RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS FINDING
AND DECLARING PUBLIC INTEREST AND NECESSITY FOR ACQUIRING AND
AUTHORIZING CONDEMNATION AND IMMEDIATE POSSESSION OF CERTAIN
REAL PROPERTIES AND PUBLIC STREET RIGHT-OF-WAY IN FEE, SLOPE AND
DRAINAGE EASEMENT, A PRIVATE DRIVEWAY AND SUPPORTING SLOPE
EASEMENT, AND TEMPORARY CONSTRUCTION EASEMENT INTERESTS
THEREIN FOR QUAIL GARDENS DRIVE EXTENSION PROJECT
WHEREAS, the City of Encinitas is a general law city of the State of California;
WHEREAS, in connection with its municipal purposes, it appears necessary for the City of
Encinitas to acquire certain public street right--of-way in Fee, slope and drainage easement, pdvate
driveway and supporting slope easement, and temporary construction easement interests in certain
real properties;
WHEREAS, public interest, convenience and necessity require the acquisition of public
street right-of-way in Fee, slope and drainage easement, a private driveway and supporting slope
easement, and temporary construction easement interests for Quail Gardens Ddve Extension
Project purposes ("Project") in the real properties more particularly described and depicted in the
attached deeds and Exhibits "A" and "B" thereto;
WHEREAS, a Mitigated Negative Declaration was prepared in compliance and adopted on
November 15, 2000, by City Council Resolution No. 2000-84;
WHEREAS, said Project is planned and located in a manner that will be most compatible
with the greatest public good and the least private injury;
WHEREAS, said real properties, and public street right-of-way in Fee, slope and drainage
easement, a pdvate ddveway and slope easement, and temporary construction easement interests
therein, are necessary for the Project;
WHEREAS, portions of said real properties are being acquired in fee and a pdvate ddveway
and supporting slope easement intere_sts as Substitute Property as defined in California Code. of
Civil Procedure Section 1240.310 to be exchanged for necessary property and/or that is reasonably
necessary and appropriate to provide replacement access to the public road to owners that will be
cut off from access to the public road and/or as uneconomic Remnants that will be left in such size,
shape, or condition as to be of little market value pursuant to California Code of Civil Procedure
Section 1240.410;
WHEREAS, said real properties are located entirely within the territorial limits of the City of
Encinitas;
WHEREAS, the City of Encinitas is authorized to acquire said real properties, and public
street right-of-way, slope and drainage easement, a pdvate driveway and slope easement, and
temporary construction easement interests therein by eminent domain pursuant, inter alia, to
California Constitution Article 1, Section 19; California Government Code Sections 37350.5, 39732,
39790, 39792, 40404, and 66410, et seq.; California Streets and Highway Code Sections 5101 and
5102; and California Code of Civil Procedure Sections 1240.010, 1240.110, 1240.120, 1240.320,
1240.330, 1240.350, 1240.410, 1240.430 and 1255.410;
WHEREAS, the City of Encinitas claims an interest in portions of the real properties being
acquired pursuant to Irrevocable Offers of Dedication; said portions required by the Project to be

accepted by the City and in those portions not required for the Project, the City will quitclaim its
interest therein as part of the Project;
WHEREAS, offers to purchase the required interests in the real properties necessary for the
Project have been made to the owners of record pursuant to Section 7267.2 of the California
Government Code which offers have not been accepted; and
WHEREAS, the City of Encinitas has provided notice to the persons designated in Section
1245.235 of the Code of Civil Procedure, and has provided all such persons a reasonable
opportunity to appear and be heard on the matters referred to in Section 1240.030 of the Code of
Civil Procedure.
NOW THEREFORE, BE IT RESOLVED that the Council of the City of Encinitas finds and
determines and hereby declares, by a vote of not less than two-thirds of its members, as follows:
1. That the above recitations are true and correct.
2. That the staff report and all evidence taken at the hearing of this matter have been
reviewed and considered.
3. That the public interest, convenience and necessity of the City of Encinitas and the
inhabitants thereof require the public street improvements and appurtenances
thereto in connection with the Project.
4. That the public street improvements and appurtenances thereto to be constructed
upon, over, under, along, and across the real properties described and depicted in
the attached deeds and the Exhibits "A" and "B" thereto, have been planned and
located in the manner which will be most compatible with the greatest public good
and the least private injury.
5. That the real properties, and public street right-of-way in Fee, slope and drainage
easement, a private driveway and slope easement, and temporary construction
easement interests therein, are described and depicted in the attached deeds and
the Exhibits "A" and "B" thereto, are necessary for the proposed Project.
6. That it appears reasonably necessary and appropriate to acquire portions of the real
properties in Fee and a private driveway and supporting slope easement interests
as Substitute Property and/or as Remnants to exchange for necessary property
and/or to provide replacement access to property owners who would be cut off from
access by the Project.
7. That offers, as required by Section 7267.2 of the California Government Code, has
been made to the owners of record of the properties to be acquired, and notice and
opportunity to appear before the City Council as required by Section 1245.235 of the
Califomia Code of Civil Procedure has been given.
8. That the City of Encinitas and all appropriate officers, representatives and attorneys
are hereby authorized and directed to acquire the real properties described and
depicted in the attached deeds and Exhibits '%" and "B" thereto, in the name of and
on behalf of the City of Encinitas, and to that end are hereby authorized and directed
to commence and prosecute an action or actions in eminent domain for the purpose
of acquiring said real properties and the public street right-of-way, slope and

drainage easement, a private driveway and slope easement, and temporary
construction easement interests therein for Quail Gardens Drive Extension Project
purposes and to obtain an order for immediate possession in the manner provided
by law.

ate of recordation of executed deed, 2) effective date of court of competent

iht of entry, and ending 35 days after recordation by City or its
contractor of a certificate of completion of project or ~ days whichever
is earlier, over, under, along and across all that real property situated in
