1995-019 Requeza Assessment RESOLUTION NO. 95-19 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS DESIGNATING THE DIRECTOR OF ENGINEERING SERVICES AS SUPERINTENDENT OF STREETS AND DESIGNATING THE FINANCIAL SERVICES MANAGER TO COLLECT AND RECEIVE ASSESSMENTS AND DIRECTING THE CITY FINANCIAL SERVICES MANAGER TO ESTABLISH A SPECIAL FUND FOR Assessment District No. 93-1 (Reoueza Street/Bracero Road) WHEREAS, by Resolution No. 95-18, this City Council confirmed an assessment on lands lying within Assessment District No. 93-1 (Requeza Street/Bracero Road) and ordered the assessment and diagram to be filed in the office of the City Engineer, acting as the Superintendent of Streets, and to be recorded in the Office of the County Recorder; and WHEREAS, it appears that the Financial Services Manager is covered by a blanket fidelity bond covering the faithful performance of the duties impose by law in an amount deemed by this City Council to be adequate; and WHEREAS, under the provisions of Section 10424 of the California Streets and Highways Code, funds collected by the Financial Services Manager pursuant to an assessment under the Municipal Improvement Act of 1913 are required to be placed in a special fund designated by the name of the improvement proceeding; NOW, THEREFORE, the City Council of the City of Encinitas DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: SECTION 1. There is hereby created a special fund to be held by the Financial Services Manager known as the "Assessment District No. 93-1 Improvement Fund". SECTION 2. The Engineer of Works is authorized to send a notice regarding the collection of assessments and the Financial Services Manager is hereby designated to collect and receive all funds paid on account of the assessment levied upon lands in Assessment District No. 93-1 (Requeza Street/Bracero Road) and the Financial Services Manager is directed to place all funds so received in the aforesaid Assessment District No. 93-1 Improvement Fund. Said notice shall provide that the assessee has 30 days from the lien date to pay the assessment in cash. If an assessment is paid within said 30-day period, the assessee shall pay the assessment less 18.6% thereof which discount represents the amount of the bond reserve fund and the approximate bond discount which will be required for bonds issued to represent unpaid assessment.
