. commissioner Bagg commented, "Good, but no proven tie between slope and restriction on building on it. Strictly a density reduction tool. Not a given that "the steeper the land the more dangerous." Commissioner Fernald stated Method 3 gives a break to slope over 25%. Doesn't mind giving them more, but the question is what percentage. Commissioner Hano stated with slopes and other constraints, a certain 300-acre parcel out in Olivenhain is likely to get only 40 dwelling units. Does not support the double constraints. Design Review is going to be the whole plan. Commissioner Fernald stated that a fair amount of this parcel is steep hillside and steep creek beds. Commissioner Bagg asked how many residences approved on Rheingold - 58. This would take it down to 35 or 47 (mid- range/maximum). Commissioners Fernald and Slater support Council recommendation . -- Method 3). Commissioner Bagg feels Method 3 is the best of the four methods being considered, but he has a problem with cutting density using slope. VOTE: 2-2 (Hano/Bagg feel there is a better way.) Various commercial land use designations: VSC to General Commercial and Local Commercial to Office Professional: - Northeast quadrant of LaCosta at railroad right-of-way. 100-150 feet at deepest part and a triangle. Return to residential. VOTE: 4-0 support to return to residential. - Northwest corner of Leucadia Blvd. at i-5. from General Commercial to visitor-Serving Commercial. VOTE: 4-0 to support. - Northeast corner of Leucadia Blvd. at Vulcan. Change from General Commercial to Local Commercial. (7-11). Mistake. VOTE: 4-0 to support. - East side of Vulcan between Leucadia Blvd. and Union. Show school district lots as public/semi/public. Remainder presently shown as General Commercial (GC); Local Commercial (LC) and Office Professional (OP) . considered; proposed for OP. Bank would be OP; local restaurant would be LC. Min. 10/25/88 including Bunyards. commissioner Bagg stated he has . difficulty including Bunyards. commissioner Slater asked if LC would be okay for Bunyards. Commissioner Bagg asked about the strip along Vulcan - depth varies. Mobile home park would be MHP. Bunyards now has General Commercial (C-2). If and when they are not there, doesn't see that strip as being the shape that would encourage GC. OP would be better. Staff stated that Bunyards would be able to expand, but a like use would not be able to take its place. If assured not damaging Bunyards operation, would support OP as the most reasonable long-term use of the land. Commissioner Slater concurs. Commissioner Hano stated that if using the same percentage as used to add onto a nonconforming house, doesn't agree. Commissioner Fernald stated this should be addressed in the Zoning Code. VOTE: 3-1 (Hano against) (Bagg, Slater, Fernald Agree that a provision that current business be protected must be included.) - Water District Office on "D" Street, from GC to Publici Semi-Public. VOTE: 4-0 - Northeast, southwest and southeast corners of Birmingham at I-5. Change from GC to VSC. VOTE: 4-0 . - Northeast and northwest corners of Mountain vista Drive at Village Parkway. GC to LC (7-11); Public/Semi-Public for fire station. VOTE: 4-0 - Southwest corner of Encinitas Blvd. at Manchester. LC to OP except for corner gas station site. VOTE: 4-0 - Southeast corner of Encinitas Blvd. at Manchester ("Village West" Shopping Center) LC to GC. Permitted uses discussed. commission felt that many of the uses in a GC zone would be inappropriate at this commercial site. Development standards may be different between a GC and LC zone. VOTE: 4-0 to support LC - Southwest corner of "J" at Second Street: show corrected location of Post Office under Public/Semi-Public; show private lot north of Post Office as GC. Commissioner Hano supports keeping residential including the Post Office site. commissioner Bagg has reservations about the private lot; it should remain residential.
